IN THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY, PENNSYLVANIA Orphans' Court Division NEGLEY, AN ALLEGED INCOMPETENT NO. 624 ORPHANS' 1980 MEMORANDUM Velma M. Negley was adjudicated incompetent by your Honorable Court on October 20, 1980, fOllowing a hearing at which testimony was presented by her son, daughter, neighbor and physician. Her daughter, Miriam Critchfield, was appointed guardian of the person. The Court took under advisement the matter of appointment of a guardian of the estate due to the preexisting power of attorney allegedly given to her son, Finley B. Negley. At the hearing, testimony was given that the son, Finley B. Negley, was given the power of attorney about two years ago and has Operated pursuant to that power during that time. Although the Court ruled that the details of his handling of his parent's financial affairs were not relevant to the incompetency hearing, and were, therefore, not inquired into, it did appear on the record that certain real estate belonging to the parents was transferred to Finley B. Negley and his wife during the time he was operating under a pOwer of attorney. A deed, reflecting this transfer, is recorded in the Recorder of Deeds office of CUmberland County, at 28H-242. The deed, a copy of which is attached hereto, is dated February 15, 1979, and recorded the same date, and recites a consideration of "One Dollar ($1.00) and other good and valuable considerations." The testimony at the hearing further showed that the actual incompetence of Velma M. Negley began as early as the fall of 1977 and that both parents had been 1 greatly dependent on the advice and assistance of Finley B. Negley (who lived next door to them) for quite some time. Neither Petitioner nor her attorneys have been furnished wi th u copy of the power of attorney nor have they been provided wi th any information concerning the financial matters of the parents, nor the disposition of other property, during that time, and, therefore, are not in a position to assess the stewardship of Finley B. Negley. Under circumstances whl\re there is a question whether Velma M. Negley was competent to grant a power of attorney, and further questions concerning the disposition of property by Finley B. Negley while acting as Attorney in Fact, without either posting bond or having Court supervision of his stewardship, Petitioner believes it would be in the best interest of Velma M. Negley to have an impartial and experienced guardian appointed to manage her financial affairs. We are dealing here with a situation where, because of the incompetence of Velma M. Negley, the power of attorney cannot now be revoked and the exercise of its powers cannot be reviewed, evaluated or challenged by the person who gave the power. An Attorney in Fact, representing an incompetent, may have all the powers of a Court-appointed guardian, yet does not have to account for the assets entrusted to him unless an interested third party were willing to voluntarily expend the time and money necessary to prosecute an accounting, and, possibly, further litigation to recover assets on behalf of the incompetent. In fact, it is questionable whether anyone other than the principal or a guardian may revoke or seek an accounting from an Attorney in fact. Section 5601 of the PEF Code, 20 Pa.C.S. Section 5601, reads in pertinent part as follows: "If a guardian thereafter is appointed for the estate of the principal, the attorney in fact or agent, during the continuance of the appointe nt, shall 2 account to the [luardian rather than the principal. The guardian shall have the same power the principal would have had if he were not disabled or the principal would have had if he -had not been adjudicated incompetent or had not created the power of attorney or agency. The guardian may either permit the attorney in fact to continue to act or revoke the power of attorney." It would appear that if there were no guardian of the estate to act on behalf of an incompetent principal then there would be no one to decide either to continue or revoke the power of attorney and therefore, by default, the power of attorney would continue whether 01' not the continuance would be in the best interests of the incompetent. Further, Petitioner believes a professional guardian would be more experienced and capable in discovering and obtaining government benefits to which Velma M. Negley may be entitled in order to partially defray the large expense of care.. Petitioner proposed the United States National Rank in Johnstown, having an office in Somerset, as guardian due to the fact that it is a well-known and reputable bank in the immediate area where Velma M. Negley now resides and, hence, would be in the best position to conveniently and economically administer the estate. Due to the relatively modest size of the estate, it is difficult to obtain the services of a professional guardian. Petitioner believes that Section 5512(c) of the PEF Code, 20 Pa. CS 5512(c) authorizes the Court adjudicating the incompetency to retain jurisdiction over the incompetent's estate regardless of the fact that the guardian may be located in 3 ; - , another county of the Commonwealth. Negley is that she is unable to remember close relatives and friends, unable to find her way home or to seek assistance for shelter. Petitioner has been advised by her physician that this condition is unlikely to improve. 4. Velma M. Negley is married to Wayne B. Negley.
