LAST WILL AND TESTAlIENT
I, LEDA E. CUSHING, of the Borough of Carlisle, County
of Cumber~and, Conunonwealth of Pennsylvania" being of sound
and disposing mind and memory, do hereby make, publish and
declare this to be my Last Will and Testament, hereby revoking
any and all former Wills or Codicils by me made.
FIRST: I give, devise and bequeath all my property, both
real and personal, and mixed, to my husband, JOHN L. CUSHING,
if he survives my death for thirty (30) days.
SECOND: In the event that I am not so survived by my
husband, JOHN L. CUSHING, then I give all my aforesaid property
in equal shares to my son,RALPH W. CUSHIHG of Hershey,
Pennsylvani_a, and my daughter, BARBARA L. KILLINGER, of R. D. I,
Myerstown, Pennsylvania. I direct that my aforesaid son and
daughter may by agreement distribute my aforesaid property as
they so desire, however, if they are unable to so agree, I
direct that my aforesaid property shall be distributed in equal
shares by my Executrix.
THIRD: I hereby nominate, constitute and appoint my
husband, JOHN L. CUSHING, as Executor of my estate. If my
husband does not survive me, then I appoint BARBARA L. KILLINGER
to serve in that capacity.
FOURTH: I direct that neither my Executor nor my Executrix
shall be required to file a bond to secure the faithful
performance of their duties.
FIFTH: I authorize my Executor or Executrix, in their sole
and absolute discretion, to purchase or otherwise acquire and
retain any investments of which I die seized or any real or
personal property of any naturej to sell, lease, pledge, mortgage
