STIPULATION AGAINST LIENS
WHEREAS, Joseph J. Katkocin is about to execute contemporaneously
herewith a contract with KATKO, INC. a Pennsylvania corporation, for the erection of a
dwelling upon a lot of land situate as follows:
ALL THAT CERTAIN lot or parcel of land situate in South Middleton Township,
Cumberland County, Pennsylvania, more particularly bound and described to wit:
BEGINNING at a point on the western right-of-way line of Stonehedge Drive, a
sixty foot wide right of way, said point in the center of a 40 foot wide drainage swale
also being the southwest corner of Lot 33; thence along the western right-of-way line of
Stonehedge Drive, along a curve to the right having a radius of 270.00 feet and an arc
length of 140 feet, said arc being subtended by a chord of South 57 degrees 54 minutes
30 seconds West, a distance of 138.44 feet to a point at the corner of Lot No. 31 of the
Stonehedge PRD Stage 3A; thence along Lot No. 31, North 17 degrees 14 minutes 15
seconds West, a distance of 165.15 feet to a point at lands of Stonehedge Developers
Inc.; thence along said lands of Stonehedge Developers, Inc, North 75 degrees 14
minutes 00 seconds East, a distance of 67.16 feet to a point in the center of a drainage
swale at the corner of Lot No. 33; thence along Lot No. 33 and the center of the
aforesaid drainage swale, South 44 degrees 59 minutes 38 seconds East, a distance of
143.25 feet to a point, the point of BEGINNING.
CONTAINING 0.37 acres, more or less. Being identified as Lot Number 32 of
Stonehedge PRD Stage 3A, as recorded in Plan Book 69, Page 13, in the Cumberland
County Recorder of Deeds Office, Carlisle, Pennsylvania.
NOW, the x-/~ day of March, 2003, at the time of and immediately before the
execution of the principal contract, and before any authority has been given by the said
Joseph J. Katkocin to the said KATKO, INC., a Pennsylvania Corporation to commence
work on the said building, or purchase materials for the same in consideration of the
making of the said contract with KATKO, INC., a Pennsylvania Corporation and the
further consideration of One Dollar, to KATKO, INC., a Pennsylvania Corporation, paid
by Joseph J. Katkocin, it is agreed that no lien shall be filed against the building by the
contractor, or any sub-contractor, nor by any of the material men or workmen or any
other person for any labor, or materials purchased, or extra labor or materials
purchased for the erection of said building, the right to file such liens being expressly
waived.
