LAST WILL
I, CLARENCE II. BILLOW, of North lUddleton 'l'ownship, Cumber-
land County, Pennsylvania, declare this to be my Last Will and
revoke any wills previously made by me.
I. I devise and bequeath all of the residue of my estate
to my wife, Ruth M. Billow, if she survives me by sixty (60)
days.
II. In the event my wife, Ruth M. !1111ow, does not survive
me, I bequeath the sum of $500.00 to each of my great grand-
children living at the time of my death.
III. I bequeath $3300.00 to my daughter and son-in-law
Beatrice E. Fickes and R. Dale Fickes, provided however that this
provision of my will shall be inoperative in the event a similar
bequest in my wife's will shall be paid.
IV. I devise and bequeath to my daughter, lJiriam E. Woolums
and my son-in-law, Jephtha B. Woolums, their heirs and assigns,
that certain real estate in North J.liddleton Township, Cumberland
County, Pennsylvania, bounded on the west by Carlisle Springs
Roadj on the north by Pennsylvania Turnpike CommissIon; on the
east by Bryn Mawr Road and on the south by land of R. Dale Fickes
and Beatrice E. Fickes.
V. I devise and bequeath all of the resIdue of my estate
of whatever nature or wherever situated to my two children,
Beatrice E. Fickes and Miriam E. Woolums in equal shares.
VI. I appoint my wife, Ruth M. Billow to be the executrix
of my estate. In the event she fails to qualify or ceases to
act, then I appoint R. Dale Fickes and the Commonwealth National
Bank to be executors. I direct that my executor shall not be
required to furnish bond in this or any other jurisdiction.
III WITNESS WHEREOF, I have hereunto set ny hand and seal
this 4- ct: day of May, 1978.

Irwin, Jr., attorney for petitioners, it is ordered and decreed
that a citation be issued, directed to R. Dale Fickes and the
Commonwealth National Bank, executors of Clarence H. Billow,
deceased, to show cause why an order should not be issued in the
nature of a writ of injunction, restraining the said executors from
the sale of the residual real estate to the Cumberland County
Industrial Development Authority, or to anyone else, said writ to
be temporary until hearing is held to determine the propriety of
the sale.

The proposed sale, $70,000 for 25 acres, more or less, Is In
complete disregard to the true value of saId real estate and Is
antagonistIc to the petItioners rIghts and interests in said property,
both as remaInderman and as profitable user thereof'.

The land Involved was specifIcally gIven to Beatrlee E. Fickes
and MIriam E. Woolums, as resIdual devisees, and therefore, the
executors lack the power to sell said land under the Probate, Estates
and FIduciarIes Code.
8.
MIrIam E. Woolums, petitioner-beneficIary, was not advised of
the sale nor was she gIven an opportunity to accept or reject the
offer whIch vitally af'fects her rights and interests.
9.
The sale of thIs resIdual estate would deny petitioners of the
only practIcal means of access to the land devised to them in paragraph
4 of' decedent's Will, and would therefore run counter to the rights of
ingress, egress and reeress which were reserved for petitioners In an
earlIer deed between Clarence II. Billow and Ruth M. BIllow, grantors,
and R. Dale FIckes and Beatriee E. FIckes, grantees, a copy of said
deed is attached her'e1;o made a part t.J1ereof, and marl{ed as peU.t.ioners

I am a licensed Real Estate Broker, licensed by the Commonwealth
of Pennsylvanio, and have been actively engaged in the real estate
business for the past twenty-eight years in the Cumberland County area.
I am thoroughly familiar with real estate values in this area,
On July 8, 1981, I inspected the properties of Clarence H, Billow
in North Middleton Township, Cumberland County, Pa., to determine my
opinion of their value as of May 5, 1981, the date of his death,

