North Middleton Authority, North Middleton Township, County of Cumberland,
Commonwealth of Pennsylvania by its solicitor, Martson Deardorff Williams Otto Gilroy &
Faller, hereby files its claim for sewer services against the real estate hereinafter described
and sets forth its claim as follows:
STATEMENT OF CLAIM
1
The name of the municipality by which this claim is filed is North Middleton Authority, a
municipal authority of the Commonwealth of Pennsylvania, located in the County of
Cumberland and organized pursuant to ordinances of North Middleton Township.

The name or names of owner or owners or reputed owner or owners, of the property against
which this claim is filed are Rick A. Hoover and Lynn E. Hoover of 1190 Newville Road,
Carlisle, Pennsylvania.

A description of the property against which this lien is filed is attached hereto and marked as
Exhibit "A" with an address of 1190 Newville Road, Carlisle, Pennsylvania.

The authorities under and by virtue of which this lien is filed is the Municipal Claims and
Liens Act of May 16, 1923, P.L. 207, as amended and supplemented, 53 P.S. 7101 et seq.

The lien is claimed for unpaid sewer user fees against the above-described property in the
amount of $4,700.00.

Interest is claimed on the above-mentioned amount from September 21, 2006.

BETWEEN Rick A. Hoover, of 1190 Newville Road, Carlisle,
Cumberland County, pennsylvania, and Lynn E. Hoover, of 112
Barrister Trail, Perry, Georgia, as joint tenants with right of
survivorship, herein designated as the Grantors;
AND
Rick A. Hoover, of 1190 Newville Road, Carlisle, Cumberland
County, pennsylvania, and Lynn E. Hoover, of 112 Barrister
Trail, Perry, Georgia, as tenants in common, each with a
one-half undivided interest, herein designated as the Grantees;
WITNESS, that the Grantors, for and in consideration of One
Dollars and no/l00 ($1.00) lawful money of the united states of
America, to the Grantors in hand well and truly paid by the
Grantees at or before the sealing and delivery of these
presents, the receipt whereof is hereby acknowledged and the
Grantors being therewith fully satisfied, do by these presents
grant, bargain, sell and convey unto the Grantees their heirs
and assigns, forever,
ALL THAT CERTAIN tract of land situate in North Middleton
TownShip, Cumberland County, Pennsylvania, bounded and described
as follows:

BEGINNING at a point in the Southern side of the public road
leading from Carlisle to Newville (Penna. State Highway Route
No. 641) which point is also in the Western line of an alley 16
feet in width: thence in a Southwardly direction along the West
side of said 16 foot alley, a distance of One Hundred and Eighty
Two (182) feet to a point in the Northern side of an alley 16
feet in width: thence in a Westwardly direction along the
Northern side of said last mentioned alley, a distance of
seventy (70) feet toa point in line of lands nO~1 or formerly of
Thomas A. Shearer and M. Viola Shearer, his wife: thence in a
Northwardly direction along'said other land of the said Thomas
and M. Voila Shearer, a distance of One Hundred and Eighty Two
(182) feet, to a point in the Southern side of said public
road: thence along the Southern side of said pUblic road in an
Eastwardly direction, a distance of Seventy (70) feet to a
point, the Place of BEGINNING.
BEING all of Lot No. 31 and the Eastern Fifteen (15) feet
of Lot No. 32 on that certain plan of lots laid out and adopted
by Thomas A. Shearer and M. Viola Shearer, his wife, and known
as Westminister Manor, said plan being recorded in the Office of
the Recorder of Deeds in and for Cumberland County,
Pennsylvania, in Plan Book No.3, Page 67.

SUBJECT HOWEVER, to the said Plan of Lots and Building
Restrictions set forth in the Deed of William and Fannie Fetter,
said deed dated June 4, 1943, and Recorded in the Office of the
said Recorder of Deed in Book "0", Vol. H, Page 354. The lot
herein conveyed is a part of Tract No. 2 described in said deed.
BEING the same premises which Rick A. Hoover, Executor of
the Estate of Lynn Elwood Hoover by Deed dated september ,1994
and recorded in the Office of the Recorder in and for cumberland
County in Deed Book" ", Volume ,Page , granted and
conveyed unto Rick A. Hoover and Lynn E. Hoover.
Together with all the buildings, improvements, ways, woods,
waters, watercourses, rights, liberties, privileges,
hereditaments and appurtenances to the same belonging or in
anywise appertaining; and the reversion and reversions,
remainder and remainders, rents, issues and profits thereof, and
of every part and parcel thereof: AND ALSO all the estate,
right, title, interest, use possession, property, claim and
demand whatsoever of the GRANTOR both in law and in equity, of,
in and to the premises herein described and every part and
parcel thereof with the appurtenances. To have and to hold
all and singular the premises herein described together with the
hereditaments and appurtenances unto the Grantees and to
Grantees' proper use and benefit forever.

AND the GRANTOR, covenant that, except as may be herein set
forth, they do and will specially warrant and defend the lands
and premises, hereditatments and appurtenances hereby conveyed,
against the Grantors and all other persons lawfully claiming the
same or to claim the same.
In all references herein to any parties, persons, entities or
corporation, the use of any particular gender or the plural or
singular number is intended to include the appropriate gender or
number as the text of the within instrument may require.
Whenever in this inFtrument any party shall be designated or
referred to by name or general reference, such designation is
intended to and shall have the same effect as if the words
"heirs, executors, administrators, personal or legal
representatives, successors and assigns" had been inserted after
each and every such designation.
THIS TRANSFER IS FROM BROTHERS TO BROTHERS AND THEREFORE IS
EXEMPT FROM REALTY TRANSFER TAX.
