Gentlemen:
Pursuant to Section 1001(1) of the Inheritance and Estate Tax Act of
1961 (72 P. S. ~ 2485-1001), a PRDTEST is entered against the CollUlDn1~ea1th's
appraisemcnt filed in the Office of the Register of Wills of ClDJ1berland
Coun:t)' on July 16, 1979 in the estate of the above named decedent.
.
James L. Mitten and Joan A. l-Iitten, executors, filed an inheritance tax
return reporting as the only asset subject to inheritance tax five bank
accounts with Commonwealth National Bank on Schedule "E", Jointly o.med
Property. The executors reported all five accounts at one-half taxable and
showed a total figure for the decedent's one-half interest of $38,571.04.
In completing his appraisement, the COIrnllonwealth's appraiser, Leo
Fulginiti, accepted the return as filed. The jointly held property was
appraised for inheritance tax purposes at $38,571.04. However, in the
execution of his appraisement, as well as the notice of filing of the appraise-
ment fozwarded to the executors, the Commonwealth's appraiser indicated the
value of the property for inheritance tax purposes ,~as only $35,571.04.
Although Petitioner believes this is nothing more than a typographical error,
he is making this objection known under Section 1001 of the 1961 Act to
insure that the interest of the COImlOll'~ea1th is properly protected.
Petitioner contends the proper value of the assets is as reported by
the executors, $38,571.04. Therefore, Petitioner respectfully requests the
Board approve an increase in the appraisement filed in the estate of Clara
F. Mitten on July 16, 1979 from $35,571.04 to $38,571.04.
