I, PAUL H. SWARNER, of South Middleton Township, Cumberlan
County, Pennsylvania, declare this to be my last will and testament an
revoke all wills which I have previously made.
I I give and devise to my brother, F. Albright Swarner
my undivided one-half interest in the parcel of land containing approx
imately 30 acres situate in South Middleton Township, Cumberland Count,
Pennsylvania, and titled jointly in the names of myself and my brother
F. Albright Swarner.
II I give and devise my farm of 123 acres, more or les
situate in South Middleton Township, Cumberland County, Pennsylvania,
to my brother, F. Albright Swarner and my nephew, Harold Swarner,
and if either be deceased, to the survivor of the two of them.
III All the rest, residue and remainder of my estate,
real and personal, wherever situate, after the payment of my debts,
funeral expenses, inheritance, estate and death taxes and expenses
of administration, I give, devise and bequeath to my sister-in-law,
Frances Swarner, if living, and if deceased one-half to my nephew,
Harold Swarner and one-half to my niece, Doris Wickard.
IV I appoint Farmers Trust Company as Executor of
this Will.
IN WITNESS WHEREOF, I have hereunto set my hand and seal
this 22nd day of November, 1978.

AND Nbw, to wit, this 26th day of August, 1980, the
First and Final Account of Farmers Trust Company, Executor under
the Will of Paul II. Swarner, deceased, having been confirmed and
decree of distribution in said estate having been ordered, in
conformity thereto, it is ordered, adjudged and decreed that the
following described real estate be awarded as follows:
To: F. Albright Swarner and Harold Swarner, as tenants in common.
ALL the following described tract of land situate in
South ~Iiddleton Township, Cumberland County, Pennsylvania, and
bounded and described as follows, to wit:
BEGINNING at a point; thence by lands now or late of F. W. Searight,
deceased, North 1/4 degree West 242.2 perches to a stonej thence
by lands now or formerly of McGreagor, North 68 3/4 degrees East,
131.8 perches to a stone or point in road; thence by lands now or
formerly of H. Stuart, deceased, South 60 1/2 degrees East, 3.5
perches to stone at side of lanej thence by land now or formerly
of Joseph R. Hosler, South 27 degrees West, 141.8 perches to point
in road; thence by land now or formerly of ~Iaggie Ritner, South
14 3/4 degrees West, 50.6 perches to stone in west side of road;
thence by same South 61 1/2 degrees East, 71.5 perches to a stonej
thence by land now or formerly of W. Albright, South 49 degrees
West, 76.5 perches to iron pin in road; thence by same South 11
degrees East, 9 perches to point in said road; thence by land now
or formerly of Jane Gill, South 70 degrees West, 56.2 perches to
the place of beginning. CONTAINING 121 Acres and 15 Perches,
strict measure.

BEING the same premises which Effie Albright Swarner, widow, by
deed dated ~Iarch 23, 1950, and recorded December 21, 1960, in
Cumberland County Deed Book 20 "B" 1136, granted and conveyed to
Paul H. Swarner.
