STATE OF PENNSYLVANIA
COUNTY OF CUMBERLAND
Linda J. Smith, being duly sworn according to law,
deposes and states as follows:
1. That she is the daughter of James W. Smith, late
of the Borough of Carlisle, Cumberland County, Pennsylvania,
and is the Executrix of his estate pursuant to his Last Will
and Testament.
2. That prior to the last illness and death of James
W. Smith, while she was in the process of a divorce, at the
request of her father, James W. Smith, she delivered to him
certain items of property which were her sole and individual
property, in order that he might safeguard them for her while
she was in the process of separation, divorce and relocation
of her residence:
a. Place setting, containing 12 each of the following,
ice teaspoons, soup spoons, knives, coctail forks, butter knives,
salad forks, dinner forks, 24 teaspoons, 4 serving ppoons, and
19 serving pieces, which items were kept for safekeeping in the
safe deposit box of James W. Smith at Cumberland County National
Bank, MJ Mall, Carlisle, Pennsylvania. The said items were
specifically bequeathed to the said Linda J. Smith, by her
maternal grandmother, Sarah F. Matlack, under item 4 of her
last will and testament, a copy of which is attached hereto.

b. One (1) Waltham pocketwatch, gold color, case
number 23073, located in the safe deposit box of James W.
Smith at Commonwealth National Bank, North Hanover Street,
Carlisle, Pennsylvania. The said pocketwatch was originally
the property of her maternal greatgrandmother and was given to
her by her grandmother, Sarah F. Matlack, during the lifetime
of Sarah F. Matlack.
c. Five (5) shares, Ford Motor Company, common
stock, certificate no. SD0287769, which were the individual
property of Linda J. Smith, having been acquired by her, but
stored for safekeeping in the CCNB,NA safe deposit box of
James \'1. Smith.
d. Twenty (20) shares, Ford Motor Company,
common stock, certificate no. FCOl~6581 and certificate no.
TC025275, which were the individual property of Linda J. Smith,
having been acquired by her, but stored for safekeeping in the
CCNB, NA safe deposit box of James \'1. Smith
e. Three (3) $25.00 Series E U.S. Savings Bonds,
dated 7/53, 6/5~, and 6/57, issued in the names of Linda Jean
Smith or James \'1. Smith, all of which '~ere acquired by James
W. Smith and delivered to Linda J. Smith more than three years
prior to the date of death of James W. Smith, being stored in
his safe deposit box at Commonwealth National Bank, for safekeeping.
To avoid dispute, however, the full date of death value of principal

appropriate schedules as fully taxable.
f. That the U.S. Savings Bonds issued in the
names of Edith M. Smith and Linda Jean Smith, as follows:

28, $25.00 bonds (6/56), (4/55), (5/58), (5/62), (7/65), (12/64),
(6/65), (12/63), (6/64), (12/70), (7/71), (6/71), (12/65), (6/69),
(12/67), (4/68), (12/66), (6/67), (6/66), (5/67), (6/66), (6/60),
(6/61), (12/71), (6/70), (10/68), (12/69), (6/64), were property
acquired by Edith M. Smith and delivered to Linda J. Smith several
years prior to the date of death of James W. Smith, and that the
said U.S. savings bonds were placed in the Commonwealth National
Bank safe deposit box of James W. Smith for safekeeping.
3. That the said Linda J. Smith, through her attorney,
Dale F. Shughart, Jr., Esquire, inquired into the present st~tus
of the John Hancock Life Insurance Policy, No. NJ22 93100 located
in the safe deposit box of James W. Smith at CCNB,NA. The result
of the'inquiry was a determination that the said policy was a group
life insurance policy covering the life of James W. Smith while he
worked for United Telephone Company in New Jersey. Upon his

transfer to United Telephone Company in Pennsylvania, the said
policy was voided, the group life insurance of United Telephone
Company of Pennsylvania providing its group life insurance through
the Equitable Life Assurance Society. No insurance proceeds were
