LAST WILL AND TESTAMENT
OF
ROBERT B. CORBIN
I, ROBERT B. CORBIN, of the Borough of Carlisle, Cumberland County,
Pennsylvania, declare this to be my Last Will and revoke any Will previously
made by me.
ITEM I: I direct that all my j.1st debts and funeral exponses including
my grave marker shall be paid from the assets of my estate as 900n as
practicable after my decease.
ITEM II: I devise and bequeath the residue of my estate, of every nature
and wherever situate, to my wife, Ruth L. Corbin, providing she shall survive
me by sixty (60) days.
ITEM III: Should my wife, Ruth L. Corbin, predecease me or die on or
before the sixtieth day following my death, I devise and bequeath the residue
of my estate, of every nature and wherever situate, to my issue living on the
sixty-first day following my death, per stirpes.
ITEM IV: I direct that all taxes that may be assessed in consequence of
my death, of whatever nature and by whatever jurisdiction imposed, shall be
paid from my residuary estate as a part of the expense of the administration
of my estate.
ITEM V: Should my wife, Ruth L. Corbin, predecease me, I appoint my
brother, William Corbin, guardian of the person of my children.
ITEM VI: I appoint my brothe r, William Corbin, of Brock port, New
York, guardian of any property which passes to a minor and with respect to
which I am authorized to appoint a guardian and have not otherwise specificall
done so. Said guardian shall have the power to use principal as well as incom
from time to time for the minor's education, support and welfare without re-
gard to his or her parent's ability to provide for such education, support and
welfare, or to make payment for these purposes without further responsibility
to the minor or to the minor's parent, or to any person taking care of the
minor.
ITEM VII: I appoint my wife, Ruth L. Corbin, Executrix of this my Last
Will. Should my wife, Ruth L. Corbin, fail to qualify or cease to act as
Executrix, then I appoint my brother, William Corbin, Brock port, New York,
Executor of this my Last Will.
ITEM VIII: I direct that my personal representative or guardian shall not
be required to give bond for faithful performance of his duties in any jurisdic-
tion.

A It is my signature.
Q This was sent by certified mail to your address where your
daughter lives, is that correct?
A That's correct.
Q And you received the certified letter?
A Yes.
Q Ilhat did you do with it?
A I gave it to Linda.

Q Is there any reason why she couldn't be present if she

^ I am sure that he could, yes.

citation, did you not?
^ Yes, I did.
o Did you give that petition and citation to your husband?
^ Yes, I did.
o IIhere did you give it to him?
^ Carlisle Hospital.
Q When did you give it to him?
A It was a week ago Tuesday evening.
MR. IRWIN: I offer into evidence, Your Honor, the two
return receipts.

Q \~hen you said October, you meant 1980?
A 1900, yes.
Q And January you mean 1981?
A Yes, I do.
Q What is the last episode with your husband's condition?
A On May 20th he had a cardiac arrest. And he was brought
to the Carlisle Hospital from Mt. Holly. And he was in a coma for
three weeks. I\nd since then he has come out of the coma, but, again,
we don't know what the prognosis really will be.
I\t this point he is not able to take care of any financial
affairs. He is very forgetful. lIe doesn't really remember anything
that has happened for the last two or three years. It even goes as
long as five years.
Q Where was he hospitalized for this last illness?
1\ Carlisle Hospital.
Q What was the date of the onset of the last illness?
1\ May 20, 1981.
Q What was that exactly?
A That was a cardiac arrest. His heart had stopped.
Q Had he had previous cardiac arrests?
A Yes, he had.
Q How many?
A One, January 4th.
Q Who was his treating physician May 20th and right up until

