PETITION FOR ADJUDICATION OF INCOMPETENCY
AND THE APPOINTMENT OF A GUARDIAN OF THE
ESTATE AND PERSON
TO THE HONORABLE, THE JUDGES OF SAID COURT:
The Petition of Anne Marie Sawyer, respectfully represents:
1. Petitioner is a registered nurse at the mental health facility of the Holy
Spirit Hospital, Camp Hill, Cumberland County, Pennsylvania.
2. Wanda T. Holley, the alleged incompetent, is currently receiving care at the
Holy Spirit Hospital, pursuant to a civil commitment under the Mental Health Procedure
Act of 1976, No. 2293, CiVil 1980, Cumberland County Common Pleas. Her age is 85 and

her date of birth is June 2, ~985.
3. Your petitioner is unsure of the extent of the alleged incompetent's estate
but believes it to consist of monthly payments of approximately $400.00 through Social
Security, and $129.01 monthly from the Pennsylvania Retirement Board.
4. The alleged incompetent was never a member of the Armed Services nor is she
receiving any benefits from the United States Veteran's Administration.
5. Wanda T. Holley is unable to manage her property, is liable to dissipate it,
and to become the victim of designing persons because of mental infirmities caused by
illness.
6. Wanda T. Holley, due to her mental infirmities, is unable without the continued
care and assistance of others, to properly care for her needs of nourishment, ~ersonal
or medical care, shelter and self-protection and safety.

ACCEPTANCE OF PROPOSED GUARDIAN
Family and Children'sService of Harrisburg, Inc. the guardian proposed in the
attached Petition for the appointment of a guardian of the Estate and person of Wanda T.
Holley, an alleged incompetent, agrees to accept the appointment and avers that:
1. The central office of the Family and Children's Service of Harrisburg, Inc.,
is located at 121 Locust Street, Harrisburg, Pennsylvania.
2. Work performed in administering the guardianships will be billed accordingly
to the rate per the contract between the guardian and Dauphin County for similar
services, which rate is currently $13.68 per hour
3. The proposed guardian has no interest adverse to Wanda T. Holley.

35 E. High Street, Carlisle, Pennsylvania.

of September, 1980, upon con-
sideration of the petition filed for the purpose of having
Wanda T. Holley adjudged an incompetent and a guardian appointed,
and upon consideration of the attached petition, the court,
being of the opinion that an examination of the alleged incom-
petent by an Impartial Medical Expert will be of material assis-
tance in the just determination of the case, it is hereby
ORDERED and DECREED that:
1. John M. Hume, M.D., Psychiatrist, is appointed
Impartial Medical Expert in this case.
2. Counsel for the parties in interest and Holy
Spirit Hospital of Camp Hill, Cumberland County, Pennsylvania,
shall promptly make available to the Impartial Medical Expert
copies of all prior medical and hos~ital reports in their posses-
sion which relate to the alleged incompetent's mental condition.

3. The Impartial Medical Expert shall fortlll~ith
examine the alleged incompetent and prepare a '~ritten report
setting forth his findings, diagnosis and prognosis, and his
opinion as to the folloNing: (a) Nhether the alleged incompe-
tent, "because of mental infirmities of old age, mental defi-
ciencies, drug addiction or inebriety, is unable to manage her
property, or is liable to dissipate it or become the victim of
designing persons"; (b) whether the alleged incompetent, "due
to her mental infirmities, is unable ,dthout the continued care
and assistance of others, to properly care for her needs of
nourishment, personal or medical care, shelter and self-protection
and safety"; and (c) whether the welfare of the alleged incompe-
tent and others in the courtroom will be promoted or endangered
by the alleged incompetent's presence there. He shall trans-
mit his report to the appointing judge and copies thereof to all
counsel of record prior to the hearing.
4. The Impartial Medical Expert shall appear in per-
son at the hearing Nhich is fixed for Court Room Number 1

AND NOW, October 1, 1980, at 10:38 a.m., after hearig on the
above matter, Wanda T. Holley having been present in court to-
gether with court-appointed counsel, Joseph P. Alexa, Esquire,
The Cumberland County Office of the Aging is appointed as
guardian of the person. The court will reserve the appointment
of the guardian of the estate until counsel can satisfy us of the
competency of the Office of the Aging and/or some other person.

In conclusion. Petitioner suggests that the aforesaid standard does not
preclude the Courts appointing the Cumberland County Office of Aging as guardian of
the estate of Wanda T. Holley as well as guardian of the person. Petitioner submits
that it has no interest adverse to that of Mrs. Holley. Due to their numerous contacts
in the past with Mrs. Holley as well as their continued involvement with Mrs. Holley
now that she is under their guardianship, it is clear that they are the most suitable
to serve in that capacity.
