LAST WILL AND TESTAMENT OF'
EDGAR E. SPATZ
I, EDGAR E. SPATZ, of 267 Belvedere Street in the Borough of Carlisle,
Cumberland County, Pennsylvania, being of sound and disposing mind,
memory and understanding, do hereby make, publish and declare this as and
for my last Will and Testament, hereby revoking and making void any and all
Wills by me at any time heretofore made.
1. I direct my hereinafter named Executrix to pay all of my just debts and
funeral expenses as soon after my death as may be found convenient to do so.
2. I give and bequeath the sum of Five Hundred ($500.00) Dollars to the
Dallastown Branch of First National Bank of York, at Dallastown, Pennsylvani ,
its successors and assigns, in trust, to invest the same and to use the income
therefrom for the care and maintenance of the burial lot and monuments
thereon erected of my parents, Jacob H. Spatz and Emma A. Spatz.
3. I give and bequeath the sum of Five Hundred ($500.00) Dollars to the
Carlisle Office of Dauphin Deposit Trust Company, located at Carlisle,
Pennsylvania, its successors and assigns, in trust, to invest the same and
se the income therefrom for the care and maintenance of the Mausoleum
located at Westminster Cemetery near Carlisle, Pennsylvania.
4. If my wife, Helen Wilson Spatz, survives me, (and for the purposes of
this article she shall be deemed to have survived me unless it appears
unmistakable that she did' not) I direct my said wife as Executrix Of this my
last Will and Testament to set aside a portion of my estate equal in value to
(a) oneMhalf of the value of my adjusted gross estate (gross taxable estate less
funeral and administration expenses and claims and debts but before the
deduction of estate or inheritance taxes) as finally determined for Federal
estate tax purposes, less (b) the value of all interests in property, if any,
which pass or have passed to my wife under other provisions of this Will or
otherwise than under this Will, but only to the extent that such interests are fo
the purposes of the Federal estate tax included in determining my gross taxab

being given to the young people who are residents of the area comprising the
Central Conference of the United Methodist Church.
6. Should any person sharing in my estate be less than 21 years of age, I
direct said Farmers Trust Company, its successors and assigns, shall be
Guardian of the estate of each minor person and hereby authorize and direct
said Farmers Trust Company to pay the income arising from the estate of suc
minor person to the person having custody of such minor person for the suppor ,
maintenance, and eduditiomof such minor person, and also authorize and
direct said Farmers Trust Company to pay from the principal of the estate of
such minor person any amount which in its judgment is necessary or desirable
to be expended for the proper support, maintenance or education of such minor
person, and upon such minor person attaining 21 years of age to pay the then
remaining principal together with any undistributed income to such minor
7. I authorize my executors and trustees:
(a) To retain and to invest in all forms of real and personal property
regardless of any limitations imposed by law on investments by executors or
trustees;
(b) To compromise claims;
(c) To join in any merger, reorganization, voting-trust plan or other
concerted action of security holders, and to delegate discretionary duties with
respect thereto;
(d) To sell at public or private sale, to exchange or to lease for any
period of time, any real or personal property, and to give options for sales
or leases;
(e) To make loans to, and to buy property from, my or my wife's
executors or administrators (even if one or more of them is a fiduciary
hereunder);

(f) To borrow from Farmers Trust Company or its successors or
others, and to pledge property as sccurity for repayment of any funds borrowe
(g) To apply for my wifc's benefit or my son's bcnefit all sums to
which she or hc is entitlcd under thc trust provided for in this Will if shc or
he is, in my corporate trustce's opinion, disablcd by advanced age, illness or
other cause;
(h) To exercise any law~givcn option (i) to value my estate for death
tax pill' poses in accordance with Section 2032 of the Internal Revenue Code or
any corresponding provision of the law in force when I die and (ii) to treat
administrative or other expenses as income tax deduction regardless of
whether they were paid from principal or income, without regard to whether
the size of the trust provided for in this my last Will and Testament will be
increased thereby and without requiring reimbursement of principal for any
resulting increase in the estate tax; provided that all decisions under this

authority shall be made by my corporate executor alone; and

Except as stated in Paragraph (g), these authorizations shall be exercisable
in respect of all real and personal property at any time held by my trustees an
shall continue in full force until the actual distribution of all such property.
All powers, authorizations, and discretion granted by this Will shall be in
addition to those granted by law and shall be exercisable without leave of

8. I authorize my trustee to receive, as an addition to the trust hereunder
(i) the proceeds of any insurance policy on my life or any other death benefit
of which my trustee is named beneficiary and (ii) any property added to that
trust by the tcrms of my wife's Will.
9. In the event my wifc shall have pre~decease me and shall have by her
last Will and Testament or otherwise cstablished with Farmers Trust Compan
or its successors, a trust substantially identical to that hereinbefore

This assessment is made in accordanco with Section 708 of tho Inheritance and Estate Tax Act of
1961 (72 P.S. ~ 2485.708).
To the extent that inheritance tax is paid within three (3) months after the death of the decedent. 8
discount of five (5) percent is allowed (72 P.S. ~ 2485.716).
Inheritance Tax. other than tax on a future interest, is due at the date of the decedent's death and becomes
delinquent at the expiration of nine (9) months after the decedent's death (72 P.S. 9 24B5. 711). Inheritance
Tax on a' future interest is payable within three (3) months after the transfer takes effect in possession and
enjoyment and is delinquent thereafter (72 P.S, 9 2485.712). Calculate interest from the delinquent date shown
on the face of this form to the date of actual payment USing the following interest table:
