NO.
WHEREAS, KOLLAS AND COSTOPOULOS, of 1104 Fernwood Avenue,
Camp Hill, Cumberland County, Pennsylvania, hereinafter referred to as Owner, is about to
execute contemporaneously herewith, a contract, with Glenn Snider, Jr., and Glen Miller,
t/d/b/a SNIDER-MILLER BUILDERS, for the erection of houses ancillary to development in a
complex known as Kingsbrook, Phase VII, Cumberland County, Pennsylvania, construction
described as follows:
ALL THOSE CERTAIN tracts or parcels of ground on Lot Nos. 25 and 26 of
North Middleton Township, Cumberland County, Pennsylvania, more particularly bounded and
described as set forth in Exhibit "A" attached hereto and made a part hereof.
NOW, this 21 st day of February , 2003, at the time of and immediately before
the execution of the principal contract dated February_ 21 , 2003, and before any authority has
been given by the said Owner, to the said Contractor to commence work on the said building, or
purchase materials for the same in consideration of the marking of the said contract with Owner,
and the further consideration of One Dollar and 00/100 ($1.00), to Contractor paid by Owner, it
is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor,
nor by any of the material men or workmen or any other person for any labor, or materials
purchased, or extra labor or materials purchased for the erection of said building, the right to file
such liens being expressly waived.

All that certain lot or tract of land located in North Middleton Township,
Cumberland County, Pennsylvania, bounded and described as follows, to wit:
Beginning at a point on the northern right-of-way line of Ridge Avenue, said
point being located the following three (3) courses from the line of land now or late of
Marie E. Doyle 1) South fifty-nine degrees, forty-five minutes, ten seconds West (S 59°
45' 10" W), a distance of one hundred nine and sixty-six hundredth feet (109.66') 2) by a
curve to the left, having a radius of three hundred twenty-five feet (R=325.00'), an arc
distance of thirty and seventy-seven hundredth feet (A/L=30.77') 3); South fifty-four
degrees, nineteen minutes, forty-two seconds West (S 54° 19' 42" W), a distance of one
hundred fifty-nine and fifty-seven hundredth feet (159.57') thence from said point of
Beginning, by said northern right-of-way line of Ridge Avenue South fifty-four degrees,
nineteen minutes, forty-two seconds West (S 54° 19' 42" W), a distance of seventy feet
(70.00') to a point; thence by Lot No. 24 North thirty-five degrees, forty minutes,
eighteen seconds West (N 35° 40' 18" W), a distance of three hundred thirty-seven and
eighty-nine hundredth feet (337.89') to a point; thence by Lots of Wertz Run Heights
North thirty-eight degrees, thirty-three minutes, eight seconds East (N 38° 33' 08" E), a
distance of seventy-two and seventy-four hundredth feet (72.74') to a point; thence by
Lot No. 26 South thirty-five degrees, forty minutes, eighteen seconds East (S 35° 40' 18"
E), a distance of three hundred fifty-seven and sixty-seven hundredth feet (357.67') to a
point on the northern right-of-way line of Ridge Avenue, the place of Beginning Said
tract contains 24,344.58 square feet or 0.5589 acres.
