PETITION FOR REMOVAL
The petition of Suzanne E. Getz, l-lichael E. Zeigler and
Dorothy E. Zeigler, by their Attorney, Peter B. Foster, re-
spectfully represents:
1. That they are three of the five natural children of
Dorothy E. Zeigler.
2. That on January 20, 1981, Dorothy E. Zeigler was
adjudged an incompetent and Michele E. Wolford was appointed
Guardian of her estate, and the said Michele E. Wolford duly
entered upon the said appointment, and by virtue thereof re-
ceived over $40,000 in assets belonging to the estate of the
said incompetent.
3. That said Guardian should be removed because she
has mismanaged the estate as shown as follows:
a) The Guardian has removed many items of personal
property belonging to the said incompetent from her mother's
home and is using these items at her own home located at 712
Market Street, New Cumberland, Pennsylvania. These items
include a microwave oven, a cedar chest, waffle irons, lawn
furniture, a chair, and a couch.

b) The Guardian has removed many items of personal
property belonging to her mother from her mother's home and
is storing them without adequate security at her home lo-
cated at 712 Market Street, New Cumberland, Pennsylvania,
and in a garage belonging to a third party located on Derry
Street, Harrisburg, Pennsylvania. These items include sets
of dishes, sets of crystal, her mother's personal jewelry,
Elvis Presley memorabilia, hand tools, and various other
items. No inventory list of the personal property in the
incompetent's estate has ever been provided to the other
heirs.
c) For an extended period of time the Guardian has
failed to pay many of the bills owed by her mother's estate.
These bills include a bill from Aetna Insurance Company for
homeowner's insurance, a bill for aluminum siding for her
mother's home, a bill for medical services from Dr. Mills,
a fuel bill for the mother's home, Blue Cross and Blue Shield
bills, a Citibank Master Charge bill and a bill from Sears,
Roebuck and Company. Enclosed as Exhibits A and B are the
aforementioned bills from Citibank Master Charge and Sears,
Roebuck and Company, respectively.
d) The Guardian has failed to notify her mother's
creditors that a Guardian has been appointed and of the ad-
dress of the Guardian and has notified various creditors that her

mother's bills should be sent to her sisters. The Citibank
Master Charge bill is repeatedly sent to Suzanne Getz at her
new address at R.D. #3, Dillsburg, Pennsylvania, 17019.
Various physicians' bills are sent to Dorothy E. Zeigler at
her address at Box 483, Etters, Pennsylvania.
e) The Guardian has made no attempt to relocate the
incompetent in a residence outside the Camp Hill Nursing
Horne where she is now located in spite of the high cost of
maintaining the incompetent in said nursing home. l-ledical
insurance will provide maintenance for the incompetent for
a six month period ending on July 2, 1981, at which time her
maintenance charges will cost $1,350.00 per month. Dr. Cohen,
one of the incompetent's physicians, has indicated that the
incompetent may be established outside her nursing home if
an adult is available to care for her in an emergency.
Dorothy E. Zeigler has found a companion who is willing to
live with the incompetent at her home.
f) The Guardian has made no attempt to sell a 1970
Pontiac Bonneville belonging to her mother for $500.00 in
spite of the fact that a willing buyer offered to buy the
automobile for the stated price in January of 1981 and all
parties involved were agreeable to the sale.
g) The Guardian has signed a Sales Agreement for the
sale of the incompetent's house located at 624 Third Street,
New Cumberland, Pennsylvania, 17070. A sale of said home would

be unnecessary if the Guardian had properly managed the in-
competent's estate by obtaining social security benefits and
insurance proceeds which are due the incompetent. Also, said
sale would be unnecessary if the Guardian had planned to move
the incompetent out of the Camp Hill Nursing Home prior to
the expiration of the aforesaid six month period, thereby
avoiding the necessity for paying a $1,350.00 monthly main-
tenance fee. Furthermore, the incompetent's home would serve
as a residence for the incomoetent after her release from the

Camp Hill Nursing Home.
h) The Guardian has sold and intends to sell personal
property items belonging to her two sisters which were stored
at the incompetent's house at 624 Third Street, New Cumberland,
Pennsylvania, 17070.
4. The Guardian has falsely stated various matters
concerning her mother's estate to the petitioners which has
resulted in the petitioners losing trust and confidence in the
Guardian.
WHEREFORE, petitioners pray the Court to grant a Rule
upon the said Nichele E. Wolford, Guardian, with notice to
her surety, to show cause why she should not be removed as
Guardian of the estate of Dorothy E. Zeigler, and to make such
other order and decree as the Court may deem fit.

