I, ELIZABETH B. FALLER, of the Borough of Carlisle, Cumberland
County, Pennsylvania, declare this to be my Last Will and revoke
any wills previously made by me.
I. I bequeath $1000.00 to St. Patrick's Church, Carlisle,
Pennsylvania, in memory of my husband, John O. Faller, Jr., with
the stipulation, however, that the funds therefrom be used only
for some purpose at the Shrine Church at 140 East Porn fret Street,
Carlisle, Pennsylvania.
II. I bequeath to Elizabeth Billow Martonyi the Walnut
Standing Leaf Empire Table in the dining room (which belonged to
her great great aunt, Mary Speck), my set of white china decorated
with blue forget-me-nots and my ring with three diamonds in Tiffany
setting.
III. I bequeath to Kim Billow Armondo and Sally Billow Lamb
two Victorian Needlepoint chairs each (which belonged to their great
great grandmother Kraus).
IV. I bequeath to Nancy Ann Faller my Sapphire Diamond Bar
Pin set in platinum (which I received from Mary Boas Faller), the

VII. I bequeath to David John Faller the brass ink stand
(which came from Ralph Harris).
VIII. I bequeath to George B. Faller the pair of brass church
candlesticks and the framed papal blessing for Nancy Dysert Faller
and family.
IX. I bequeath to the Cumberland County Historical Society
and Hamilton Library Association the painting of Independence Hall
painted by Lone Star Dietz.
X. I direct that the following items of my household furnishings

C. 1 direct that my Trustees shall payout of income
in quarterly installments or more frequently at the
convenience of the Trustees to or for the benefit of
my grandson, John Terence Faller, such amount as my
Trustees deem necessary or advisable for his comfort-
oble support and maintenance. As of the date of this
will, 1 suggest that such amount should be $300.00
per month but I direct that my Trustees may adjust the
amount upward having due regard for the increase in
cost of living as indicated by Consumer Price Index
published by the Bureau of Labor Statistics. In
addition to such amounts as set forth above, I direct
that my Trustees may pay such additional amounts as
deemed necessary or advisable by my Trustee for the
education of John Terence Faller as well as for any
unusual medical or dental expenses and for any emer-
gency which may befall him.
D. Any income not required or paid for the purposes set
forth in subparagraph C above shall, at the end of each
accounting year of the Trustees be paid absolutely to

E. My Trustees may pay to or for the benefit of John
Terence Faller such portion of principal as the

tion or general welfare of my grandson, John Terence
Faller, having due regard, however, to any duty of support

F. Upon the arrival of John Terence Faller at age twenty-
one years, or upon completion of his education, which-
ever shall later occur, my Trustees shall distribute
any accumulated income and all principal of said
trust estate (including items which wer~eld in

absolutely to my son, John D. Faller, Ill. I f my son,
John D. Faller, III, is not surviving, thon my Trustees
shall distribute said inoome and principal to his
children in equal shares.
G. In the event of the death of John D. Faller, III
without leaving any children to survive him the
prinoipal of said Trust Estate shall be paid in equal
shares to my two brothers or the ohildren of my two
brothers per stirpes.
In the event of the death of
any of the children of my two brothers, leaving
children to survive him or her, the share of the
parent shall be paid to the surviving children per
stirpes.
XIV. All principal and income shall, until actual distribution
to any beneficiary, be free of the debts, contracts, alienations and
anticipation of suoh beneficiary and the same shall not be liable to
any levy, attachment, execution or sequestration while in the hands
of my Trustees or Executor.
XV. The Trustees may retain any of the assets of my estate
which come into their hands and shall invest and keep invested the
principal of the Trust Estate in such manner and in such securities
or other property, real or personal, and upon such terms and for such

hereby to give to the Trustees full and complete authority to hold,
possess, manage, oontrol, sell, convey, encumber, lease, give and
execute options, invest and reinvest the whole and every part of the
Trustee Estate according to their sole judgment and discretion without
any limit upon the power and authority so to do by statute or other-
wise. The Trustees may allocate receipts and expenses to principal
or income or partly to each as my Trustees from time to time think

XVI. I appoint George u. Faller to be executor of this my
Last Will. In the event he Fails to qualiFy or ceODeD to act, then
I appoint Farmers Trust Company to be Executor.
XVII. I appoint my son, John D. Faller, Ill, my niece, Therese
Frances Faller and Farmers Trust Company to be Trustees under this
my will. In this connection, I direct that my corporate Trustee
shall have the sole management in the investment and reinvestment
of the trust assets.
XVIII. I appoint Farmers Trust Company to be guardian of the
estate of any minor beneficiary under this my will. In addition to all
powers authorized by law, I authorize said guardian to pay any portion
or all of the principal of said guardian estate to or for the benefit
of such minor beneficiary for his care, maintenance, support, educa-
tion or general welfare or any illness or emergency which may befall
him.
XIX. I direct that my Executor, my Trustees and my guardian
shall not be required to file bond in this or any other jurisdiction.

PENNSYLVANIA INHERITANCE TAX GENERAL INFORMATION
1. PERSONS RESPONSIBLE FOR RETURN
Section 701 of the Inheritance and Estate Tax Act of 1961 provides that the following persons shall prepare and file
a return: ." ,; .
a. The personal representative of the estate of the decedent ilS 10 properly of the deceuenl adlllini?lered by him
and such additional property which is or may be subject to Inherililnce Tax of which he/she shall have or
acquire knowledge;
b. The transferee of properly upon the transfer of which Inheritance Tax is or may be imposed by the 1961 Statute,
including a trustee of property transferred in trust, provided lhat no separate return need he made by the transferee
of property included in the return of a personill representative.
2. PLACE FOR FILING
The return is to be filed in duplicate with Ute Register of Wills of the county wherein the decedent resided.
3. TIME FOR FILING
The return is due nine months aller the decedent's death, unless iln extension for filing has been ilpplied for and
granted by the Secretary of Revenue within the nine-month period.
4. FAILURE TO FILE RETURN
Section 791 of the 1961 Statute provides that" . . .any person who willfully fails to file a return or other report
required of him. . .shall be personally liable. . .to a penalty of 25% of the tax ultimately fouiid to be due or $1,000
whichever is the lesser to be recovered by the Department of Revenue as debts of like amount are recoverabl e by
law."
5. TAX RATES
Inheritance Tax is payable at the rate of 6% on transfers to lineal descendants, such as father, mother, husband, wife,
son, daughter, grandchildren, grandparent, son-in-law and daughter.in-Iaw and at the rate of 15% as to all others.
6. PAYMENT OF TAX
The tax assessed on the transfer of property reported in the return is due 9 months aller the decedent's death. Interest
at the rate of 6%per annum accrues therealler until payment is made. All payments received are first applied to any
interest which may be due with any remainder applied to the tax. IF TAX IS PAID WITHIN 3 MONTHS AFTER THE
DECEDENT'S DEATH, A DISCOUNT OF 5% OF THE TAX PAYMENT IS ALLOWED.
All checks should be made payable to the Register of Wills of the county wherein the decedent resided and are
received subject to the final determination of the Department of Revenue.
7. FAILURE TO PAY
The taxes imposed, together with apy interest thereon, are a lien upon real property, which lien remains in effect until
the taxes and interest have been paid in full. The taxes may be sued for agains~ any real properly.ir1"thedecedenl's. n ,,,.
estate or against any property belonging to a transferee liablefor the tax.
8. FILlNGOF FALSE RETURN
Any person who willfully makes a false return or report required of him shall, in accordance wilh Section 793 of the
1961 Statute, be guilty of a misdemeanor and, on conviction thereof, shall he sentenced to pay il fine not exceeding
$1,000 or undergo imprisonment not exceeding one yeilf or both.

Pennsylvania, and ha:ve been actively engaged in tj-,e Real Est.ate business
for the past twenty years in the Cumberland County area. I am thoroughly
familiar with real estate values in thjs area.
On March 23, 1981, accompanied by REALTOR George Lo Ebener, I inspected
the above captioned tract to establish my opinicn of its market value as
of November 6, 1980, the date of the death of Elizabeth B. Faller.
This tract of 18 acres is a part the described parcel of real estate in the
above referenced deed. I tis located in South Middleton Township, on
Rocklildge Drive (T478) between T477 and highway 174. None of the lal!ld fronts
on a hard road _ this tor'act is approximately 200 yards from Rockledf,e Drive.
The land is generally gont'ly rolling in character and has many trees;
however tl"e trees are not suitable fop hurvest other than fOl' firewood.
In my opinion the fair market balu(~ of t.his tract was ;;$21000.00 as of
November 6, 19800 This figure was ar'rived at by comparing it to a sale
that is under wuy at this time (Mt Hock Estates to John staub) wjth
settlement sch8duled sometime in AfJl'il 19810

INSTRUCTIONS FOR COMPLETING SCHEDULE "B"
Schedule "B" must include all tangible and intangible personal property
owned individually by the decedent at the time of death. Property owned
jointly with another party or parties should be listed on Schedule "E" - - Jointly
Owned Property. Intangible personal property, titled in the'name of the decedent,
but payable at death to another party or parties, including but not limited to
P. O. D. U. S. Savings Bonds and Tentative Trust Accounts, must be listed on
Schedule "B".
Tangible personal property should be listed first. Examples of tangible
personal property are jewelry, wearing apparel, househpld goods and furnishings, .
books, paintings, automobiles, boats; snowmobiles, aircraft, etc.
Intangible personal property includes cash'on'~andand.in the bank, stocks,
dividends, bonds, mortgages, treasury certificates, notes, together with accrued
interest, salaries or wages, insurance payable to the ~state or fiduciary in said
capacjty, partnership interest, etc. An interest in any undistributed estate or

account as reserved for "possible additional expenses, taxes, assess-
ments and contingencies as may be determined to be due" will be re-
tained by the executor, at interest, as follows: at the expiration
of one year following confirmation of the account, or at such earlier
time as the executor deems advisable, the executor proposes to dis-
tribute such funds with accumulated interest, less however, any

B. Faller, late of Carlisle Borough, cumberland county, Pennsyl-
vania, together with statement of proposed distribution thereon,
having been confirmed by the Court on January 12, 1982, and dis-

IT IS THEREFORE ORDERED AND DECREED, that in accordance with
the said final account and statement of proposed distribution as
confirmed by the court, the distribution of the follow{ng real
estate to John D. Faller, III is hereby confirmed and the same
is awarded to John D. Faller, III, his heirs and assigns:
