funeral and administrative expenses out of my estate, as soon as
practicable after my death.
3. Should my ~1ife, Laurn J. Stoner, survive me for a period
of thirty days following my death, I devise nnd bequeath the re-
mainder of my estate to Laura J. Stoner.
4. Should my ,~ife, Laura J. Stoner, predecease me or die on
or before the thirtieth day following my death, I devise and be-
queath the remainder of my estate to my issue living on the thirty-
first day folloui.ng my death, per stirpes.
5. I nominate and appoint Cumberland County National BanI. And
Trust Company, Hount Holly Springs, Pennsylvania, trustee of the
share of any beneficinry l'lho may be a minor. 'fhe income and/or
principal of said trust may be accumulated or expended for tile
maintenance, education and support of such beneficiary as my truste
in its sole diBcretion may determine; and r.\Y trustee, in the ex-
penditure of income and/or principal for such purposes, may, at its
discretion, apply the same directly I~ithout the intervention of a
guardi.an or pay the same to any person having the care or control
of said beneficiary or I"ith I~hom the beneficiary resides, l-1ithout
duty on the part of the trus tee to supervise or inquire into the

is completed, the register, in a case of intestacy,
shall grant Letters of Administration de bonis non,
and in the case of testacy, Letters de bonis non
cum testamanto annexo, to the person or persons
entitled thereto." (Emphasis added,)
Accordingly, it appears from the above-quoted provision of
the Probate, Estate and Fiduciaries Code, that it is improper
to issue Letters D.B.N.C.T.A. except where both of the named Co-
Executrices renounce or resign. However, it is my understand-
ing that all of the parties involved are anxious that Mr, Irwin
qualify in some fiduciary capacity in order that the administra-
tion can be completed without further difficulty. Therefore, it
is my recommendation to you that if all of the parties, includ-
ing the attorney for the Estate, indicate in writing that they
consent to the issuance of Letters of Administration D,B.N.C.T.A.
to Mr. Irwin, that those Letters be issued. I recognize that
there are going to be some format problems with regard to the
petition for the Letters D.B.N.C,T.A. as well as for the format
for the advertisement. However, I believe that in the interest
of expediting the administration of this Estate that the Letters
D.B.N.C.T.A. should be issued.
By copy of this letter, I am so notifying Roger M. Morgen-
thaI, Esquire, the attorney for the Estate, Edward L. Schorpp,
Esquire, the attorney for the named CO-Executrix, Carol Ann S.
Marpoe and Harold S. Irwin, Jr., the nominated substitute
fiduciary. As set forth above, I believe that Mr. Morgenthal
should write a letter to the Register of Wills requesting the
issuance of Letters D.B.N.C.T.A. to Mr. Irwin and should pro-
vide a general statement as to the reason why the Letters should
be issued. In addition, I believe Mr. Schorpp should have his
client, Carol Ann S. Marpoe, execute her consent to the issuance
of these Letters.
If you have any questions concerning the foregoing,
please do not hesitate to contact me.
