Maier, deceased, STEPHEN HENRY LAFFEY and KAREN JANE LAFFEY, grandchildren of Sophie V. Maier, and the sole remaindermen of the Trust established under the will of Sophie V. Maier, individually, and FARMERS TRUST COMPANY of Carlisle, Pennsylvania, WITNESSETH: WHEREAS, Sophie V. Maier died on July 18, 1986, having first made her Last Will and Testament dated December 5, 1960, in which she disposed of her property as follows: "FIRST: I do not hereby exercise any power of appointment given me under the last Will and Testament of my husband, Henry Maier. SECOND: I direct that all my just debts and funeral expenses shall be paid as soon after my decease as may be practicable. THIRD: I give and bequeath to my husband, HENRY MAIER, all my tangible personal property and/or interest therein wheresoever situated which is used, adapted or intended for personal or household use, pleasure, adornment or transportation. In the event my said husband does not survive me, I give and bequeath the same to my daughter, JANE ANN LAFFEY. WHEREAS, by the SEVENTH article of her Last Will and Testament, Sophie V. Maier, named her husband, Henry Maier, Executor and Trustee of said will and nominated the Chase Manhattan Bank as Executor and/or Trustee if Henry Maier should fail to qualify, and WHEREAS, Henry Maier died on November 5, 1980, and the Chase Manhattan 8ank had previously informed SOphie V. Maier by correspondence dated August 4, 1976, and February 1, 1977, that it would not qualify in the absence of a provision in her will that assured the bank of increased fees in accordance with the bank's minimum fee schedule, which fees are substantially in excess of the fees currently proposed by Farmers Trust Company which has served as Guardian of the Estate of Sophie V. Maier since November 3, 1980, and the Chase Manhattan 8ank sUbsequently returned the Last Will and Testament of Sophie V. Maier to her on August 7, 1978, thereby effectuating its renunciation as Executor and Trustee, and WHEREAS, Sophie V. Maier, because of several years of mental and emotional instability, was adjudged incompetent by the Court of Common Pleas of Cumberland County on November 3, 1980, and Farmers Trust Company of Carlisle, Pennsylvania, was appointed Guardian of her estate in proceedings at No. 630 Orphans' 1980, and WHEREAS, Farmers Trust Company, Guardian as aforesaid, has faithfully performed its obligations of guardianship and has filed its Firat and Final Account in the estate of Sophie V. Maier with the Court of Common Pleas of Cumberland County, Pennsylvania, on Sep~ember 12, 1986. NOW THEREFORE, the parties hereto intending to be legally bound hereby mutually agree as follows: 1. That the parties hereto and each of them do mutually agree that the Last Will and Testament of Sophie V. Maier, dated December 5, 1960, shall be effectuated without the necessity of probate and by the means of this Family Settlement Agreement. 2. HUMER: Good afternoon, Your Honor. 'This is the time fixed for the hearing on the petition of Henry Maier for the Adjudication of Incompetentcy of his wife, Sophie V. Maier. As I informed Your Honor Friday, Mr. 11aier is ill, was taken ill suddenly, and is a patient in the hospital, so his daughter, Mrs. Laffey, will be here and I propose to put her on briefly. THE COURT: Very well. Whereupon, ,lANE M. LAFFEY having been duly sworn according to law, testified as follows: DIRECT EXAMINATION BY ~IR. HUMER: D please state your nane and your residence address. A. Jane Laffey, Boiling Springs, Pennsylvania. D How are you related to Sophie V. Maier? ~ I am her daughter. D Are you related to Henry Maier? ~ 1 am his daughter. D Are you the only child? ~ Yes, sir, I am. -3- o Mr. Maier was the petitioner in this proceeding, and will you tell the Court when he became ill and where he now is. A. Your lIonor, dad was retired on Thursday evening at about ten o'clock; about quarter-of-three in the morning he awakened with a severe angina and then had a seizure which for the moment I couldn't diagnose. My guess was, as a laymen, was that he had had a stroke, but that does not happen to be the case. We took him to lIoly Spirit Hospital and had him admitted through the emergency room. His own physician has kept him there in order to make tests to ascertain what the cause of the problem was. o Mrs. Laffey, you are familiar with this proceeding, are you not? A. Yes. Q. P.re you wholly in accord ~li th the prayer of the Petition? L I am entirely in accord with it. MR. HUMER, I have no further questions unless Your Honor has questions. BY 'l'HE COUR'r: Q. 11010[ old is your father, Mrs. Laffey? A. My fa ther was ninety on the 23rd of September. o I notice that the petition asks that he be appointed in an advisory capacity. I guess that was a matter of appeasement. L It was a matter of consideration. He has spent his life amassing this estate for my mother and he has amassed one for himself. -4- Letting go of control was a matter which I thought would hasten his decline, so .:J t r.lr. lIumer' s suggestion, we took this tact. Mr. Caverly was cheerful and agreeable about the approach. 'l'HE COURT: 'l'ha t's all. You may step down. (Witness excused.) MR. IICMER: As my next witness I call Dr. John F. Mira. Whereupon, JOliN F. mRA having been duly sworn according to law, testified as follows; DIRECT EXMIINATION BY BR. limIER: ~ Dr. Mira, for the record, will you state your name in full, office address and professional qualifications. A. r4y name is John Francis Mira; I have an office in the Kronenberg Building in Carlisle, and I am a psychiatrist and was trained at the University of Rochester in psychiatry, and I am Board certified in psychiatry. Q. Have you had an opportunity to see Mrs. Sopie V. ~!aier? ~ Yes, I saw her initially upon her admission to Carlisle Hospital on the 25th of August 1980, and she was admitted at that time for increasing agitation and paranoid feelings that were not able to be controlled by a number of various tranquilizer medicines by her internist. She \,'as admitted to the psychiatric unit for evaluation of the medications and procedures that might control -5- her behavior and to be in a secure area while that was done. She was discharged after I had seen her on il daily basis for the most part, either in group meetings or on every other day, ~ersonally, individually, on the 20th of october 1980, and I saw 1 i i I I I. I here again on the 31st of October. D What, if anything, have you been able to observe