THIS AGREEMENT made the 25th day of February, 2003, by and between RIDGEVIEW
CUSTOM HOMES, LLC., a Pennsylvania limited liability company, hereinafter referred to as
Contractor, and HERBERT G. WEAVER, hereinafter referred to as Owner, whereby the former
undertook and agreed to erect and construct a custom built home on that certain lot of ground situate
at Lot No. 126, Indian Hills-Section 2, South Middleton Township, Cumberland County,
Pennsylvania, more fully described in Exhibit "A" attached hereto and made a part hereof.
NOW THEREFORE, WlTNESSETH: That the said Contractor, for and in consideration of
the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves
and their subcontractors, and all parties acting through or under them, covenant and agree that no
mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby expressly waive and relinquish
the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any
of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant.

executed the foregoing statement for the purposes therein contained by signing the name of the
limited liability company by himself as the sole member.

ALL that certain tract of land situate in South Middleton Township, Cumberland County,
Pennsylvania, and more particularly identified as LOT NO. 126 on the Final Subdivision Plan of
INDIAN HILLS - SECTION II, recorded in the Office of the Recorder of Deeds in and for
Cumberland County, Pennsylvania, in Plan Book 77, Page 72, et seq., the metes and bounds
description for which lot is as follows:
BEGINNING at a point on Silver Maple Drive (50 feet right-of-way) at the dividing line between
Lot No. 127 and Lot No.126 on the above-mentioned plan of lots; thence along said Silver Maple
Drive North 20 degrees 11 minutes 44 seconds East a distance of 41.10 feet to a concrete monument;
thence by a curve to the left having a radius of 225.00 feet and an arc length of 48.90 feet to a point;
thence South 82 degrees 15 minutes 24 seconds East a distance of 146.81 feet to a point; thence
South 03 degrees 18 minutes 16 seconds East a distance of 29.95 feet to a point; thence South 20
degrees 11 minutes 44 seconds West a distance of 93.81 feet to a point on the dividing line between
Lot No. 126 and Lot No. 127 on the above-mentioned plan of lots; thence along the dividing line
between Lot Nos. 126 and 127 North 69 degrees 48 minutes 16 seconds West a distance of 150.00
feet to a point on Silver Maple Drive (50 feet right-of-way) the dividing line between Lot No. 127
and Lot No. 126 on the above-mentioned plan of lots, the point and place of BEGINNING.
CONTAINING 16,010.04 square feet.
