KNOW ALL ~lEN BY THESE PRESENTS, tha t I, JOliN A. MYERS,
of Box 37, Purcellville, Virginia 22132, being one of the devisees
under the will of Zora A. Myers who died April 10, 1955, leaving
a last will and testament dated August 14, 1950, duly probated
April 14,1955, and remaining of record in Cumberland County
Will Book 49, at page 218, wherein per paragraph 6th she provided:
"The residence in which I live in Centerville, Pa., I
hereby devise to my six children, Nora V. Myers, John A.
1,lyers, Mrs. Elva Bixler, 01 ive L. !lyers, Dorothy ~lyers
and Leland Myers, on the following terms and conditions:
(a) My three unmarried daughters, Nora V. Myers, Olive L.
Myers and Dorothy Myers, or anyone or more of them shall
have the right and pdvi lege of maintaining their home in
said residence so long as any of them shall desire to do so.
(b) In the event that anyone or more of said daughters
shall desire to make her home in said residence then the
one or ones so residing therein shall keep said property
insured, in repair and shall pay the taxes thereon and
otherwise pay all of the expenses incident to the maintenance
of said residence.
(c) In the event that all three of said daughters shall
disclaim their right to maintain a home in said residence
by a written disclaimer, acknowledged and recorded by them
then said residence may be sold by my respective children.
(d) If, at any time, said residence shall not be occupied,
as a home by one or more of said unmarried daughters for a
continuous period of six months any right so to occupy
said residence in the future shall be forfeited and the
children may sell or partition said property.
(e) The residence referred to shall include the land
appurtenant thereto located on the south side of the
\':alnut Bottom Highway,"
du hereby irrevocably release, disclaim, renounce, and surrender
to my three sisters, Nora V. :,Iyers, Olive L. ~lyers, Dorothy ~lyers,
their heirs, devisees and assigns, all of my right, title and
