LAST WILL AND TESTAHENT
of
RUTH HARRIS
I, Ruth Harris, of the City of Butler, formerly of the
City of Harrisburg, Pennsylvania, being of sound mind, memory
and understanding do make, publish and declare this and the
following to be my last will and testament, hereby revoking any
and all wills and codicils by me at any time heretofore made:
1. I direct that all expenses of my last illness and
funeral expenses, including my grave marker, shall be paid from
my residuary estate as soon as practical after my decease, as
part of the expense of the administration of my estate.
2. I direct that all taxes which may be levied upon
property passed under this will and all outsider this will shall
be paid as an expense of the administrator of my estate.
3. I hereby give, devise and bequeath all my estate
and wordly possessions, real, personal and or mixed property,
of whatsoever nature and wherever situate, unto my beloved
daughter, Tracy Ann Harris.
4. In the event that my beloved daughter, Tracy Ann
Harris, shall not have reached the age of eighteen (18) years
at the time of my death, I appoint Mr. Co Mrs. Richard vJagner,
now of 1096 A Superior Drive, Harrisburg, Pennsylvania, 17111,
as guardians of the estate of my daughter, and I give, devise,
and bequeath all my estate, real, personal andlor mixed, of
whatsoever nature and wherever situated unto the said Mr. & Mrs.
Richard Wagner now of Harrisburg, Pennsylvania, guardian, in
trust, said trust is to be administered as the guardians deem
appropriate, with powers to invest, re-invest, collect and
receive income, payor deduct, expire the trust for the proper
and adequate maintenance and education and benefit of my
daughter, Tracy Ann Harris, and to give over such the accullIOlulated
income and principal less proper expenses at age 18.

5. It is my earnest desire that custody of my said
child, Tracy Ann Harris, should be reposed in the said ~lr. & Mrs.
Richard Wagner of Harrisburg, Pennsylvania.
6. I hereby authorize and empower my Executor herein-
after named, and my trustee, hereinbefore named, to sell all the
real personal property and any or all of the personal property
of which I shall die seized or possessed, or to which I am
entitled at my death, is the sole discretion of the said Executor
or guardian, at private or public sale, without an order of
Court, at such time or times and upon such terms as said Executor
or guardian shall deem proper for the best interest of my estate,
thereby converting the same into case; to execute, acknowledge
and deliver all proper writings, deeds of conveyance and transfers
thereof: and, in the contingencies above set forth, to add the
proceeds of sale of the said real and/or personal property to
the principal of the trust hereinabove created, to be administered
under and in accordance with the provisions of this, my last will
and testament.
7. I hereby nominate, constitute and appoint the said
Mr. Richard Wagner as Executor of this, my last will and testament.
8. I direct that my Executor and guardian hereinabove
appointed shall not be required to enter security in any juris-
diction in which he may act.

have letters testamentary issued to him and requested that such letters
be issued to the Petitioner, l,illiam Leo Robinson.
5. Such letters testamentary were issued to the Petitioner on
May 28, 1980, with no requirement that bond be given by said Petitioner.
6. Pursuant to the provisions of the decedant's Last Will and
Testament, the only person entitled to sbare in the decedant's estate
is Tracy Ann Harris, the decedant's natural granddaughter and adoptive
daughter, born November 14, 1964.
7. On June 27, 1980, this Honorable Court in Action No. 435,
1980, Orphans' Court Division, entered an order upon petition and
consent appointing Bonnie Kay French, the natural mother of Tracy Ann
Harris, guardian for the person of Tracy Ann Harris.
8. Tracy Ann Harris currently resides with her natural mother and
guardian of her person, Bonnie Kay French, at R.D. #10, Box 366, Carlisle,
Pennsylvania.
9. Tracy Ann Harris is the only person entitled to a family
exemption, under the Decedant's Estate and Fudiciaries Code of 1972 as
amended Act No. 130 of 1974 (20 P.S. ~3l2l), because she was living with
the decedant at the time of her death and she is her adoptive daughter.
She desires to take the exemption in cash and in kind.
10. The assets of the deceased and their appraised value at the
time of death were as follows:
