owns two properties -- the home she lives in.

A We found out that her total income through t~e'interest
and the ~ooial security came to $533,00 a month, .I think it waSt
nearest to my recollection.

A Yes, I have.
0 Can you say approximately how long Edith Lightner
has been your patient?
A Mrs. Lightner first came to our offices and we assumed
her oare in July of 1977.
o During the period from July until her recent admission
to the hospital, did you find Edith Lightner to be reasonably
oompetent and knowledgeable about her own condition and affair~?
A Until the time of her most recent admission to the Holy
Spirit Hospital, yes.
o For what reason was she admitted to the Holy Spirit Hospital?
^ Approximately twenty-four to thirtY-six h6urs before her
admission to Holy Spirit, Mrs. Lightner apparently became rather

A I aro presently eroployed by Holy' Spirit Hospital in

o In the 'course of your employment as a sooial workar
at the Holy Spirit Hospital, have YOu beoome aoquainted with
Edith Lightner?
A Yes, r have. The physicians who were attdnding her
at Holy Spirit have written an order asking the Sooial Servioe
Department to make arrangements for nurning home oare for
M'rs. Lightner on April 28th. And that's when I became involved.
o How often have you seen Edith Lightner since April 28th~
A ~~ varies, but I have seen her at least on the average of
twioe a week.
o I suggest to you that the medicare benefits were terminated
for Edith Lightner at the hospital as of June 15th/ is that oorreot,
to t.he best of your knowledge?
A I did some cheoking before I oame. We' gave the notioe
of termination of benefits I believe on the 14th, I am not Bure
when. There was a three-day grace period ~hat went along with that.
So the effective date of the stoppage of medicare ooverage \~ould
have been about the 17th of June, within a day of that anyway.
Q What are the approximate charges to Edith Lightner while
she is a patient. at the H'oly Spirit Hospital?

A The ba~io rate for just the room itself exoeeds $100.00
a day.
o In your attempt to transfer Mrs. Lightne~ to b nursing
home, did you oontaot her relatives?
A Yes, when I had the referral frbm the physioians/ ,I
oontaoted a friend, Mrs. Brubaker, who was liste<;l on tl,e ohart.
And she informed me that Mrs. Lightner did have relatives. And
I got in touoh with Mr. pred BoyanoWBki.
o In your experienoe in having people transferred from
the hospital to nurBing home facilities, is it neoessary to have
someone sign as baing the purty or perBon responsible for the
payment of the oost of the nursing home?
A Yes, it is.
Q Do you think that Mrs. Lightner is oapabl.e of B.ign:j.ng

A No ~ I don 't.
Q Do you believe that Mrs. lJightner knows today. her
ourrent financial status, who her relutives are and so forth?
A I don't think she reall.y -- I know she oannbt expresB.

9. No other oourt has ever assumed jurisdiction to
ever determine the oompetency of the said Edith Lightner.
10. Because of the inf irmi ties of old age, . peti tioner
believes that it would not be in the best interest of the
incompetent to have her. present at the hearing.
WHEREPORE, petitioner prays that the oourt set a date for
a hearing to deolare Edith Lightner as an incompetent and to
direot notioo by regular mail to those persons who are known to
petitioner, and that notice to the unknown next-of-kin of Edith
Lightner be given by publication.

A No. We are not receiving any rent. But the man who lives

MR. SLIKEI Your Honor, that is a oiroumstance that is also
in sort of a state of limbo beoause of the lbng relationBhip between
Mrs. Lightner and the ocoupant of the house. We thought reluotant
at lea13h at this early stage to sell that hOUBe or to order him to
