THIS AGREEMENT made the ){Jrltay of February, 2007, by and between,
G & C AASSOCIATES, Builder, of 9974 Molly Pitcher Highway, Shippensburg, Pennsylvania,
hereinafter referred to as Contractor,
AND
MICHAEL J. CASSIDY and JUliE A. CASSIDY, t/d/b/a G & C ASSOCIA TES, of Shipp ens burg,
Pennsylvania, hereinafter referred to as Owner,
WHEREAS, the said Contractor undertook and agreed to make certain improvements to
Owner's property situate in Cumberland County, Pennsylvania, known as Lot 45 Hollar Avenue,
Shippensburg, Borough of Shipp ens burg, Cumberland County, Pennsylvania, more fully described
in Exhibit "A" attached hereto and made a part hereof.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for
and in consideration of the sum of One Dollar ($1.00) to said Contractor in hand paid by Owner, the
receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement
aforesaid, for himself, and his subcontractors, and all parties acting through or under them, covenant
and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them
against the said buildings and improvements and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and construction of the said improvements on the lot
above described, and the said Contractor, for himself, his subcontractors and others under him
hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or
claims against the said buildings or any of them, and agree that this instrument, waiving the right of
lien, shall be an independent covenant.

ALL that certain lot or parcel of ground situate in the Borough of Shippensburg,
Cumberland County, Pennsylvania, bounded and described as follows:
BEGINNING at a point at the edge of Hollar Avenue: thence by Hollar Avenue, South
48 degrees 04 minutes 54 seconds East 106.25 feet to a point in common comer with Lot 44;
thence by Lot 44, South 41 degrees 55 minutes 06 seconds West 121 feet to a point at lands now
or formerly of Catherine Shay; thence by lands now or formerly of Catherine Shay, North 48
degrees 04 minutes 54 seconds West 106.25 feet to point at lands now or formerly of Elizabeth
H. Maurer; thence by lands now or formerly of Elizabeth H. Maurer, North 41 55 minutes 06
seconds East 121 feet to the point and place of BEGINNING.
BEING part of the same real estate which The West End Land Company of
Shippensburg, by deed dated October 15, 1992, and recorded October 16, 1992, granted and
conveyed to H. Scott Garling and Michael J. Cassidy. The said H. Scott Garling died on July 29,
1994. Letters of Administration were issued to Barbara L. Garling on August 8, 1994, by the
Cumberland County Register of Wills. By specific provision ofthe Partnership Agreement
between H. Scott Garling and Michael J. Cassidy, the personal representative of a deceased
partner, may succeed to the interest of the deceased partner and continue to conduct partnership
business. Barbara L. Garling previously elected to succeed to the interest of the deceased
partner, but has since withdrawn from the partnership. Julie A. Cassidy has become a partner.
