sale with respect to said premises for the sum 0f $37,000.00, a
copy of said agreement of sale being attached hereto as Exhibit "E"
and being made a part hereof BS though fully set forth.

The sale price for said renl estate is the full fair market
value as evidenced by the appraisal of Chas. Adler & Son. attached
hereto as Exhibit "c" and made a part het'eof as though fully. set
forth.

Said rea1'es~ate was financed to the extent of :one hundred
per cent of its value at date of purchase on July 15, 1977, and
a mortgage pay-off of $31,082.19 as of April 18, 1979, is attached
hereto as Exhibit "c" and made a part hereof as though f.ullyset
f.orth.

After deducting the mortgage pay-off, the per diem interest
upon the mortgage together with delinquency assessments, broker's
commissions, .Veterans' Administration points, taxes and other
customary expenses of sale, there will be less than $1,000.00
distributable to the estate.

Al though the es ta te will. be insolvent for tax purposes, there
will be sufficient assets to satisfy the creditors upon reduction
of the customary attorney and fiduciary fees.

The Petition of JAYNE \oJ, STEHART, Administratrix of the Estate
of llarold D. Stewart. Deceased, by her Attorney, Hayne F, Shade,
Esquire, respectfully represents. as follows:
1.
Petitioner, JAYNE iI. STE\lART, is an adult indi.viclual who reside
at 18 Conway Drive, Mechanicsburg, Cumberland County, Pennsylvania,

On February 1. 1979, Letters of Administration were granted to
Petitioner by the Register of Hills of Cumberland County,
Pennsylvania, upon the Estate of the above-named Decedent who died.
intestate. on November 26, 1978, a resident of East Pennsboro
Township, Cumberland County, Pennsylvania.

On December 22, 1978, a surety bond was filed with said Registe.
of Wills in the amount of $6,000.00 with Hestern Surety as surety.

The total value of the personal estate was $5,391.54,
5.
No real estate has been sold from the estate prior to the
filing of this Petition,
6.
Among the assets of Decedent were his personal residence, a
single story frame dwelling, located at 312 College Hill Road,
Enola, East Penl'.sboro Township. Cumberland County, Pennsylvani.a,
more particularly described in a Deed from George H. Gilbert and
Sandra K. Gilbert, his wife. to Decedent, portions of which Deed
are attached hereto IlS Exhibit "A" and made a part hereof as thougl
fully set forth.

On April 22, 1979, Petitioner entered into an agreement of
sale with respect to said premises for the sum of $37,000.00.

Said IOlgreement called for Veterans I Administration financing.
9.
Because the appraisal of the fair market value of said premises
by the Veterans' Administration was in the amount of only
$34.800,00 and would have required certain repairs to the premises
at that value, the sale pursuant to said agreement of April 22.
1979, became impossible of performance,

Upon petition of Petitioner pursuant to the said agreement of
April 22, 1979, your Honorable Court entered an Order on May 28.
1979, authorizing the sale of said premises upon entry of addition
security in the amount of $3,000.00.

On July 30, 1979, Petitioner entered into an agreement of sale
with respect to said premises for the sum of $34.200.00, a copy of
said agreement of sale being attached. hereto as Exhibit "B" and
being made a part hereof as though fully set forth.

Said real estate was financed to the extent of one hundred
percent of its value at date of purchase on July 15, 1977, and a
mortgage pay-off of $31,082.19 as of April 1B, 1979, is attached
hereto as Exhibit "e" and made a part hereof as though fully set
forth.

Although the purchase price in the agreement of sale of
July 30, 1979, is $2,800.00 less than the purchase price in the
initial agreement, the Estate will stand in a nearly identical
position to its position under the initial agreement because there
