GELDART, Defendants :IN THE COURT OF COMMON PLEAS :CUMBERLAND COUNTY, PENNSYLVANIA :MLD - - 2007 130Ce MUNICIPAL LIEN FOR SEWER SERVICES North Middleton Authority, North Middleton Township, County of Cumberland, Commonwealth of Pennsylvania by its solicitor, Martson Deardorff Williams Otto Gilroy & Faller, hereby files its claim for sewer services against the real estate hereinafter described and sets forth its claim as follows: STATEMENT OF CLAIM 1 The name of the municipality by which this claim is filed is North Middleton Authority, a municipal authority of the Commonwealth of Pennsylvania, located in the County of Cumberland and organized pursuant to ordinances of North Middleton Township. 2 The name or names of owner or owners or reputed owner or owners, of the property against which this claim is filed are Nathan E. Geldart and Teri L. Geldart of 1138 Newville Road, Carlisle, Pennsylvania. 3 A description of the property against which this lien is filed is attached hereto and marked as Exhibit "A" with an address of 1138 Newville Road, Carlisle, Pennsylvania. 4 The authorities under and by virtue of which this lien is filed is the Municipal Claims and Liens Act of May 16,1923, P.L. 207, as amended and supplemented, 53 P.S. 7101 et seq. r 1 5 The lien is claimed for unpaid sewer user fees against the above-described property in the amount of $4,700.00. 6 Interest is claimed on the above-mentioned amount from September 20, 2006. EVANS and SANDRA L. EVANS, husband and wife, of Cumberland County, Pennsylvania, hereinafter called Grantors, AND NATHAN E. GELDART and TERI L. GELDART, husband and wife, of Cumberland County, Pennsylvania, hereinafter called Grantees: WITNESSETH, that in consideration of the sum of One and no/100 ($1.00) Dollar, the receipt whereof is hereby acknowledged, the said Grantors do hereby grant and convey unto the said Grantees, their heirs and assigns as tenants by the entireties ALL that certain tract of land situate in North Middleton Township, Cumberland County, Pennsylvania, more particularly bounded and described follows, to wit: BEGINNING at a point in the middle of the concrete road between Carlisle and Newville; thence in a Southerly direction 207% feet along other lands now or formerly of Ralph F. Finkenbinder et ux, known as Lot No. 4, to an iron pin in the Northern line of a sixteen (16) feet alley; thence at right angles along said alley, West 50 feet to an iron pin; thence at right angles along property now or formerly of Clair Myers, North 207% feet to a point in the middle of the aforesaid concrete road; thence along the middle of said road; East 50 feet to a Point and Place of BEGINNING BEING known as 1138 Newville Road, Carlisle, PA 17013. BEING the same premises which JP Morgan Chase Bank, granted and conveyed to Donald G. Evans and Sandra L. Evans, his wife, by deed dated December 16, 2003 and recorded in the Office of the Recorder of Deeds for Cumberland County in Deed Book 260, Page 433.
