PLACE FOR FILING _ The return is to be filed in duplicate with the Register of Wills of the county wherein the decedent resided.
TIME FOR FILING _ The return is due nine months after the decedent's death. unless an extension for filing has been applied for and granted by the Secretary
of Revenue within the nine-month period.
FAILURE TO FILE RETURN _ Section 791 of the 1961 Statute provides that ". . . any person who willfully fails to file a return or other report required of him
... shall be personallv liable... to a penalty of 25% of the tax ultimatelv found to be due or $1.000 whichever is the lesser to be recovered by the
Department of Revenue as debts of like amount are recoverable by law."
DEDUCTIONS _ Unsatisfied liabilities incurred by the decedent prior to his/her death are deductible against his/her taxable eslate.ln addition to debts incurred
by the decedent or eslate. other items are claimable including the cost of administration. attorney fees. fiduciary fees. funeral and burial expenses
including the cost of a burial 101. tombstone or grave marker. and other related burial expenses.
FAM1L V EXEMPTION _ A lamily exemption may be claimed by a spouse of a decedent who died domiciled in Pennsylvania. If there is no spouse. or if the
spouse has forfeited his/her rights. then any child of the decedent who is a member of the same household can claim the exemption. In the event there is
not such spouse or child. the exemption can be claimed by a parent or parents who are members of the same household as the decedent. The familv
exemption is allowable only against assets which pass by a will or by the Pennsylvania Intestate Laws.
FIDUCIARV COMMISSION _ Compensation paid to an estate representative; namely. an executor or administrator, for services performed in administering an
estate is reportable for Pennsylvania Income Tax purposes. This taxable income item should be reported on Form PA.40, Individual Income Tax Return,

PETITION FIXING SECURITY
TD THE HONORABLE, THE JUDGES OF SAID COURT:
AND Nml COMES, EDITH J. MYERS, Administratrix of the
Estate of SARAH CORNMAN, Deceased, and files this Petition to Fix
Security, of which the following is a statement:
1. That Sarah Cornman, residing at 221 Longs Gap Road,
Carlisle, Cumberland County, Pennsyl,ania, died intestate on
January 1, 1980.
2. That Letters of Administration were granted to your
Petitioner on February 20, 1980, by the Register of Wills of Cumb-
erland County, Pennsylvania.
3. That no security was entered by your Petitioner with
the Register of Wills because the value of the decedent's estate
was estimated at less than $5,000.00 and security was not required
by the Pennsylvania Probate, Estates and Fiduciaries Code, 20 P. S.
Sec. 3174(d).
4. That there is no known personal property of value in
the Estate, and no real estate has been sold previously,
5. That the decedent died seized of a parcel of real
estate located at 221 Longs Gap Road, Carlisle, Cumberland County,
Pennsylvania, consisting of an irregularly shaped lot with frontage

of 97 feet on Longs Gap Road and being improved with a dwelling
house; See Deed Book "W', Volume 23, Page 3~l.
6. That your Petitioner has entered into a contract to
sell the aforesaid parcel of real estate to Barry L. Miller and
Holly A. Miller, his wife, of North Middleton Township, Cumberland
County, Pennsylvania, for the sum of Five Thousand Five Hundred
($5,500.00) Dollars.
WHEREFORE, your Petitioner prays your Honorable Court to
enter a decree requiring the entry of security in such an amount
as the Court may determine, upon the entry of which your Petitioner
to have authority to receive the proceeds of the sale of the afore-
said premises.

PETITION FOR DISCHARGE OF ADMINISTRATRIX
TO THE HONORABLE THE JUDGES OF SAID COURT:
The Petition of Edith J. Myers, respectfully represents:
1. That your Petitioner is Edith J. Myers, of Carlisle,
Cumberland County, Pennsylvania,
2. That Sarah Cornman died intestate on January 1, 1980,
a resident of North Midcleton Township, Cumberland County,
Pennsylvania,
3. That the decedent was not survived by a spouse.
4. That the Pennsylvania Inheritance Tax Return was filed
on September 15, 1981, in the Office of the Register of Wills of
Cumberland County, Pennsylvania,
5. That a statement of Debts and Deductions was filed on
September 15, 1981, in the aforesaid Register's Office.
6. That the inheritance tax for the decedent's estate
has been paid in full,
7. That the decedent was survived by one brother, Mervin
L. Cornman, and a niece, Edith J. Myers, her sole heirs-at-law under
the Intestate Laws of the Commonwealth of Pennsylvania,

8. That your Petitioner posted a bond with the Insurance
Company of North America as Surety in the amount of $10,000.00.
9. That your Petitioner filed her First and Final Account
and Schedule of Distribution on November 5, 1981, and said Account
and Schedule of Distribution were confirmed on January 12, 1982,
by your Honorable Court,
10, That the entire estate has been paid and transferred
to the parties entitled thereto in accordance with the aforesaid
Account and Schedule of Distribution, and no other money or property
belonging to the estate has been received by the Petitioner since
the confirmation of said account,
11. That all parties in interest as distributees have
signed Releases, except Mervin L. Cornman who is confined to the
Cumberland County Nursing Home and for whom the funds received under
the estate, to wit: $1,246.41, were placed in a savings account to
be used for his burial or as needed.
12. That the Insurance Company of North America, Surety,
has consented to the discharge of your Petitioner as Administratrix
as evidenced by the Consent attached hereto and makred Exhibit itA".
WHEREFORE, Petitioner prays your Honorable Court to dis-
charge her from the duties of her appointment and to release her
and her Surety from future liability on the bond given by them on
her appointment.