PARCEL NO.1: Is 0 triangular shaped lot fronting approximately 125 ft,
on the East side of Spring Road and extends approximately 300 ft, deep,
and is 450 ft. wide at the rear. It is bounded on the North by the Pa.
Turnpike; on the East by Parcel No.2; on the South by property of Fickes;
and on the West by Spring Road. It is improved with a 1~ story frame
bungalow with asphalt shingle roof.
The first floor containo a living room, dining room, kitchen with
plywood cabinets; two bedrooms, each with closet, and a bathroom without
modern fixtures. The second floor is divided into two rooms that provide
ample storage space, and at one time was a small efficiency apartment.
The interior walls are plastered and papered and the floors, other than
the bathroom and kitchen ore yellow pine. The bathroom and kitchen have
tile floors. The basement under the dwelling has block and stone foun-
dation with cement floor, hand fired coal hot air furnace, electric
water heater and 60 Bmp electrical oervice. There are aluminum storm
windows on the North and West side of the dwelling, The roof shingles
are apnroximately three years old.

tho Oakland Monor Tract. The Turnpike comes within several Feet of the
Northweat corner of the Front porch und the traFFic noise depreciates
the vulue of thc property. The property ia zoned R-2 Residential and
the operation of the seaFood atore ia a non-Fonforming use.
In my opinion, the fair market value of thin property as of May 5,
1981, was $41,500.00.
PARCEL NO.2: A tract of land located bet\veen the property of the
Carlisle Fairground and the Pennsylvania Turnpike, containiJl'g approxi-
mately 20 Acres, bordered on tha North by the Turnpike; on the East by
property of the 104th Armered Cavalry; on the South by the Carlisle
Fairground and on the West by proposed Uryn Mawr Road. This land is
gently rolling and aceess to same would be over proposed Bryn Mawr Road
and public water is available at this location.
'AFter considering its location, the proposed sale price of the
Carliale Fairground at $7000.00 pOl' ucre with improvements, including
water and sewer, it is my opinion that this unimproved tract of land
with water only, would have a Fuir market value of approximately
$70,000.00, or $3500.00 per acre.

INFORMATION
This document is the Notice required to be given under Section 709 of the Inheritance and Estate Tax Act
of 1961 172 P.S. section 24851.
If the tax is paid within three (3) months after the decedent's death. a discount of 5% of the tax paid is allowed.
Inheritance Tax becomes delinquent nine (9) months after the decedent's death. Interest is charged at the
r"te of six (6) percent per annum on the amount of unpaid tax. (SEE EXAMPLE BELOW)

BEING Parcel "B" as shown on a Final Subdivision Plan for the
Clarence H. Billow Estate, by Stephen G. Fisher, which plan
is recorded in the Office of the Recorder of Deeds in Plan
Book No. 42, Page 97.
TOGETHER with all right, title and interest of Clarence H.
Billow in and to the portions of Bryn Mawr Road and "M"
Street included within the above described tract of land as
shown on said subdivision plan.
TOGETHER with, and subject to, the right of ingress, egress
and regress together with Beatrice E. Fickes, her heirs and
assigns, over the driveway from Carlisle Springs Road through
Lots ,51 and 52 on Plan of Oakland Manor recorded in the
Office of the Recorder of Deeds in Plan Book 3, Page 18, and
through the western portion of Lots 69, 70A, 70, 71. 72 and
73, to the land herein conveyed, as the same presently
exists.
The tract of land above conveyed being composed of the

Bryn Mawr Road; thence by said center line South 05 degrees
10 minutes 30 seconds West 500.00 feet to an iron pin; thence
North 84 degrees 49 minutes 30 seconds West 30.00 feet;
thence by the western line of Bryn Mawr Road and land now or
formerly of E. R. Morrison and land of Beatrice E. Fickes
North 05 degrees 10 minutes 30 seconds East 475 feet to a
point; thence by land of Beatrice E. Fickes North 84 degrees
49 minutes 30 seconds West 285.00 feet to a point at or near
the eastern right of way line of Carlisle Springs Road;