On reading the Motion for Preliminary Injunction in this
cause, filed by the attorney for petitioners,
It is ordered that the Guardian in the instant action,
Michele E. Wolford, show cause before this Court on June 't
1931, at '}:JOo'clocl<P .H. at Courtroom 113, Cumberland County
Courthouse, Carlisle, Pennsylvania, why a Preliminary Injunction
should not issue during the pendency of said action, according to
the prayer of such complaint; and
It is further ordered that petitioners cause a copy of this

AFFIDAVIT
Personally appeared before me, a Notary Public in and for
said Commonwealth and County, Suzanne E. Getz, who, being duly
sworn according to law/does depose and say that the sale of her
mother's house located at 624 Third Street, New Cumberland,
Pennsylvania, by the Guardian of her mother's estate would cause
irreparable harm to the estate for the following reasons. It is
not necessary to sell the incompetent's house to maintain the in-
competent given her income from social security benefits and medical
insurance and the large number of valuable personal property items
belonging to the incompetent which could be sold for her benefit.
Furthermore, the house should be retained as an inexpensive means
of housing the incompetent upon her release from the Camp Hill
Nursing Home. Such a release would be permitted by Dr. Howard
Ray Cohen, one of the incompetent's physicians if a companion for
the incompetent could be found. A companion has been found by
Dorothy E. Zeigler, daughter of the incompetent. Furthermore,
the incompetent is deeply attached to her home and does not want

the said house should serve as a residence for the incompetent
upon leaving the Camp Hill Nursing Home where she is now located.
Dr. Howard Ray Cohen, one of the incompetent's physicians, has
indicated that it would be possible for the incompetent to leave
said Home if a companion could be found and such a companion has
been located. Furthermore, the cost of maintaining the incompetent
would be lessened if she were returned to her home.
~ /. The Guardian has not received approval by the Court
for the sale of real estate owned by the incompetent as required
by 20 P.S. ~ 5155.
~;t. The estate of Dorothy Elizabeth Zeigler would suffer
irreparable harm if said sale were consumated as shown by the
Affidavit from Suzanne E. Getz attached as Exhibit A.
WHEREFORE, Petitioners move the Court to grant a preliminary
injunction restraining the Guardian froln selling the incompetent's
house until a hearing on the issue is held.

out such knowledge or information because the means of proof are within
the exclusive control of an adverse party.

~~ It is denied the Estate of Dorothy Elizabeth Zeigler would
suffer irreparable harm and after reasonable investigation the Guardian
is without knowledge or information sufficient to form a belief as to the
truth of the averment.
WHEREFORE, the Guardian moves this Honorable Court to deny a
Preliminary Injunction and permit the sale of the Incompetent's real es-
tate after a hearing held in this matter and to deny and further relief
as may be requested.
II. NEW MATTER
A. Request to Sell Real Estate
6. Guardian incorporates by reference herein the Petition by
Guardian of Estate of Incompetent for Leave to Make Private Sale of In-
competent's Real Estate and Waive Additional Security previously filed
with this Honorable Court, pursuant to Pa.R.C.P., Rule l019(g).
B. Postin~ of Bond by Petitioners
7. On or about June 4, 1981, the Petitioners filed a Petition

to enjoin the sale of the Incompetent's real estate and an Order, ex part
was entered enjoining said sale.
8. The sale of said real estate while previously agreed to by
the Petitioners, had not received the prior approval of this Honorable
Court.
9. By Agreement of Counsel, the hearing originally set for
June 9, 1981, was postponed until June 23, 1981.
10. If the sale of said real estate is not consummated on or
before June 29, 1981:
a. The buyers of said real estate will lose their mort-
gage commitment attached hereto as Exhibit 1, and mayor may
not receive another mortgage on such favorable terms, if at all
b. The realtors may sue for commissions.
c. The buyers may sue for specific performance or damages
d. Unpaid debts of the estate will accummulate interest
needlessly.
e. CCNB Bank, N.A., has indicated it will commence mort-
gage foreclosure proceedings against said real estate for unpai
mortgage obligations.
f. The estate will be without money for debts of admini-
stration and to meet the liabilities of the Incompetent.
g. The Incompetent will be forced to leave the nursing
home where she currently resides and be without any funds what-
soever for her care, support and maintenance or nursing assis-

FACTUAL ALLEGATIONS
7. On November 2, 1980, the Respondent suffered Organic
Brain syndrome, secondary to a full cardiac arrest.
8. On November 2, 1980 the Respondent was admitted to
Holy Spirit Hospital, a private facility, in Camp Hill and
remained there until her discharge on November 25, 1980, when
she was transferred to the Mechanicsburg Rehabilitation Center,
4950 Wilson Lane, Mechanicsburg, Cumberland County,
Pennsylvania 17055.

