estate of the minor is necossary to assure proper invontrnent of the estate of

WHEREAS, Husband and Wife were lawfully married in Hagerstown,
~laryland, on January 3, 1967, and
WIH~R1~I\S, one (1) child was born of said marriage, namely,
Marty Ann, age 7, and
WHEREAS, differences have urisen between the Husband and Wife

apart from eaoh other, and
WHElWAS, Husband and Wife desi;re to settle and determine,
finally and for all time., their mutual rights and the support
and maintenanoe of the ch:l.ldl and

various property rights they have between them,
NOW THEREFORE, the parties hereto, intending to be legally
bound hel'eby, do oovenant and agree as follows I
1. It shall be lawful for Husband and Wife at all times
hereafter to live separate and apart from each othor and to reside
from time to time at suoh plaCle or places that they shall
respectively dsem fit, free from any control, restraint or
interference, direct or indireot, by each other. Neither party
shall molest the other or conpel or endeavor to compel the other
to oohabit or dwell with him or her by any legal or other pro-
oeedings, and each party will follow any occupation that he or
she desires without interference by the other party. Suoh em-
ployment by either party ahall in no way increase or deorease the
support terms as contained herein. The foregoing provisions shall
not be taken to be admission on the part of either Husband or Wife

2. At such time either Husband or Wife obtains divorce from

payments shall continue until said child reaches the age of eight,e n
(lB), marries, becomes self-supporting, or dies, whiohsver occurs
first.
4. Wife shall have complete and permanent custody of the
aforementioned chIld s'ubject to reasonablo visitati.on rights with

right, title and interest in and to the plainfield property.

may be necessary or desirable to oonvey to wife and daughter, Mart
Ann, joint tenants with the right of survivorship, all of husband'
right, title and interest in and to the Holly pike property, Upon
any futuro sale of said property, wife oovenants to place 1/2 of e
net proceeds in a trust aooount for the benefit of Marty Ann.
Any costs, expen.e. or real estate transfer taxes in conneot on
with the above premise. IIhall be borne by the Grantee of .aid
property. AnY mortgage or other obligation secured by either
property shall. be the 801e responsibility of the party securing
said property and said Grantee ahall indemnify and save harmless e
other party from any claim ari.ing from the mortgage or other
seoured obligation,

I 7. The parties agree to a division of their joint furniture,
belongings and other personal items by mutual agreement to be
effected hereinafter.

8. All notes presently in individual names shall remain the
individual obligation of the note debtor.
9. Charge accounts with outatanding balances as of this
date shall be paid as follows I
a. Sears - t~ be paid by Wife
b. J.e. Penney - to be paid by Husband
c. Montgomery Ward - to be paid by Wife. Husband agrees
to reimburse Wife for one-half of all payments made to
Montgomery Ward upon uresentation of evidence of such payment
until the present obligation is paid in full.
d. CCNB Ready Credit Aocount - to be paid by Wife.
No additional charges will be made by either party to any of
the aforementioned acoounts after, t~8 date hereof.
10. Wife shall have .theright to claim the aforementioned
ohild as a dependant for inaome tax purposes hereinafter.
11. Husband agrees to pay to the Wife by way of property
settlement the Bum of $225.00 upon the signing of this agreement.
12. Wife shall not hereafter oontract or incur any debt or
liability for which Husband or his property or estate might be
responsible and shall indemnify And save harmless Husband from any
and all olaims or demands made against him by reason of debts or
Obligations inourred by her exoept upon consent of Husband.

time against Husband, or in and to or against his estate, or

any time against Wife, on in tlnd to or against her elltate, or
any ptlrt thereof, whether arising out of any former oontracts,
engagements, or liabilities of Wife, or by way of ourtesy
or claim in the nature of curtesy, widower's rights or
unc"\el' the intestate laws, or the right to take against Wife's
will, or in any other manner whatsoever, except only pursuant
to this Agreement.
13. This Agreoment ShAll not be construed to affect or bar
he right of either Husband or Wife to an absolute divoroe on

arise, and in any such suit instituted by either, Husband or
ife shall not olaim or demand any support, alimony pendente lite,

14. This Agreement shall be oonstrued under the laws of the
onunonwealth of Pennsylvania.
15. This Agreement oonstitutes the entire understanding

16. This Agreement shall bind the parties hereto and their
respective heirs, exeoutora, administrators and assi~\s.

Q What is the reason f,or selling the property there now?
^ Well, there were several reasons. .One I was goin~ to
be working in the Camp Ilill area. I am going to sell real estate.
And I wanted to work in the Camp Hill area. My daughter is in.
parochial sQhool and wants to gq to Trinity Iligh School. ~nd,the
Mechaniosburg-Camp Ilil1 area would also be better in that effect.
Q You are employed by whom now?
A Well I I am not going back to work right away. I was
employed by the company that sold the hou~e, by Detweiler Real
Estate. I ha~enot been working in the last few weeks on a
full-time job.
I have been working for my brother part-time. When she
goes baok to school, I had been offered a job with Revere Real
Estate. But I really plan to take a job with another agency, which
I won't mention because I have not gone for my int.rview there yet.
But .1 t. is a West Shore agency. ., "
Because we would like to live in the Camp Ili1l-M~ch~ni6sburg
area. That's the other reason that I plan to wait a year until I
am more established on a new job to buy another home.