the present time?
A Dr. Joseph Brazel.
Q Has Dr. Brazel been his treating physician for some time
previous to May 20, 1981?
A Since October, 1980.
Q Did you request a report from Dr. Brazel?
A Yes, I did.
Q Is that a correct copy of the record received from Dr. Brazel,
dated June the 16th, 1981?
A Yes, it is.
MR. IRWIN: Your Honor, I would offer into the evidence
Dr. Brazel's report, which is attached to my petition. And I offer
that under Section 5518 of the Probate, Estates and Fiduciaries Code,
which indicates that in any hearing related to the mental condition
of a person whose competency is in question, the sworn statement by
a physician at any hospital or institution shall be admissible in
evidence as to the condition of an inmate at such hospital in lieu
of his appearance and testimony, unless by special order of the Court
directs his appearance and testimony in person.
BY I~R. IRWIN:
Q What estate does your husband own in his own name alone?
A He owns the automobiles, which are two.
Q What year automobiles are they?

A 1971 and 1973.
Q \1hat are they?
A One is a Ford Ranchero, and the other is a Ford Maverick.
Q Is the Ranchero the 1971?
A Yes, it is.
Q And the Maverick is the 1973?
A Yes, it is.
Q What property do you and your husband own jointly?
A We own our home, 264 Gibson Street, 6466 Walnut Street.
Q What kind of property is the last one you mentioned?
A That was a home that we were renovating, but which is
not completed as yet. And we also own an apartment building, a
seven-unit building at 420 North Baltimore in Mt. Holly Springs.
\'ie own an apartment building at 517 North Hanover Street.
That's three units. And another building at 525 North Hanover
Street, which is also three units.
Q Are you employed?
A Yes, I am.
Q In what capacity?
A As a teacher at Big Springs School District, Newville.
Q Are there any funds available to finance your husband's
hospitalization and his present situation at the Forest Park Nursing
Home?

^ The funds available for the hospitalization I do have Blue
Cross and Blue Shield benefits, but at the nursing home there are
no funds.
Q Where do you expect the money is going to come from to pay
for that nursing home stay?
A I am going to have to sell the property.
Q You are going to have to sell some of the real estate?
A Right.
Q Have you talked to Farmers Trust Company about acting as
guardian for the estate of your husband?
A Yes, I have.
Q Has the Farmers Trust Company indicated their willingness
to act as his guardian?
A Yes, they have.
Q I show you a statement that's attached to your petition,
marked Consent of the proposed Guardian. Is that the statement that
is signed by Dennis Caverly, Trust Officer of the bank?
A Yes, it is.
MR. IRWIN: Your Honor, at this time I would offer into
the evidence the consent of the Proposed Guardian, which the original
is attached to the petition.
BY MR. IRWIN:
Q Is it your understanding that some of these properties would

be sold, Mrs. corbin, and at least half the money would be put into
a fund held by the Farmers Trust company and to be applied to the
necessary expenses that your husband incurs at Forest Park and
wherever else?
A Yes.
Q As I understand it, there are no other funds available
in his own name to pay any bills?
A That's correct.
Q In fact, after May 20, 1981, did you find any unpaid
bills in his effects?
A Yes, I did.
from March and April.
some of those bills.
I found bills that had not even been opened
And I had to borrow $5,000.00 to help pay
Q Did you borrow that in effect in your own name?
A Yes, I did.
Q At the time that this all came about, were you and your
husband estranged?
A Yes, we were.
Q Did that estrangement come after his series of heart attacks
when he had a personality change?
A Yes, it did. It was on February the 16th when he left the
house.
Q Does the Farmers Trust Company have any interest that you

know of that is adverse to your husband?
A Not that I know of.
Q 11here did he do his banking?
A \1e have our personal checking account at Farmers Trust
Company, and the account for the apartments at Commonwealth National
Bank.
Q Where did you have your mortgages?
A They are all at Cumberland Valley Savings and Loan.
Q But your personal checking, that is his checking and your
checking, was at the Farmers Trust Company?
A Yes, it was.
Q Has any other Court ever assumed any jurisdiction in any
kind of a proceeding to determine the competency of Robert Corbin?
A No.
Q Have any guardians anywhere ever been appointed before
for him?
A No.
Q Is it correct that you believe that the current fair
market value of all the jointly-owned property is approximately
$411,000.OO?
A Yes.
Q With an indebtedness of I guess now of about $lOO,OOO.OO?
A Yes.

Q What business was Mr. Corbin in prior to these series of
hospitalizations?
A He was just working on the apartment buildings.
Q He had no business other than managing the properties?
A No, he didn't.
Q Did he do most of the business work for the apartments,
such as collecting the rents, deposits and all that type of thing?
A Yes, he did.
Q Who is doing that now?
A I am.
Q Do some of the checks come through payable to both of you
or how do they work?
A No. They usually come just to one person or the other. The
checks are now coming in my name.
Q When did Mr. Corbin go to Forest Park?
A He went there on Monday of this week. It would have been
July the 6th.
Q Does he recognize you when you go there?
A Yes, he does.
Q Are you able to talk with him intelligently about these
properties and anything about them?
A Yes. And he does ask questions, but, for instance, he will

want to know who is in the apartments and how much they are paying.
And then about five minutes later he will ask the same thing. He
does not remember what you have said.
Q When you gave him a copy of this citation and the petition,
did he ask you what that was for?
A Yes. We read it. And I had a friend of mine who went
along with me. And we read it to him and tried to explain to him,
and that we felt that this was the best. And he thought at that
time that it was agreeable. Now, he has not mentioned it since.
I doubt whether he remembers, but we did talk to him about it.
Q When you gave this citation to him, he never indicated
to you that he wanted to be here at this hearing, did he?
A No, he didn't.
Q And he has not communicated any indication that he would
like to be here since you have given him the citation?
A No, he hasn't.
Q What are the costs at the Forest Park Nursing Home per
month or per day?
A It is $44.00 per day. That is exclusive of doctor bills,
therapy.
Q Is there any type of insurance covering anything at all
at Forest Park?
A No, there isn't.

A I'll get the exact date out, October 16th, 1980, was
the first day that I sa'~ M,r. Corbin in consultation from Dr.
Holland.
Q And have you been treating him continuously since that
date?
A Yes, sir.
Q /I,nd would vou tell us what his physicial condition has
been and what his problems are?
1\ M,r. corbin has very serious heart disease "li th severe
congestive heart failure, and he has required in the past year
coronary artery bypass surgery, and -- I'll spell it for you --
ventricular, v_e_n-t-r-i-c-u-l-a-r, aneurysm, a_n_e_u_r_y_s_m,
resection for extensive heart disease.
In addition, he has chronic obstructive lung disease.
f'.nd on 11ay 20th, 1981, he sustained severe brain damage from a
prolonged cardiac arrest in 110unt HolllJ, pennsylvania, from whic
he has not fully recovered.
Q What is his present condition?
A From a cardiac point of view, at the present time he
is stable in that he is having no chest pain, shortness of breat
edema or difficulty in breathing. He is, however, extremely
weak, tires easily and he has extensive mental impairment since

the cardiac arrest on May 20th, 1981.
2 He is unable at this time to perf.orm any complicated
3 reasoning or detailed analysis of his financial status or his
4 medical problems.
5 Q Can you state, Doctor, in your opinion whether or not
6 he's mentally or physicallv able to care for himself or to make
7 decisions affectinq his health or financial ""atters?
8 A At the present time and since May 20th, 1981, he is not
9 able to care for himself either physically or mentally. He
m requires basically constant nursing care and total care of
11 delivery of his medications.
~ In addition, he cannot at the present time make any
13 decisi ons regardin'J either his physical or mental or financial
14 problems.
15 Q And what's his prognosis at this time?
16 A I think one can say now three months after the event
17 that he probably with a reasonable assurance will not recover to
18 the state ',vhere he is able to tal<,e care of his own lTIental, his
ill own physical and other, mental, physical and financial matters.
W Q Do you believe at this time that it's wise and importa t
21 for the Court to name a guardian to take care of his financial
2i matters?
~ A I do. And in discussing it with the patient today, he
U agrees, also, that he is not able to handle these problems.
~ ~ 'rhat's all the questions I have.
