THIS AGREEMENT made the of
2003, by and between Denise Thompson, trading and doing business
as Home Designs Unlimited,
Nellapalli B. Venkatesh and Priya Doraiswamy, hereinafter referred
to as Owner, whereby the former undertook and agreed to erect and
construct a single family dwelling Lot 97, Aspen Lane, Enola,
Hampden Township, Cumberland County, Pennsylvania on that certain
lot of ground situate in
Lot 97, Aspen Lane, Enola, Hampden Township, Cumberland County,
Pennsylvania
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for and in consideration of the sum of ($1.00) Dollar
to Denise Thompson, trading and doing business as Home Designs
Unlimited in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for themselves and their subcontractors, and
all parties acting through or under them, covenant and agree that
no mechanic's liens or claims shall be filed or maintained by
them or any of them against the said buildings and the lot of
ground appurtenant thereto for or on account of any work done or
materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and
construction of the said buildings on the lot above described,
and the said Contractor, for themselves, their subcontractors and
others under them hereby expressly waive and relinquish the right
to have, file, and maintain any mechanic's liens or claims
against the said buildings or any of them, and agree that this
instrument, waiving the right of lien, shall be an independent
covenant.

ALL THAT CERTAIN piece, parcel or lot of land situate in
Hampden Township, Cumberland County, Pennsylvania, and bounded
and described as follows:
BEGINNING at a point on the Southern right-of-way line of
Aspen Lane (50.00 feet wide), said point being located at the
Northeastern corner of Lot No. 96; then along said right-of-way
line of said Aspen Lane (50.00 feet wide), North 88 degrees 30
minutes 15 seconds East, for a distance of 90.00 feet to a point
at the Northwestern corner of Lot No. 98; then along the Western
boundary line of Lot No. 98, South 01 degree 29 minutes 45
seconds East, and through an exisiting 30.00 foot wide drainage
easement, for a distance of 120.00 feet, to a point in line of
Exisiting Phase III; then along said exisiting Phase III, and
along the centerline of said 30.00 foot wide drainage easement,
South 88 degrees 30 minutes 15 seconds West, for a distance of
90.00 feet, to a point at the Southeastern corner of Lot No. 96
then along the Eastern boundary line of Lot No. 96, and through;
said existing 30.00 foot wide drainage easement, North 01 degree
29 minutes 45 seconds West, for a distance of 120 00 feet, to a
point and the place of BEGINNING. '
THIS piece, parcel or lot of land consists of approximately
10,800 square feet of land, and is known and numbered as Lot No.
97 on the Final Subdivision Plan for Westbury - Phase 6-A, which
is recorded in Cumberland County in Plan Book 83, Page 122.
UNDER AND SUBJECT TO any and all restrictions, reservations,
conditions, easements, agreements covenants and rights-of-way of
record. ,
BEING THE SAME PREMISES which The McNaughton Company,
deed to be recorded simultaneously herewith in the Office by their
of the
Recorder of Deeds of Cumberland County, granted and conveyed unto
Nellapalli B. Venkatesh and Priya Doraiswamy.
