ANSWER OF EXECUTOR TO PETITION FOR CITATION
TO THE 1I0NORABLE, THE JUDGES OF SAID COURT:
The averments of paragraphs 1 through 3 inclusive are
admitted.
4. Admitted as stated, and in further answer it is
averred that an Inheritance Tax Return, Form RCC-33 is being
filed herewith, and a copy attached hereto.
5. Admitted.
NEW MATTER
6. John J. Shumaker, Executor, avers that the reason for
deferring filing the Inheritance Tax Return was substantial
uncertainty as to the fair market valuation of the real property
which is the principal asset of the estate, and a desire to
value said property at its actual sale price.
7. That the Executor promptly listed said property with
a real estate broker for a period of six months, and when the
property remained unsold, listed it with another broker for a
period of six months, which listing has been renewed for an
additional six months period because of apparent prospects of
sale, which have not yet resulted in a sale.
8. Thnt the property involved is decedent's residence,
situated at 124 Big Spring Avenue, Newville, Cumberland County.
9. That the sale of said property is further complicnted
by the fact that it is not in good repair, that Newville real
estate is generally not readily sulable, which is made more
difficult by the fact that it is an older, less desirnble home
and the limited availability of mortgage money and high interest
rates.
10. That in all other respects, the Executor has
endeavored to comply faithfully and promptly with the provisions
of the law.
11. That as is obvious from the attached Inheritance
Tax Return, decedent's estate is cash poor, to the extent that
decedent's four adult children have personally borrowed funds
necessary to pay the outstanding debts of the estate.
12. That sale of said real property is necessary for
the payment of Inheritance Taxes which may be due the Common-
wealth of Pennsylvania, but the amount of said taxes cannot
presently be ascertained until the expenses of administering
~he real property, including real estate taxes, insurance and
broker's commission are finally determined.
WHEREFORE, the Executor prays your Honorable Court to
dismiss the Commonwealth's Petition for Citation.
