Hostetter, Jr., of the Borough of Palmyra, County of Lebanon and State of Pennsylvania, being of sound and dis- posing mind, memory and understanding, do make, publish and declare this to be my last \~il1 and testament, hereby revoking and making void all former wills by me at any time heretofore made. 1. I direct the payment of all my just debts and funeral ex- penses as soon as conveniently may be after my decease. 2. I give and bequeath such tangible personal effects as my automobile, household furniture, clothing, etc., to my wife, Anna B. Hostetter. 3. My sons and my daughter-in-law, Dorothy Hostetter, shall be given the privilege of selecting volumes from my library, and after their selections, representatives of the Messiah College Library and of the Brethren in Christ Church Archives shall be given the privilege or selecting books, papers and records which they feel would be of use to the Library and the l\.rchives. 4. Al~ the rest, residue and remainder of my estate shall be divided into five (5) equal shares and distributed as follows; (1) To my son, C. Nelson Hostetter, one share. (2) To my son, S. Lane Hostetter, one share. (3) To my son, D. Ray Hostetter, one share. C.H To The Harrisburg National Bank and 'frust Company, Trustee, one share, in trust, for the following purposes: A. To invest and reinvest the same in securities which are considered legal investments under the Fiduciary Laws of the State of Pennsylvania. B. To accumulate the income therefrom during the natural lifetime of my wife, Anna B. Hostetter, which accumulated income shall also be invested in like securities periodically and Page 1. If my said wife should exhaust her own estate, the Trustee shall have discretionary authority to use and consume so much of the principal and income of this trust estate as may be neces- sary for her comfortable support and maintenance, including medical, surgical and hospital or other institutional care. Upon the death of my said wife, to pay over the remaining balance of said trust fund, including principal and accu- mulated incomer to Messiah College, to be added by the Trustees of the College to the Chair of Theology Endowment. (5) To Dorothy Hostetter, widow of my deceased son, Glenn Hostetter, if she is living, one-fifth of one share, and the balance of this share to The Harrisburg National Bank and Trust Company, Trustee, in trust for the benefit of the four daughters of my said deceased son, i.e., Virginia Ann Hostetter, Victoria Ann Hostetter, Elizabeth Ann Hostetter, and Beverly Day Hostetter, in equal shares, for the following purposes: A. To invest and reinvest the same in securities which are considered legal investments under the Fiduciary Laws of the State of Pennsylvania. B. To accumulate the income therefrom, invest the same in like securities, and add them to the corpus of the share of each daughter. C. After each daughter reaches the age of eighteen years, and other educational funds and resources available to her have been exhausted, principal as well as income of her share may be used to meet such costs of higher or special education as are approved by her mother and the Trustee. D. When each daughter reaches the age of twenty-one years,one-half of the corpus of her trust estate shall be paid to her. Page 2. 7~O . ~. ~ ., , E. When each daughter reaches the age of twenty-five years, the balance of her trust estate shall be paid to her, F. The Trustee shall have discretionary authority at any time during the minority of any of the above-mentioned daugh- ters of my deceased son to use principal as well as income for her comfortable support and maintenance, including medical, surgical and hospital or other institutional care, if in the judgment of the Trus- tee it appears that her mother is not financially able to provide for such daughter's health, care and comfort. G. If any daughter should die without issue before receiving the full amount of her trust estate, the same shall be added to the trust estates of the other daughters. If, however, she should die with issue, then her trust estate shall be held in trust for such issue under the same conditions as set forth above until such issue shall have reached the age of twenty-one years. 5. I direct that the interest of all beneficiaries in the trust hereby created, whether in the princi.pal or income thereof, shall be free from liability to attachment or other legal process issued at the instance of any creditor or assignee of such bene- ficiary, and I direct that no payment shall be made in the way of anticipation of sums which may thereafter accrue to any beneficiary. 6. I hereby authorize, empower and direct my Executors, as such, or my Trustee, to sell at public or private sale or sales and to convey any real estate which I may own at the time of my decease, and to give good and sufficient deed or deeds for the same. 7. Upon the closing of my Executors' account, I direct my Trustee to receive from them in kind whatever unconverted assets may then remain in the hands of my Executors. 8. If, at the time of any distribution of any part of the trust estate formed in paragraph 4 above, any portion thereof is so Page 3. , ... "' ,#' , .
