Plaintiff, Mid South Building Supply, Inc., is a Pennsylvania corporation maintaining an office and place of business located at 3451 Simpson Ferry Road, Cumberland County, Pennsylvania. 2. Defendant, R.C. Skelly, Inc. is a Pennsylvania corporation: with an office and/or place of business located at 29 Pine Tree Drive, Mechanicsburg; Cumberland County, Pennsylvania 17055. i 3. Defendant, Robert C. Skelly is an adult individual who maintains an office and/or place of business located at 29 Pine Tree Drive, Mechanicsburg; Cumberland County, Pennsylvania, 17055. 4. At the special instance and request of the Defendants, Plaintiff sold and tendered to Defendants various building materials and related goods and merchandise for which there is presently due and owing to Plaintiff the sum of $10,493.27, plus interest at the rate of 1 %2% per month. 5. Plaintiff has rendered to Defendants Statements of Account showing a balance due to Plaintiff by Defendant in the amount of $10,493.27, to which the Defendants have not objected and an account has therefore been stated between Plaintiff and Defendants as set forth in Exhibit "A", which is attached hereto and incorporated herein, in the amount certain of $10,493.27. 6. Defendant, Robert C. Skelly executed a Credit Application wherein he agreed to pay reasonable attorney's fees, and therefore Defendants are obligated to Plaintiff in the amount of $2,098.65 ($10,493.27 x .20). A copy of the Credit Application is attached hereto as Exhibit "B". 7. A copy of the Personal Guarantee as executed by the Defendant, Robert C. Skelly is attached hereto and incorporated as Exhibit "C". Pursuant to the terms of the Personal Guarantee the Defendant guaranteed any indebtedness due and owing by R.C. Skelly, Inc. to the Plaintiff. 8. Although duly demanded the said outstanding balance in the amount of $10,493.27 has not been paid by Defendants to Plaintiff or to anyone acting on behalf of Plaintiff and is therefore due and payable with interest at the rate of 1 %s% per month and the costs of suit.
