I, JONAS W, BRINDLE, widower, of the Township of Monroe, Cwnberland
COlmty, Pennsylvania, make, publish al1d declare this as and for my Last
Will and Testament, hereby revoking all other Wills <Uld Codicils heretofore
made by me.
FIRST: I direct the payment. of all my just debts and the expenses
of my last illness and funeral from my estate, as soon after my death as
conveniently may be done.
SECOND: I give, devise and bequeath any Commonwealth National Bank
stock that I may be possessed of at the date of my death to the ALLEN LU1HERN
CHURCH, at Churchtown, Cwnberland County, Pennsylvania, for general church
purposes,
THIRD: I give, devise and bequeath my real estate and dwelling house
situate in Monroe TOlVl1ship, Cwnberland County, Pennsylvania, and all household
and personal effects <Uld other tangible personalty of like nature (not including
cash or securities), together with any exis ting insurance thereon, to RUSSELL
DITMER, provided that all iruleritance, estate, transfer, succession and
death taxes of any kind whatsoever which may be payable thereon by reason
of my deat.h shall be paid by Russell Ditmer.
FOURTH: I direct that all the rest, residue and remainder of my estate
of whatever nature and wherever situate be converted into cash as soon as possible
by my hereinafter named Co-Executors, and distribution of same be made by them
as follows:
(A) Three Hundred Fifty ($350.00) Dollars t.o my niece, SHIRLEY PEFFER.
(B) Three Hundred Fifty ($350.00) Dollars t.o my nephew, JAY FOUGHT.
(C) 1'1"0 Hundred Fifty ($250.00) Dollars to my sister, /.ms. RUTH FOUGm'.
(D) 1'1"0 Thousand ($2,000.00) Dollars to the ALLEN LU1llERAN CHURCH at
Churchtown, Cwnberland County, PelIDsylvania, for general church purposes.
(E) Two Hundred ($200.00) Dollars to my deceased wife's niece, MRS..
FLORENCE CLAIR, who presently resides at Churchtown, Cwnberland County, Pennsy-
vania.
(F) I give and bequeath all the rest, residue and remainder of my
estate to my deceased wife's niece and nephews, MRS. PHYLLIS VOGLER, CULVER
W. DUNKLEBERGER and BERNARD DUNKLEBERGER, or to the survivors, share and
share alike.
FIFTH: My Co_Executors and personal representatives shall have the
follOlving powers in addition to those vested in them by law and by other
provisions of my Will, applicable to all property, exercisable \vithout court
approval IDld effective until actual distribution of all property.
(A) To sell at public or private sale, or to lease, for IDlY period of time,
any real or personal property and to give options for sales, exchanges or
leases, for such prices and upon such terms or conditions as are deemed proper.
(B) To compromise any claim or controversy.
(C) To invest in all fonns of property, including stocks, common
trust funds and mortgage investment funds, without restriction to investments
authorized for Pennsylvania fiduciaries, as they deem proper, without regard
to any principle of diversification, risk or productivity.
(D) To exercise any option, right or privilege granted in insurIDlce pol-
icies or in other investments.
SIXTH: Should any of the legatees named in Paragraph THIRD or Paragraph
FOORTH, "A", "B", "C", and "E" predecease me, then I direct that his or her
share shall become part of my residuary estate.
SEVENTH: In the event the assets of my estate shall be insufficient
to pay in full the above mentioned bequests, I direct that they shall abate
in the order set forth therein.
EIGI-ill1: I direct that IDlY and all inheritance, estate and transfer taxes
imposed upon my Estate, passing under my Will or otherwise shall be paid out
of the principal of my residuary estate, with the exception of any provisions
made for assets passing to RUSSELL DITMER, as mentioned hereinabove.
NIN111: I nominate and appoint ~ms. IUJTH FOUGHT and CULVER W. DUNKELBERGER,
or the survivor thereof, as Co-Executors of this, my Last Will and Testament.
I hereby relieve my Executor from the necessity of posting security in cOlmection
with his duties as such in any jurisdiction in which he may be called upon to act
insofar as I am able by law to do so.