AFFIDAVIT OF TREATING PHYSICIAN
I, RAYMOND C. GRANDON, Doctor of Medicine, being duly
sworn, according to law, depose and say that I am the treating
physician for DOROTHY E. ZEIGLER, and have been since November
25, 1980, when the said DOROTHY E. ZEIGLER was transferred from
the Holy Spiri t Hospital in Camp Hill, to the Mechanicsburg
Rehabili tat ion Center in Mechanicsburg, Pennsylvania, that I
have personally physically examined DOROTHY E. ZEIGLER, and,
have on the basis thereof, concluded that DOROTHY E. ZEIGLER
presently suffers from Organic Brain Syndrome secondary to a
full cardiac arrest.
In addition to DOROTHY E. ZEIGLER's mental infirmities,
the said DOROTHY E. ZEIGLER is unable to walk or dress her
person without assistance.
All of these problems require
constant care and monitoring to attend to DOROTHY E. ZEIGLER's
needs. All of these problems lead your deponent to the medical
opinion that DOROTHY E. ZEIGLER is not physically capable of
caring for her own medical needs and lacks sufficient capacity
to make or communicate responsible decisions concerning her
person and estate.
While the said DOROTHY E. ZEIGLER does not
now require hospitalization in a sub-acute care facility such
as the Mechanicsburg Rehabilitation Center, the said DOROTHY E.

County, Pennsylvania, which is held in fee simple by deed dated February
23, 1976, and recorded at Deed Book 26, Volume L, Page 782, and more par-
ticularly described as follows:
ALL THAT PIECE OR PARCEL OF LAND situate in the Borough
of New Cumberland, Cumberland County, Pennsylvania,
being more particularly bounded and described as fol-
lows:
Tract No. 2
BEGINNING at a point, the northeast corner of Third
Street (66 feet wide) and Rosemont Avenue (50 feet
wide); thence northeastwardly along the southern line
of Third Street, a distance of twenty-five and forty-
five hundredths (25,45) feet to a point; thence south-
eastwardly at right angles to Third Street and through
the cente~ of a partition wall of a double-framed
dwelling house and beyond, a distance of one hundred
forty (140) feet to Tailer Avenue; thence southwest-
wardly along Tailer Avenue, a distance of twenty-five
and forty-five hundredths (25,45) feet to Rosemont
Avenue; thence northwestwardly along Rosemont Avenue,
a distance of one hundred forty (140) feet to Third
Street, the place of BEGINNING, as surveyed by D. p,
Raffensperger, Registered Surveyor, on June 29, 1955.
BEING Lot 1112 and a small part of Lot ffll, block "D"
in Buttorff's Addition to New Cumberland, recorded in
Record Book "N", Volume 5, Page 500.
HAVING THEREON erected a two-and-one-half story frame
dwelling known as 624 North Third Street, New Cumber-
land, Pennsylvania.
5. Your Petitioner, in order to properly administer the Estate
of the Incompetent, agreed to expose and list said real estate for sale
I with REMAX of Central Pennsylvania, pursuant to an Exclusive Sales Listin
Contract dated March 11, 1981, a copy of which is attached hereto as Ex-
hibit 2.

6, Your Petitioner, in order to properly administer the Estate
of the Incompetent, thereafter entered into an Agreement to sell the said
real estate to Joel E. Stoner and Sandra L. Stoner, his wife, dated March
30, 1981, for the sum of Thirty-five Thousand ($35,000.00) Dollars cash,
a copy of which is attached hereto as Exhibit 3.
7. Your Petitioner believes that Thirty-five Thousand Dollars
($35,000.00) is a fair price for the premises, and a better price than
could be attained at public sale, See Exhibits 4 and 5 attached hereto.
8. Your Petitioner entered into the above agreement after re-
viewing the financial needs of the Estate with the former husband and
children of the Incompetent, together with the attorney for said children.
9. Said private sale is in the best interests and advantage of
the Estate because of but not limited to the following factors:
a. The present cash assets prior to the filing of this
Petition were $67.97 as set forth in Exhibit 6, attached hereto,
and the actual and estimated liabilities of the estate are
$9,048.69 as set forth in Exhibit 7, attached hereto.
b. The projected liabilities of the Estate may be annual-
ized at approximately $7,931.75 without companion or nursing
services and $26,291.75 with such services, as set forth in Ex-
hibit 8, attached hereto, for which there is no income to meet
said liabilities.
c. The said real estate is in danger of remaining vacant
with a possibility of vandalism.

