PERSONS RESPONSIBLE FOR RETURN Section 701 of the Inheritance and Estate Tax Act of 1961 provides tliat the following persons shall prepare and file a return: a, The personal representative of Ihe estate of the decerlent as to properly of Ihe decedent adminislererl by him and such additional properly which is or may be subject to Inheritance Tax of which he/she shall have or acquire knowledge; b, The transferee of property upon the transfer of which Inherilance Tax is or may be imposed by Ihe 1961 Statute, including a trustee of property transferred in trust, provided that no sep<lfate Ieturn need be made by llie transferee of property included in the return of a personal representative, " 2, PLACE FOR FILING The return is to be filed in duplicate with the Register of Wills of the county wherein the decedent resided. 3, TIME FOR FILING The return is due nine months after the decedent's death, unless an extension for filing has been applied for and granted by the Secretary of Revenue within the nine-month period, 4, FAILURE TO FILE RETURN Section 791 of the 1961 Statute provides that" , , ,any person who willfully fails to file a return or other report required of him, , .shall be personally liable, , ,to a penalty of 25% of the tax ultimately found to be due or $1,000 whichever is the lesser to be recovered by the Department of Revenue as debts of like amount are recoverable by law," 5. TAX RATES Inheritance Tax is payable at the rate of 6% on transfers to lineal descendants, such as father, mother, husband, wife, son, daughter, grandchildren, grandparent, son-in-law and daughter-in-law and at the rate of i5% as to all others, 6, PAYMENT OF TAX The tax assessed on the transfer of property reported in the return is due 9 months after the decedent's death. Interest at the rate of 6% per annum accrues thereafter until payment is made, All payments received are first applied to any interest which may be due with any remainder applied to the tax. IF TAX IS PAID WITHIN 3 MONTHS AFTER THE DECEDENT'S DEATH, A DISCOUNT OF 5% OF THE TAX PAYMENT IS ALLOWED, All checks should be made payable to tile Register of Wills of the county wherein the decedent resided and are received subject to the final determination of the Department of Revenue, 7, FAILURE TO PAY The taxes imposed, together with any interest thereon, are a lien upon real property, which lien remains in effect until the taxes and interest nave been paid in full. D. 1974, by and between \'lILLIAM \~. KINER and ETHEL R. KINER, his wife, of the Borough of Mechanics- burg, County of Cumberland and State of Pennsylvania, parties of the first part, AND KIRK R. HASSINGER and SANDRA E. HASSINGER, his wife, of the Township of East Pennsboro, County of Cumberland and State of Penn- sylvania, and RANDALL C. HASSINGER and MARGARET E. HAS- SINGER, his wife, of the, Township of Upper Allen, County of Cumberland and State of Pennsylvania, parties of the second part. WITNESSETH, that the said parties of the first part, for the consideration hereinafter mentioned and contained, agree to sell and convey unto the said parties of the second part, their heirs and assigns, the following . real estate: . Said installment payments shall continue until the unpaid balance of principal has been reduced to such an amount as can be borrowed by the parties of the second part on a conventional type Mortgage loan from a Banking institution in the State of Pennsylvania, at which time the said parties of the second part shall then pay to the parties of the first part the remaining balance in full. In addition to the said installment payments on account of purchase price and interest thereon, the said parties of the second part agree to pay the taxes, water rents, insurance premium, sewerage rentals, and make all, necessary repairs to the premises to keep the same in good condition. Taxes for 1974 shall be pro-rated as of Sep- tember 1, 1974. The parties of the second part shall make no major changes or improvements to the property without the written consent of the parties of the first part. Upon compliance with the foregoing terms and conditions, and payment of the said purchase price in full by said parties of the second part, the said parties of the first part will', at their own proper cost and charge, make, execute and deliver to the said parties of the second part a good and sufficient Deed for the proper conveying and assuring of the said premises in fee simple, free from all encumbrances, dower or right of dower, such conveyance to contain the usual covenants of general warranty. At the time of conveyance of the title, each party hereto shall pay one-half the total transfer taxes. , It is elso agreed between the parties hereto that possession of the said premises will be delivered to the said parties of the second part on the first day of September, A. D. 1974, and that said parties of the second part shall be entitled to receive rents,issues and profits therefrom from September 1, 1974, subject to the conditions herein set forth. The parties of the first part shall have the privileQe of encumbering the premises which are the subject of this Agreement by a Mortgage or otherwise, pro- vided, however, that at no time may any such encumbrance exceed the unpaid principal balance under this Agreement; and if the parties of the first part should default in mak- ing any amortized payments which may be required in connec- tion with such Mortgage or other encumbrance, the parties of the second part shall have the privilege of applying any sums payable under this Agreement to such encumbrance holder. In the event the said parties of the second part shall fail to make said monL;ly payments as aforesaid, for the space of thirty (30) days after the same shall have be- come due and payable by the te~s hereof, or if a breach of -2- ,', " : .l :' any of the other foregoing conditions be made by the parties of the second part, then and in such case, this Agreement shall become null and void and the 'said parties of the se- cond part shall forfeit all moneys then paid as liquidated damages. If default shall be made in the payment of any monthly installment as aforesaid, or a breach of any of the conditions of this Agreement shall be made by the parties of the second part, the entire principal sum remaining un- paid shall become due and payable at once and may be col- lected by suit or otherwise: and the Prothonotary or any . Attorney of any Court of record of Pennsylvania, or else- where, is hereby authorized and empowered to appear for and confess judgment against the said parties of the second part and in favor of the parties of the first part for the whole amount of said principal sum remaining unpaid, together with interest, costs of suit, release of errors, Attorney's commission of five (5%) per cent., and waiVing inquisition and exemption. Upon the breach of any of the covenants or condi- tions of this Agreement, or upon its termination by forfei- ture, the Prothonotary, or any attorney of any Court of re- cord of Pennsylvania, is hereby authorized to appear for and to confess jUdgment in an amicable action of ejectment against the said parties of the second part and in favor of the said parties of the first part for the premises herein described, and to direct the immediate issuing of a Writ of Habere Fa- cias Possessionem with clause of Fieri Facias for costs, waiving all irregUlarities, without notice and without leave of Court. ' Acceptance by the parties of the first part of any of the aforesaid monthly payments after the same shall have become past due and in default, Qr any failure to enforce any of the rights herein reserved to the parties of the first part, or any of the penalties, forfeitures or condi- tions herein contained, shall not in any wise be considered a waiver of the right to enforce the same at any time with- out any notice whatsoever. If the parties of the first part shall by one proceeding pursue a remedy on account of default on the part of the parties of the second part, this shall be considered an election of remedy by the parties of the first part and a waiver of the right to enforce any of the other proceedings herein contained, except that if the parties of the first part elect to keep moneys then paid as liquidated damages, they shall also have the right to a con- fession of jUdgment in ejectment and the i~mediate issuing of the l'1rit of Habere Facias Possessionem. The parties of the second part shall have the privi- lege of paying as much more than Two Hundred Five and 07/100 ($205.07) Dollars required monthly as they desire, and nothing contained in this Agreement shall be construed to limit them to said a.":Iount.