GENERAL INHERITANCE TAX INFORMATION
Unsatisfied liabilities incurred by the decedent prior to his/her death are deductible against his/her taxabie estate.
In addition to debts incurred by the decedent or estate, other items are claimable including the cost of administration,
attorney fees, fiduciary fees, funeral and burial expenses including the cost of a burial lot, tombstone or grave marker.
All debts being claimed against an estate are subject to the approval of the Register of Wills with whom the
Inheritance Tax Return is filed. Evidence to support the decedent's or the estate's liability for the debts being claimed
should be attached to this schedule.
A family exemption of $2,000 may be claimed by a spouse 01 a decedent who died domiciled in Pennsylvania.
If there is no spouse, or if the spouse has forfeited his/her rights, then any child of the decedent who is a member of
the same household can claim the exemption. In the event there is no such spouse or child, the exemption can be
claimed by a parent or parents who are members of the same household as the decedent. The family exemption is
allowable only against assets which pass by a will or by the Pennsylvania Intestate Laws,

(1) acre. The conveyance into decedent took place by deed
dated April 18, 1969 and recorded in the Cumberland County
Recorder of Deeds Office in Deed Book "E", Voll.llre 23, Page
279, whereupon said property was conveyed by Vance C. Enck
to decedent, Jonas W. Brindle and Mildred M. Brindle, his
wife, as Tenants by the Entireties. The said Mildred M.
Brindle died April 25, 1974 whereupon sole and complete title
became vested in decedent, Jonas W. Brindle. Pursuant
to the Iilst Will and Testament of decedent, real esta'te
is specifically bequeathed to Russell Dibner.

real estate hereinafter described be and the same is hereby awarded to Russell
E. Ditmer, single person, his heirs and assigns.
ALL that certain tract of land situate in Monroe TOWnship, C\lI11berland county,
pennsylvania, rrore particularly \:Qunded and described' in accordance with
a survey thereof made by Thal'aS A. Neff, Registered surveyor, dated March
12, 1969, as follows:
BE!3INNING at a point =ked by a spike in the center line of TOWnship ROad
#553, a comer of the land herein conveyed and land of Phillip J. Bellanca
and ,Gloria Bellanca, his wife; thence by said Bellanca land, North 32 degrees
37 minutes East 200 feet to a point marked by a stake; thence by the line of
other land of the Grantor, SOUth 57 degrees 23 minutes East 284.90 feet
to a point =ked by a stake; thence continuing by the line of other land of the
Grantor, SOuth 66 degrees 37 minutes West 241.25 feet to a point in the center
line of the first rrentioned public road, which point is =ked by a spike;
thence by the center line of said public road, North 57 degrees 23 minutes
West 150 feet to the Place of BEGINNING. The center line as referred to
herein is the center line of the established road, and not the center line
of the right-of-way of the highway as the same presently exists.
HAVING ERECTED TJ;lEREOO, a dwelling house being known and numbered as Box 518,
R.D. #6, carlisle, pennsylvania.
BEING the same premises which vance C. Enck, by his deed dated April 18, 1969
and recorded in the Cumberland county ReCOrder of Deeds office in Deed BOOk
"E", Volune 23, Page 279, granted and conveyed unto Jonas W. Brindle and
Mildred M. Brindle, his wife. The said Mildred M. Brindle died April 25, 1974,
whereupon Jonas W. Brindle beCame the sole owner. The said Jonas W. Brindle

prol:ated and recorded in the Cumberland County Register of wills Office in
Will Book 21, Page 167, provided as follows:
"THIRD: I give, devise and bequeath my real estate and dwelling house
situate in M:mroe Township, Cumberland County, Pennsylvania, and
all lPusehold and personal effects and other tangible personalty
of like nature (not including cash or securities), together with
any existing insurance thereon, to RUSSELL DHMER, provided
that all inheritance, estate, transfer, succession and death
taxes of any kW whatsoever which rray be payable thereon by
reason of my death shall be paid by Russell Ditmer."
UNDER AND SUBJECl', NEVERl'HELESS, to the following building and use restrictions
and conditions which shall be binding on the within described tract of land
only and shall not be deemed binding on other land of the Grantor, with
which building and use conditions and restrictions the within Grantees, their
heirs and assigns, by the acceptance of this Deed, agree to carply:
1. Said land shall be used for residential purposes only.
2. No trailer, rrobile mme or similar structure rray be located up::m said
tract of land temp::>rarilyor permanently, for any use whatsoever.
3. Nothing shall be done on said land which may be or become an annoyance or
nuisance to the neigh!xJrhood, including but not limited to the keeping and
maintaining of wrecked autorrobiles, junk, or debris of any other nature.
4. My single family dwelling house erecte:l on said land shall have a value
of at least $12,000,00, excluding land value, based upon 1968 values
and costs of construction.
5. No building or any part or portion thereof shall be erected or rraintained
within 30 feet of the eastern right-'of-way line of Township FDad No. 553,
The ,"said Russell Ditmer is also known as Russell E. Ditmer.
AND the Recorder of Deeds in and for Cumberland COunty is directed to
reoord a certified copy of this Decree and index the Decree as a conveyance
fran the Estate of Jonas W. Brindle.