d, Said real estate is without maintenance and is in dan-
ger of declining in value,
e, GGNB Bank, N.A., has threatened to institute foreclo-
sure proceedings against the real estate for non-payment pur-
suant to a mortgage made by the Incompetent prior to her illnes
unless necessary payments are received by July 1, 1981, and for
which no cash exists in the estate to pay, said mortgage being
recorded at Mortgage Book 675, Page 581.
f. The estate is being threatened by other unpaid debts,
including taxes and debts of administration for which there is
no cash to pay said debts and from which the sale of personal
assets will not yield sufficient proceeds to satisfy, said per-
sonal assets estimated to be less than $4,000.00 as per the In-
ventory filed June 19, 1981,
g. The estate is without funds to pay for medical service
needed by the Incompetent, which services the Incompetent has
received under benefits programs expiring June 30, 1981.
10. The real estate is currently unoccupied as the Incompetent,
who lived alone is currently maintained in a nursing home, has an unknown
rental value, is currently assessed for tax purposes at $4,890,00, and is
subject to a mortgage held by GGNB Bank, N.A, in the amount of $5,899.68
as recorded in Mortgage Book 675, Page 581.
11. The purpose of this Petition is to obtain a decree stating
that the title to said real estate shall be indefeasible in the purchas-
ers and unprejudiced by any error in these proceedings.

DISCHARGE DIAGNOSIS: Pos t-hypoxic brain injury.
This 57-year-old femEl'?, previously treated only ror hypertension in the
past, recent congestion. Family history of elevated blood fats, lIer sister had a
heart attack, and an ancurysm in her cercbral circulation. Mother died at 70 of a
CVA and father died of alcohol. Sister has hyperthyroidism. Apparently she Cased
at home, Came to the ER in V-fib., full CPR. She improved, but marked CNS damage.
Appeared to be a post Case I encephalopathy, was comatose, small pupils, no response
to pain. Flacid times 4, Questionable seizure activity, Had a tachycardia with
clear lungs and no edema, The impression ';us a post-anoxic brain. She is a patient
of Dr. Harry Brooks. Her only problenl in the past has been hypertension with a poor
response to therapy.
She gradually improved with steroids and dehydration and was felt that she
was a candidate for Rehab hospital. The cardiopulmonary system stabilized. She was
able to eat and drink, began talking on occasion and was capable of maintaining her
own fluids, etc. She was put in ambulation and did relatively welL At the time
she left HSH, she ~lasambulating 100 feet times two with the assistance of two people,
one uncler each arm. She was seen by Dr. Leland Patterson ~lho agreed with the hypoxic
brain injury and expect further improvement and thought that she might eventually
evolve into all action myoclonus which could be treated successfully.
Brain scan shortly after admission waS negative. EEG showed diffuse, slow
dysrhythmia consistent with diffuse organic disease. There was some pneumonia on the
portable chest with marked improvement. Abnormal perfusion lung scan was shO~lll with
a mvd€.rat~ pr.j~ubilit:y -:,E pulmonary embulism, and she Has Hevarillized for a time. The
chest x-ray still showed some residual pneumonia, but this was definitely clearing.
Her EKG showed left ventricular hypertrophy, and the final chest x-ray showed a small
persistent right pleural effusion, clearing of the atelectasis or infiltrate behind the
left heart compared to 11/17. Still a littlc sub-segmental diseasc. EKG's did not go
through a pattern for acute myocardial infarction. Electrolytcs remained relatively
stable. Sodium got a little bit low on occasion. Enzymes were ~arkedly elevated, but
this possibly was related to the hypoxic injury as opposed to cardiac damage. Serology was
nonreactive. Cultures were non-revealing. i.C__W.-'lL1i....g!ll-'-~~iJ:,h,JL600 HBC's and a nor-
mal differential.
