the residue of my estate, up to Fifty ($50.00) Dollars a month to
defray the cost of maintenance for my sister. This expenditure
shall terminate at the expiration of one year from the date of my
death. When my sister has vacated my home, my Executor shall
proceed to convert all the rest, residue and remainder of my estate,
whether real or personal, into cash. This conversion shall be at
either public or private sale or sales, and such sale or sales
shall be in accordance with the terms and conditions which my
Executor deems best. Then, when such conversion has been completed,
I direct my Executor to dispose of my property in accordance with
the following items of my will.
ITEM IV. I give and bequeath the sum of One Thousand
($1,000.00) Dollars to my sister, RUTH BOMGARDNER TOME. If RUTH
BOMBARDNER TOME fails to survive me, this bequest shall go to my
nephew, GERALD R. TOME. If GERALD R. TOME fails to survive me,
his bequest shall go to his children, two-thirds to the oldest
child and one-third to the youngest child. This distribution
to his children, two-thirds to the oldest child and one-third to
the youngest child, shall prevail throughout this will, for any
distribution to the children of GERALD R. TOME, should he fail to
survive me.
ITEM V. I give and bequeath the sum of One Thousand ($1,000
Dollars to my nephew, GERALD R. TOME, or his issue surviving.
ITEM VI. I give, devise and bequeath the sum of Two
Hundred ($200.00) Dollars to the HUMMELSTOWN TRINITY UNITED
METHODIST CHURCH.
ITEM VII. I give and bequeath the sum of Two Hundred
($200.00) Dollars to my nephew, CHARLES RICHARD SEIDEL.
ITEM VIII. I give and bequeath the sum of One Hundred ($100 00)

Dollars to my niece, JEANETTE BOMGARDNER.
ITEM IX. I give and bequeath the sum of One Hundred ($100.00)
Dollars to my niece, LINDA BOMGARDNER.
ITEM X. I give and bequeath one-half of the residue of my
estate, left after the bequeaths above listed have been made, to
my nephew, GERALD R. TOME. The remaining half of the residue of
my estate, I give in two (2) equal parts. One part I give and
bequeath to my brother, L. IRVIN BOMGARDNER and to his wife, MARY,
or the survivor among them. The other part I give and bequeath to
CHARLES RICHARD SEIDEL.
ITEM XI. I appoint CUMBERLAND COUNTY NATIONAL BANK AND TRUST
COMPANY as Guardian of the estate of any minor who becomes a
beneficiary under this Will and with powers to:
(a) Receive and hold for such minor or minors all
property payable by law to a guardian appointed by my
Will:
(b)
without
and
Invest such property and all accumulated income
restriction to investments authorized for fiduciaries:
(c) Use income and principal for the minor's mainten-
ance and education, either directly or by payment to any
person having custody of the minor and which person is
undertaking the minor's education and maintenance. Pay-
ment to such a person and receipt thereof shall be a
complete acquittance of the guardian. All unexpended
principal and income shall be paid to the minor at his
majority.
Said guardian may, in discharge of all duty hereunder,' pay
any minor's share deemed impractical of administration to the
person standing in place of the minor's parent or deposit it in an
interest bearing savings account in the name of the minor.
ITEM XII. I appoint GERALD R. TOME as the Executor of my
Will. If GERALD R. TOME fails to survive me or is unable or
unwilling to serve in this capacity, then I appoint CUMBE~LAND
COUNTY NATIONAL BANK AND TRUST COMPANY as my Executor.

ITEM XIII. In addition to powers given them by law, my
Executor and any guardian acting hereunder shall have the fullest
power and authority in all matters and questions and to do all acts
which I might or could do if living, including, without limitation,
complete power and authority to invest (without restriction to
investments permitted by law), sell (at public or private sale, for
cash or credit, with or without security), mortgage, lease and
dispose of and distribute in kind, all property, real and personal,
at such times and upon such terms and conditions as they deem
advisable.
ITEM XIV. No fiduciary acting hereunder as Executor or as a
guardian, shall be required to post bond or enter security in this
or any other jurisdiction.
ITEM XV. All estate, inheritance, transfer, legacy, successio
and other death taxes of any nature, payable by reason of my death,
which may be assessed or imposed upon or with respect to property
passing under this Will or property not passing under this Will,
shall be paid out of my estate as an expense of administration, and
no part of said taxes shall be apportioned or prorated to any
legatee or devisee under this will or any person owning or receivin
any property not passing under this will.
