I, FOSTER P. MINNICH, of the Borough of Mechanicsburg, County of
Cumberland and COl1Ullonwealth of Pennsylvania, being of sound mind and memory,
do hereby l1k"lke, publish and declare this to be ll\V Last Will and Testament, in
manner and fom following, hereby revoking any Will or Wills heretofore made
by me.
FIRST: I direct that allrrry just debts and funeral expenses be

fully paid and satisfied as soon as conveniently may be after rrry decease.
SECOND: I give, devise and bequeath, absolutely, all of rrry esti.te,
real, personal and miXed, of whatsoever kind and nature, and wheresoever situ-
ate, unto rrry wife, ROSELLA S. HDlNICH. HO\fever, in the event my wife be not
living at the time of my decease, or if she and I shall die simultaneously
or as the result of a COl1Ullon accident or catastrophe, or under such circum-
stances as to render it difficult or impossible to detennine with certainty
whether she survived me, or if she fails to survive me by more than three (3)
months, then, and in an,y of said events, I give, devise and bequeath, abso-
lutely, all of ll\V estate, real, personal and miXed, of whatsoever kind and
nature, and wheresoever situate, unto ll\V surviving children in equal shares,
except that the share of any child who is a minor at the time he or she would
be entitled to take hereunder shall be held in trust as provided under the
provisions of paragraph THIRD of this Will.
THIRD: I hereby designate and appoin~ my son, GERALD P. HDlNICH,

who has attained his majority, as Trustee of rrry estate for the benefit of rrry
minor children.
The aforesaid Trustee shall have full power to deal with whatever
estate, real, personal, or miXed, that I may die possessed of in such manner
as if it were his own personal estate, a.'1d that said Trustee, in making in-
vestments shall not be limited to such investments as are or may be authorized

by law for the investment of estate or trust funds. The Trustee shall applJ'
the income from my estate toward the maintenance, including health, education
and welfare of my aforesaid minor children, and such part of the principal
as he shall from time to time deem fit. As each child reaches the age of
twenty-one (21) years, the Trustee shall pay over to him or her one-hall'
(1/2) of the then residue of his or her share of the principal of said trust
estate as he or she would have received if I had died intestate at that time.
Upon each child attaining thB age of twenty-rive (25) years, respectivelJ',
the Trustee shall pay over to such child all the rest, residue and remainder
of his or her share of said trust estate.
FOURTH: I direct that my Executrix, hereinafter named, shall have
full power in her discretion to do aIT3" and all things necessary for the com-
plete administration or my estate, including the pemer to sell at public or
private sale, and without aIT3" Order of Court, aIT3" real or personal property
belonging to my estate, and to compound, compromise, or otherwise to settle
or adjust aIT3" and all claims, debts, charges and demands upon or in favor or
my estate, as fully as I could do if liVing.
I rurther direct that rrrJ' Executrix, hereinafter named, shall have
full power in her discretion to retain aIT3" investments made or possessed by
me, and to sell, to vary and to change the investments of my estate, and to
make investments and re-investments wi.thout being limited to such investments
as are or may be authorized by law for the investment 'Jf estate or trust funds.
FmH: I hereby nominate, constitute and appoint as Executrix of

This assessment is made in accordance with Section 708 of the Inheritance and Estate Tax Act of

Inheritance Tax, other than tax on a future interest. is due at the date of the decedent's death and becomes

PETITION FOR AWARD OF REAL ESTATE
The Petition of Rosella S. Minnich, Executrix of the
estate of Foster P. Minnich, late of the Borough of Mechanics-
burg, County of Cumberland, State of Pennsylvania, deceased,
respectfully represents:
1. Petitioner is the surviving wife, Executrix, and
sole beneficiary of the Decedent, Foster P. Minnich.
2. The Decedent, Foster P. Minnich, held a one-half
(1/2) interest in the real estate and dwelling numbered as
300 North Market Street and 1 East Factory Street, Mechanicsburg,
Cumberland County, Pennsylvania, under the deed of the Pennsyl-
vania Rail Road Company to John P. Minnich and Foster P. Minnich,
dated December II, 1962, and recorded in the Office of the
Recorder of Deeds for Cumberland County, Pennsylvania, at Deed
Book S, Volume 20, Page 1139, a copy of which is attached hereto
as Exhibit "A", and is included herein by reference.
3. The previously described real estate is encumbered
by the mortgage of John P. Minnich and Foster P. Minnich to the
First Bank and Trust Company of Mechanicsburg, Pennsylvania,

described real estate (also described in paragraph 2 herein) was
taken in kind by Rosella S. Minnich, as indicated in the Schedule
of Proposed Distribution:
