OF DONALD E. SIlOR'f
I, DONALD E. SHORT, of Upper Allen 'fOlmship, Cumberland County,
Pennsylvania, being of sound and disposing mind, memory and under-
standing, do hereby make, publish and declare this as and fOl' my Last
\Hll and Testament, hereby revold.ng and making void any and all wills
by me at any time heretofore made.
1. I direct that all my debts and funeral expenses be paid as
soon as practicable after my death by my Executor hereinafter named.
2. All the rest, residue and remainder of my estate, real,
personal and mixed, and wheresoever the same may be situate, I give,
devise and bequeath to the First Bank and Trust Company of Mechanicsburg,
Pennsylvania, its successors and assigns, as Trustee, in trust for my
son, Robert S. Short, born July ij., 1959, and my daughter, Vicki D. Short,
born July 13, 1961, each child to have an equal share and interest in
my estate and a separate trust fund established by the Trustee repre-
senting his or her fifty (50) pereent share. Within ninety (90) days
of the date of my death I direct my Trustee to sell any real estate and
automobiles which may be owned by me at the time of my death, the pro-
ceeds of such sales to be put into tlle trust funds as provided herein.
The Trustee is directed to expend interest only from the trust for the
purpose of the support and maintenance of my son and daughter as is
necessary in the Trustee's discretion to provide therefor. The Trustee
is further authorized and directed to pay income and principal from the
trusts as is necessal'y in the Trustee's discretion to provide for the
education, including higher education, and medical care for my son and
daughter. Payment from the trust shall be madf! by the Trustee to the
Guardian of the person of my son and daughter or directly to my son and
daughter, whoever, in the discretion of my Trustee is the appropriate
payee. Each child shall be able to draw from the balance of the princi-

the principal of the trust fund at thc age specified as directed herein.
The Trustee's authol'ity shall terminate \~hen the Trustee has tUl'ned over
to the youngel' child the balance of the principal remaining in her
aecount at the age of thirty (30) years. Should either my son or
daughter predecease me, I direct the share such deceased child would
have received shall pass to the surviVal' of the tl~O.
(a) In addition to the pOI~ers conferred by case lal~,
by statute and by any other provisions hereof, the Trustee
shall have the follol~ing discretionary pOl~ers applicable to
all real and personal property held by it, including
property held for minors, all real and personal property being
referred to in this paragpaph as the Trust Estate, which
powers shall be effective I~ithout court order and shall exist
until the trus t is terminated:
(i) To retain any propcrty received by it,
including its 01011 stock;
(ii) To invest and reinvest all or any part of
the Trust Estate in such stocks, bonds, securities or
other property, l'eal 01' personal, as it, in its
discretion shall deem peopel', without regm'd to

to delegate authority lVith respect thereto, to deposi,t
investments under agreements, to pay assessments, and
generally to exercise all rights of investors;
(viii) To permit the proceeds of any insurance
policy to remain lVith the issuing insurance company for
the benefit of any income beneficiary under any optional
method of settlement allowed by the issuing company;
(ix) To invest in endolVment, insurance at' annuity
policies on the life of beneficiary hereunder;
(x) To do all the other acts in its judgment
necessary or desirable for the proper management,
investment and distribution of the Trust Estate.
(b) All income or principal held for the use and benefit
of the beneficiary of this trust shall not be in any lVay or
manner subject to anticipation, assignment, pledge, sale or
transfer, nor shall any such interest, IVhile in the possession
of the Trustee, be liable for or subject to thc debts,
contracts, obligations, liabilit ies or torts of the beneficiary,
or to attachments, executions or sequestrations undel' process

In addition to debts incurred by the decedent or estate, other items are claimable including the cost of administration,
attorney fees, fiduciary fees, funeral and burial expenses including the cost of a burial lot, tombstone or grave marker.
All debts being claimed against an estate are subject to the approval of the Register of Wills with whom the
Inheritance Tax Return is filed. Evidence to support the decedent's or the estate's liability for the debts being claimed
should be attached to this schedule.
A family exemption of $2,000 may be claimed by a spouse of a decedent who died domiciled in Pennsylvania.
If there is no spouse, or if the spouse has forfeited his/her rights, then any child of the decedent who is a member of
the same household can claim the exemption. In the event there is no such spouse or child, the exemption can be
claimed by a parent or parents who arc members of the same household as the decedent.

The return is due nine montlls after the decedent's death, unless an extension for filing has been applied for and
granted by the Secretary of Revenue within the nine-monlh period.
4, FAILURE TO FILE RETURN
Section 791 of the 1961 Stalute provides that" . . .any person who willfully fails to file a return or other report
required of hjm. . .shall be personally Ijable. . .to a penalty of 25% 01 the tax ultimately found to be due or $1,000
whichever is the lesser to be recovered by the Department of Revenue as debts of like amount are recoverable by
law."
5, TAX RATES
Inheritance Tax is payable at the rate of 6% on transfers to lineol descendants, such as father, mother, husband, wjfe,
son, daughter, grandchildren, grandp~rent, son-in-law <lnd d~ughter-in-Iaw and at the rate 0115% as to ~1I others,
6. PAYMENT OF TAX
The tax assessed on the transfer of property reported in the return is due 9 months after the decedent's death. Interest
at the rate of 6% per annum accrues thereafter until payment is made. All payments received are first applied to any
interest which may be due with any remainder applied to the tax, IF TAX IS PAID WITHIN 3 MONTHS AFTER THE
DECEDENT'S DEATH, A DISCOUNT OF 5% OF THE TAX PAYMENT IS ALLOWED.
All checks should be made payable to tlle Register of Wills of the county wherein the decedent resjded and are
recejved subject to Ihe final determination of the Department of Revenue.
7. FAILURE TO PAY
The taxes imposed, together with any jnterest thereon, are a lien upon real property, which lien remaios jn effect until
the taxes and interest have been paid in full. The taxes may be sued for against any real property jn the decedent's
estate or against any property belongjng to a transferee liable for the tax.
8. FILING OF FALSE RETURN
Any person who willfully makes a false return or report required of him shall, in accordance with Section 793 of the
1961 St~lute, be guilty of a misdemeanor and, on conviction thereof, shall be sentenced to pay a fine not exceeding
S1,OOO or undergo imprisonment not exceeding one year or both.
