LAST WILL AND TESTAMENT
I, ELIZABETH B, RUPP MYERS, Widow, of the Borough of Mechanicsburg,
County of Cumberland and State of Pennsylvania, being of sound mind,
memory and understanding, do make, publish and declare this to be my
last Will and Testament, hereby revoking and making void all former wills,
codicils and other testamentary dispositions by me at any time heretofore
made.
1.
I direct my Executrix, hereinafter named, to pay as soon as prac-
ticable after my decease all my just debts and the expenses of my last
illness and burial,
2,
I give, devise and bequeath all of my estate - real, personal and
mixed _ unto my niece, Pauline Rupp Warner, absolutely.
3.
Should the said Pauline Rupp Warner predecease me, then and in that
event I give, devise and bequeath all of my said estate unto the issue
of Pauline Rupp Warner, per stirpes.
4.
I hereby nominate, constitute and appoint my said niece, Pauline
Rupp ~larner, to be the executrix under this my last Will. Should the
said Pauline Rupp Warner predecease me, then and in her stead, I nomi-
nate, constitute and appoint The Commonwealth National Bank to be the
executor of this my last Will,
IN WITNESS WHEREOF, I, ELIZABETH B. RUPP MYERS, the Testatrix,
have hereunto set my hand and seal to this my last Will and Testament

The said Elizabeth B. Rupp Myers died on September 3, 1981, a
widow, without children, leaving a Last Will and TestaI:lent dated
July 29, 1976, wherein and whereby she left her entire estate unto
her niece, Pauline Rupp Warner, the Executrix named in said Will.
The said Pauline Rupp Warner survived the said Elizabeth B,
Rupp Myers and elects to take the above listed stocks and real estate

DECREE AWARDING REAL ESTATE
AND NOW, this /cJ1.f:ay of {'Ie TC/-:'.L'.l..-" ,1983, at
0' clock P, ~t., E. 0, T., it appearing that The First and Final
Account and Proposed Schedule of Distribution of Pauline Rupp Warner,
Executrix under the Last \Hll and Testament of Elizabeth B, Rupp
Myers, late of the Borough of Mechanicsburg, County of Cumberland
and State of Pennsylvania, have been duly filed and advertised in
accordance with law and Rulesof Court, and The First and Final Account
and Proposed Schedule of Distribution have been confirmed by the
Court of Common Pleas - Orphans' Court Division, Cumberland County,
Pennsylvania, on October 11, 1983, and it further appearing that the
said Pauline Rupp Warner is the sole residuary legatee, devisee and
distributee under the Last Will and Testament of Elizabeth B. Rupp
Myers, deceased, and it further appearing that the said Executrix
has in her Proposed Schedule of Distribution claimed credit for the
distribution of said real estate in kind to the said Pauline Rupp
Warner.
NOW, THEREFORE, it is ordered, adjudged and decreed that,
ALL that certain lot of ground situate in the Borough
of Mechanicsburg, County of Cumberland and State of Pennsyl-
vania on the Northwest corner of Walnut and Simpson Streets,
having erected thereon a t\~o-story double brick dwelling,
frame stable, and other outbuildings, bounded and described
as follows, to wit:

BEGINNING at a post on the South side of St, John's
Alley; thence by lot formerly of Heirs of David Neisley,
South 22 degrees East 159 feet to a post; thence South
24-3/4 degrees East 61 feet to ~Bid Simpson Street; thence
Eastward by said street, North 75-1/2 degrees East about
367 feet to Walnut Street; thence Northward by said Walnut
Street, North 23-1/2 degrees West about 233 feet to said
St, John's Alley; thence up same South 73 degrees West
about 360 feet to the place of Beginning,
Containing about two (2) acres.
BEING the same premises which Hary Barnhart by her
Deed dated April 9, 1869 and recorded in the Recorder's
Office in and for said Cumberland County in Deed Book "D",
Vol, 3, Page 277, granted and conveyed unto George Rupp,
The said George Rupp, a/k/a George M, Rupp, died
April 8, 1890, leaving a Last Hill wherein and \Ihereby
he devised a life interest in said premises unto his wife,
Elizabeth Rupp, with remainder unto his sons, Henry B.
Rupp and Albert B, Rupp, subject as therein set forth,
The said Elizabeth Rup?, a/k/a Elizabeth Barnhart
Rupp, life tenant, died August 3, 1892,
BEING one of the three tracts which Frank E. Hollar,
Clerk of the Orphans' Court, by his Deed dated March 13,
1894 and recorded in the Recorder's Office aforesaid in
Deed Book "D", Vol. 5, Page 451, granted and conveyed
unto Albert B, Rupp pursuant to Order of Court dated
December 12, 1893, and entered in Orphans' Court Docket
No. 32, Page 444, in and for said Cumberland County,
The said Albert B. Rupp, widower, died January 18,
1935, leaving a Last Will and Testament dated November 23,
1934, wherein and whereby, amongst other things, he devised
said premises unto his daughter, Elizabeth B, Rupp, who
thereafter married S. Harper Hyers, now deceased.
Is hereby awarded to Pauline Rupp lIarner, her heirs and assigns,
forever.
The Recorder of Deeds is directed to record this Decree among
the Deeds in his official custody and to index the same in the
