LAST WILL AND TESTAMENT
OF
HELEN MONGEAU
KNOW ALL MEN BY THESE PRESENTS, that I, HELEN MONGEAU, of
the City of Chicago, Cook County and State of Illinois, being of
sound and disposing mind and memory, do hereby revoke all former
wills and codicils by me at any time heretofore made, and do now
make, publish, acknowledge and declare my Last Wi 11 and Testament
as follows, that is to say:
FIRST: I direct that all just debts owing by me, including
last illness and funeral expenses, shall be paid as soon as practic-
able. I alos direct my executor, hereinafter named, to pay all in-
heritance and estate taxes and other governmental charges, taxes or
liens imposed upon the transfer hereunder of my estate or any portion
thereof passing under the terms of this, my Last Will and Testament,
or upon the transfer hereunder of the interests of any of the interests
of the legatees, devisees or beneficiaries, by any present or future
law of the United States or of any State, and that all such charges,
taxes and liens be considered and treated as expenses and costs of
adminstering of my estate and be paid out of the same before dis-
tribution thereof if possibleo
SECOND: I give and bequeath to Domiinican Fathers, Province
of Sto Albert, The Great, of United States of North America, an
Illinois Corporation, the sum of Five Hundred Dollars ($500.00), for
Masses to be offered in behalf of myself and my deceased husband,
Martin Mongeau 0
THIRD: I give, devise and bequeath to my step-daughters,
Margaret MacLean and Arthemise Schuetz, share and share alike, all

my remaining property, real, personal and mixed, of every name,
nature and kind whatsoever; and, in the event of the death of one
or both of my said step-daughters prior to my death, leaving lawful
issue surviving, I give, devise and bequeath to the lawful issue of
the one so dying, per stirpes, the share of my estate that the one
so dying would have taken if living; and, in the event of the death
of one of my said step-daughters prior to my death, leaving no lawful
issue surviving, I give, devise and bequeath the share of the one so
dying to the surviving step-daughter.
FOURTH: I make, nominate and appoint my step-daughter,
Arthemise Schuetz , the executor of this, my Last Will and Testament,
and I request and direct that she shall not be required to give any
bond or security as such executor. I give and grant unto my said exe-
cutor full power and authority, at her discretion, to sell and dis-
pose of all or any portion of my estate at such time or times, at
such price or prices and on such terms of payment as she may deem for
the best interests of my estate, and to execute, acknowledge and del-
iver all such deeds, conveyances and documents as may be necessary
and proper to consummate such sale or sales and to do any other act
or thing concerning my estate that I myself could have done if livingj
in the case of the death, resignation, refusal or incapacity to act
as such executor of my step-daughter, Arthemise Schuetz, I hereby
make, nominate and appoint my step-daughter, Margaret MacLean, to be
executor to fill such vacancy, hereby giving and granting unto her
as such successor executor, the same powers and authority as are here-
in given to my step-daughter, Arthemise Schuetz, as executor, and I
request and direct that she shall not be required to give any bond
or security as such succesor executoro

Gentlemen:
Pursuant to Section 1001(1) of the Inheritance and
Estate Tax Act of 1961 (72P. S. ~ 2485-1001) a PROTEST is
filed on behalf of the Commonwealth of Pennsylvania against
the action of our local representative in determining the
inheritance tax due and payable in the estate of the above
named decedent.
The assessment prepared by the Cumberland County
Inheritance Tax Office shows a tax liability of $235.04. This
determination was based on the conclusion that the entire estate
was taxable at the Class "A" on six percent rate. However,
exemination of the inheritance tax return and in particular
Schedule "E", Jointly Owned Property, discloses that checking
account #252-109470-2 in Commonwealth National Bamc of Harrisburg,
Pa. was a joint account held by decedent and her cousin, This
account was appraised at its full date of death value or $629.34.
Reference to Section 403 of the 1961 Act reveals that a
cousin cannot be formed within the class of beneficiaries taxable
at the lower rate. Inheritance tax on the jointly owned property
passing to Louise Colarusso would be at the rate of fifteen,
percent pursuant to Section 404 of the 1961 Act.
Accordingly, Petitioner contends the tax on the jointly
o.med property should be charged at the rate of fifteen percent.