with respect to Mrs. Maier's' competency? A. Starting a t leas t from psychia tric observa tions, ~lrs. 11aier, upon admission to the hospital, was suffering what we believe to be accute severe depression with paranoid feelings and confusion; depression that probably has been related to increasing changes in her husband's condition, and in the last few years, changes in her own location. Going back briefly in her history, she had been living in New York City for a number of years, and for a time was there while her husband was in Boiling Springs. In 1977, I believe, in response to some change in her husband's condition, she came to Boiling Springs, was admitted to a psychiatric hospital then, very, very upset with similar kinds of symptoms to now. She has been interr:littently having extreme episodes of agitation, disorientation, and feeling that people around her are taking her possessions or designing to take her possessions. She presented that way on the in-patient interview in Carlisle Hospital and was difficult to medicate in the usual fashion with what we call -6- anti-psychotic medicines because she was sedated very quickly, and we couldn I t give her enough of the medicines to decrease her paranoid feelings and keep her awake, basically. We then decided to try anti-depressant medications, and she succeeded in pulling herself together with those medicines to th,e extent that at a protected, predictable setting she ~las able to talk rationally seventy percent of the time and to behave herself in a way that was appropriate in the hospital on anti-depressant medicines. .~, .r, . l'lhen her environment changed, however, or whenever she was given l~ord about how things were going with her husband, or when she ~lould see him, she became very emotional and for a day or so afterwards, even on the medicines, she would be disoriented at times; she would not YJ10wat times whether she was in the hospital or no t . Also, one thing that we noted, when new patients came to the hospital, she would be most overly ingratiating with them, thinking that she wasn't in the hospital and that it was her duty to help those people, more to an extent than would be expected from just another patient in the environment. So, she changes from a period of being very high and very pleasant but almost too giving to periods when she is very frightened and feelings that people are taking things from her when they really aren't. -7- This behavior is in many \~ays typical of an extroverted individual who begins to become senile and is also depressed, and tha t is really the pa t tern in a general way tha t Nrs. Maier had had. She has been a stage person and a very extroverted person for a greater portion of her life, and now she is showing, basically, some deterioration of her ability to remember recent events. She has senile brain disease and also is depressed, and when she becomes accutely depressed and is confronted with the changes in her envi.ronment or husband's changing condition, she becomes frightened and then cannot really remember where he is at times or control the resources around her. D Have you discussed with Mrs. Maier this Petition to have her adjudicated an incompetent and to appoint a guardian for her? A. Yes. She understood, I believe. fully what was being done. She, in fact, said to me, "I can't take care of my own money." Maybe not those exact words, but she was saying very clearly that she meant that she is not able to know the exact amount of her resources or to disperse it wisely. She says, "r give it away sometimes." and she seems to recogni ze tha t. She was very upset about the ~lord "incompetent." She thought that that was too gross a description of what was the matter with her, and we tried to explain to her that that is the way the law defined it, that is the word the law uses, but she was very upset about that. -8- , .' . ., r , ' ~, . . . " Q. Mrs. ~laier is not here today. Have you any opinion, based upon your examination of her mental condition, as to whether or not her welfare would be promoted or impaired by her presence here tOday? A. Before the learning of her hsuband' s condi tion I was " prepared to say -- and I think it would be an accurate assessment that her welfare would be impaired by being here because this is a different and new setting for her; and when she is in a different setting, she becomes frightened because she is not able to learn and retain things the way younger individuals can and then she becomes very agitated. She also takes things in a very concrete and general way, and although she understands that she needs to have help with her money, I think a Court hearing Uke this would bring upon her very generalized notions that she is being declared unfit to care for herself and an unworthy person. So she would very likely then, I think, become very agitated and maybe even need hospitaliZ3tion, so I thought it would not be wise for her to be at the hearing. Q. Dr. Mira, have you an opinion as to whether or not, because of her infirmities of old age, she is competent to manage her property? A. I think that, based on Mrs. Maier's own assessment and also the judgment that I have made observing her behavior on the unit, especially in the way in which she became overly ingratiating -9- with other patients and handled herself in a very impulsive way that it is appropriate that an action such as this take placa and that a guar.dian b,! set up [or che handling of her property .1/ d tbe handlin':! cf her funds. MR. HUMER: Your Honor, tt,at is all I :lavc. Do you have al;y questions of Dr. Mira? BY THE COURT: 0. Your direct answer to Mr. Ht;mer' s question then would be that it is your opinion tnat she would not be capable of managing her estate or her assets at thid time? ". Yes, it is my opinion that she \lculd not. 0. For the record, in addition to being a psychiatrist, you are a medical doctor; is that correct? A. Yes, I am. 0. When you last saw Mrs. Maier, was she at her home? A. She is now living at the Homewood Retirement Center; that's where she ~ent from the hospital because it was very difficult for her to be in the same environment as her husband with his fluctuating condition. She came to the hospital on an appointment made by me to see her and ~c see how she was doing on the medications, and I saw her in the emergency room on October 31st at the hospital on that day. Q Based on hee age, do you anticipate any radical improvement in her clJr.dition at this time? -10- A.
