BUSHEY, of Milton, Sussex County, Delaware, being of sound and disposing mind and memory, do hereby make and declare this as and for my Last l'1ill and Testament, hereby revoking all prior wills and codicils heretofore made by me. ITEM I. I direct my executors, hereinafter named to pay all my just debts and funeral expenses as soon after my death as may be convenient. ITEM II. I direct that my executors sell my real estate as soon as it can be conveniently done. ITEM III. It is my intent and desire that any written statement or list to dispose of items of tangible personal property not othenTise specifically disposed of in this will that may be prepared by me after the execution of this will is to be given full force and effect to dispose of the specific itmes of personal property which is either in my handwriting or signed by me and which identifies the items and the legatees, all in accordance with 12 Del. e S212 of the Delaware Code. ITEM IV. In the event that my husband, Norman F. Bushey shall survive me, I bequeath the rest and residue of my estate to A.J. Stevens III. and John Bushey, Trustees, for the following purposes: The trustees shall hold, manage, invest and reinvest the principal of the trust and collect the interest therefrom and shall use so much of the principal and/or interest for the care and maintenance of my husband, Norman F. Bushey, during his lifetime. The trust shall te~inate at the death of my husband and the trustees shall: (l) Pay the sum of Eighteen Hundred Dollars ($1800.00) to Wi1metta Stevens. (2) Pay the sum of Eighteen Hundred Dollars ($1800.00) to Cloyd F. Bushey. (3) Pay 10% of the residue to Hilton Luther T the remnining 90% of the residue shall be divided equally between Cloyd F. Bushey, 11. David Bushey, t'li 1rnctta Stevens, and John F. Bush€'y. Should N. David Bushey not be living at the date of the death of Norman-P. (2) I bequeath the sum of Eighteen Hundred Dollars ($1800.00) to Cloyd F. Bushey. (3) I bequeath 10% of the remainder of my estate to Milton Luther; the remaining 90% of the residue shall be divided equally between Cloyd F. Bushey, N. David Bushey, Wilmetta Stevens, and John F. Bushey. Should N. David Bushey not be living at my death and leave no issue by his marriage with Sally Kaiser Fries, then and in that event his said share will be divided equally between James Leonard Fries and Jeffrey Scott Fries. ITEM VI. I nominate, constitute and appoint Albert Johnson Stevens III and John F. Bushey to be the Co-Executors of this my Last will and Testament. In the event that either one for any reason is unable or unwilling to serve,! then the other shall have full authority to act as the Executor.
