WITNESSETHTHAT: August 10, 2001 The Contractor by Instrument dated S ing 1 e f ami 1 y dwe 11 ing entered into an Agreement with the Owner for the erection and construction of a , situated on Lot 36, Hickory Ridge, Phase I, East Pennsboro Township, Cumberland County, as more fully described on Exhibit "A" attached hereto AND WHEREAS, the Contractor has covenanted and agreed therein to enter into an additional agreement with the Owner stipulating that no lien or liens of any kind shall be filed against the above building or the appurtenances thereto. NOW, THIS AGREEMENT WITNESSETH, that the Contractor, for and in consideration of the awarding to him of the said contract as for the sum of ONE DOLLAR ($1.00) to him in hand paid by the Owner, the receipt of which is hereby acknowledged, promises and agrees that no Mechanic's Lien or liens shall be filed against the aforesaid building or the appurtenances thereto by any subcontractor, subcontractors, materialmen, mechanics, laborers or anyone for materials furnished, work done or services rendered of any kind whatsoever, for or about, or on account of the aforesaid building or on the credit thereof. WITNESS: WITNESS: CO,NTRACTOR: ~ B/..~ (SEAL) (SEAL) (SEAL) Barbara Evans Coble EXHIBIT '~A" ALL THAT CERTAIN piece or parcel of land situate in the Township of East Pennsboro, Cumberland County, Commonwealth of Pennsylvania being more fully described as follows: BEGINNING at a point on the dedicated right of way line of Sullivan Street at the dividing line of Lot No. 35 and Lot No. 36, Hickory Ridge, Phase I, recorded in Plan book 77, Page 143; thence by said dividing line, South 88 degrees 33 minutes 06 seconds West a distance of 100.00 feet to a point at the dividing line of Lot No. 38 and lands herein described; thence by said dividing line North 01 degrees 26 minutes 54 seconds West a distance of 132.17 feet to a point on the dedicated right of way line of Sullivan Street; thence by said right of way line, the following two courses and distances: 1) by a curve to the right having a radius of 125.00 feet and an arc distance of 171.18 feet to a point; 2) South 01 degrees 26 minutes 54 seconds East a distance of 9.70 feet to a point, the place of BEGINNING. BEING Lot No. 36, containing 10,137.67 square feet as shown on Final Subdivision Plan of Hickory Ridge, Phase I, recorded in Plan Book 77, Page 143, and being subject to all easements of record. BEING THE SAME PREMISES which Michael Manning and Associates, by deed dated , 2001, and intended to be recorded simultaneously herewith in the Office of the Recorder of Deeds of Cumberland County, granted and conveyed unto Rhy Patrick Coble and Barbara Evans Coble, Mortgagors herein.
