~lemoria1 Hospital. was transfcrred to ~lcssiah Village Home on December 28th,
1978, and is prescntly being maintained there.
3. ~brgaret S. De1motte is suffcring from mental disease and has been
in continuous residencc in Seid1e ~\:)moria1 Hospital and ~lcssiah Village as
a patient.
4. That she is so mentally ill that she is unable to care for her
property and might becomc victim of designing parties.
5. That she lacks sufficient capacity to make or communicate responsible
decisions concerning her person.
6. Because of her condition it would not bc in her best interest to be
present at a court hearing.
7. This affidavit is being made in accordance with Section 5518 of the
Probate, Estates and Fiduciaries Code, Act of June 30, 1972. P.L. 508. No. 164,
Section 2, as amended.

1. Your Petitioner is Dorothy n. Oyer, an adult individual residing
at One ~bunt Allen Drive, Hechanicshurg, Pennsylvania; your Petitioner is the
daughter of Margaret S. Oc1motte, the alleged incompetent.
2. ~Iargaret S. Oc1motte, the alleged incompetent, is a ninety year
old wi<IOI~ (born February 7, 1888) I~ho resided at One ~bunt Allen Drive,
Hechnnicsbllrg, Pennsy1vnnia, was admitted to SeicHe ~1cmoria1 Hospital,
~lcchanicsburg, Pennsylvania, in Fehnlary 1!l77 , and who is now a resident of
~1cssiah Village, ~1cchanicsburg, Pennsylvania.
3. TIle next of kin of the alleged incompetent consists solely of
your Petitioner, two grandchildren, heing N0l111a D. Otstot, 13 ~lount Allen
Drive, Mechanicsburg, Pennsylvania, and Alhert E. Dyer, 414 Brandy l.ane,
~lcchanicsburg, Pennsylvania, and tI~o great-grandchildren, heing Sandra Otstot,
13 ~lount Allen Drive, ~'echanicshurg, Pennsylvania, and Dm,," Marie Oyer, 414

4. The gross value of the nlleged incompetent's estate is approxi-
mately $130,000.00, and her net income from all sources, to the extent that

plus a monthly social security check in the amount of $177.20 per month.

6. The alleged incompetent, ~L1rgaret S. Dc1motte, is a person I~ho,
because of mental infimi ties of old age is unable to manage her propert)', or
is liable to dissipate it or hecome the victim of designing persons, and is a
person who lacks sufficient capacity to 11\1ke or conummicnte responsible deci-
sions concerning her person;
7. Your Petitioner, IJorothy n. J1)'er, daughter of the alleged incompe-
tent, proposes to be appointed guardian of the incompetent's estate.
8. TIle proposed guardian has no interest adverse to the alleged
incompetent ami has, in fact, heen managing the incompetent's affairs since
1970.
9. No other court has ever assumed jurisdiction in any proceeding to
detemine the competency of the alleged incompetent.
10. TIle alleged incompetent has no guardian already appointed;
11. TIlere is attached hereto, and made a part hereof, the written
consent of the proposed llUtlrdian to act as guardian, and the written consent of
all next of kin of the alleged incomnetent expressing their Ivritten desire and
consent for the appointment of the proposed guardian.
WHEREFORE, your Petitioner prays for a citation, directed to the
alleged incompetent, with notice thereof to her next of kin and to such other
persons as your Honorable Court may direct, to show cause why she should not be
adjudged an incompetent and a guardian of her estate appointed.
