HomeMy WebLinkAbout07-1318 . .. v :IN THE COURT OF COMMON PLEAS :CUMBERLAND COUNTY, PENNSYLVANIA :MLD - - 2007 - / 3 I J" NORTH MIDDLETON AUTHORITY Plaintiff STEVEN GRAY, Defendant MUNICIPAL LIEN FOR SEWER SERVICES North Middleton Authority, North Middleton Township, County of Cumberland, Commonwealth of Pennsylvania by its solicitor, Martson Deardorff Williams Otto Gilroy & Faller, hereby files its claim for sewer services against the real estate hereinafter described and sets forth its claim as follows: ., STATEMENT OF CLAIM 1 The name of the municipality by which this claim is filed is North Middleton Authority, a municipal authority of the Commonwealth of Pennsylvania, located in the County of Cumberland and organized pursuant to ordinances of North Middleton Township. 2 The name or names of owner or owners or reputed owner or owners, of the property against which this claim is filed is Steven Gray OF 13 Texaco Road, Mechanicsburg, Pennsylvania 17055. 3 A description of the property against which this lien is filed is attached hereto and marked as Exhibit tlAtl with an address of 825 Newville Road, Carlisle, Pennsylvania. 4 The authorities under and by virtue of which this lien is filed is the Municipal Claims and Liens Act of May 16, 1923, P.L. 207, as amended and supplemented, 53 P.S. 7101 et seq. 5 The lien is claimed for unpaid sewer user fees against the above-described property in the amount of $4,700.00. 6 Interest is claimed on the above-mentioned amount from September 22, 2006. U M B [ f\ Lt. :4 1) C 0 U NT Y - P A Tax Parcel # '01 SEP 6 Prl 3 lf7 THIS DEED MADE this Stjbday of ,2001 BETWEEN JEANNETTE MORRISON, a married woman, of Carlisle, Cumberland County, Pennsylvania, "GRANTOR" , STEVEN GRAY, a married mant of Mechanicsburg, Cumberland County, Pennsylvania, "GRANTEE" , WITNESSETH, that in consideration of the sum of One Hundred Thirty Thousand and 00/00 ($130,000.00) Dollars, in hand paid, the receipt whereof is hereby acknowledged, the said GRANTOR does hereby grant and convey in fee simple to said GRANTEE, his heirs, assigns and successors; ALL those certain two tracts of ground, together with the improvements erected thereon, lying and being situate in North Middleton Township, Cumberland County, Pennsylvania, bounded and described as follows; TRACT NO.1: Being located on the North side of the public road leading from Carlisle to Newville, known as Route 641, bounded on the East by property now or formerly of Robert Otto; bounded on the West by property now or formerly of Kenneth E. Miller; having a frontage of 80 feet on the North side of the Newville Road and extending in depth 245 feet, more or less, to a proposed 21 foot alley; and also being Lot Nos. 24 and 25, as shown on the Plan of Eckels Park as recorded in the Office of the Recorded of Deeds in and for Cumberland County in Plan Book 2, Page 58. TRACT NO.2: Bounded on the South by the Carlisle-Newville Highway, known as Route No. 641; bounded on the East by properties now or formerly of Edward S. Kronenberg and Jack E. Nace; bounded on the North by a public alley; and on the West by property now or formerly of Margaretta L. Morrison and Jeannette Morrison, by deed dated April 27, 1999 and recorded August 13, 1999 in the Office of the Recorder of Deeds in and for Cumberland County in Deed Book 205 Page 922, granted and conveyed unto Jeannette Morrison, grantor herein. The deed herein is to convey the property under a certain Installment Agreement of Sale between the Grantors and Grantee as recorded in Cumberland County Miscellaneous Book 469 page 903. The interest of Scott Perry under a prior Installment Agreement recorded in Cumberland County Miscellaneous Book 350 page 792 was extinguished by virtue of a Quit Claim Deed recorded in Deed Book "I" Volume 36 Page 282. AND the said GRANTOR hereby warrants specially the property herein conveyed. Leon C. Morrison is included herein to convey any interest he may have acquired in the subject property by virtue of marriage to Jeannette Morrison.
