SECTION 701 ET SEQ AND NOW, comes Brandon Michael Rummel, by and through O'Brien, Baric and Scherer, Attorneys at Law and makes the following Petition: 1. Petitioner is Jamie L. Shumberger, the natural mother and guardian of Brandon Michael Rummel. She is an adult individual residing at PO Box 505, New Kingston, Cumberland County, Pennsylvania. 2. Brandon Michael Rummel was born December 15, 1997 in Carlisle, Pennsylvania. 3. At the time of birth, the child was given the name Brandon Michael Rummel. A copy of the birth certificate evidencing this fact is attached hereto and incorporated herein as "Exhibit A." 4. The natural father of Brandon is Keith M. Rummel. Mr. Rummel resides C/O Perry County Prison, P.O. Box 520, New Bloomfield, PA 17068. The father has not had any contact with Brandon since February, 2000 and has repeatedly indicated that he ha~ no interest in his child as per the attached communications. 5. Petitioner has resided continuously in Cumberland County since Brandon's birth and she has Court Ordered sole legal and primary physical custody of the child. 6. There are no judgments or decrees of record against Petitioner or Brandon. 7. Petitioner now desires to have Brandon Michael Rummel's name changed to Brandon Michael Shumberger, so that his surname is the same as that of his natural mother. WHEREFORE, Petitioner requests your Honorable Court to enter an Order granting the Petitioner's request to change his name from Brandon Michael Rumel to Brandon Michael Shumberger. Rummel DRS No. 99-00021 PACSES No. 687100075 Dear Mr. Rummel: The Domestic Relations Section has received your letters dated January 23, 2003, and the letter to Judge Rehkamp dated January 27, 2003. I will attempt to answer the questions you raised that pertain to your support matter. Once you are released from the Perry County Prison, the DRS office will be more than happy to consider your request to transfer your case to Cumberland County. If you are in jail because you have not paid your support, the Domestic Relations Section does not waive or forgive the support obligation. You are in jail because you did not pay your support as ordered by the Court. If you are imprisoned for a matter not related to your support case, you may petition for jail forgiveness. Such petitions are reviewed by me and decisions are made on a case-by-case basis. Obviously, your own actions led to your incarceration, but your child still has the same needs for food, clothing and shelter whether you're in jail or not. Why should your child be penalized for your irresponsible actions? The SEC program referral is given to individuals who are already receiving benefits from the Pennsylvania Department of Public Welfare. No one associated with this case is receiving DPW assistance; therefore, that referral has not been given to you. The CareerLink program which is utilized by the SEC program is open to anyone. I have enclosed a CareerLink brochure for your information. Mr. Keith R. Rummel January 31, 2003 Page 2 o I disagree that putting you in jail defeats the purpose of the enforcement officer. What we're hoping will happen is that you'll realize that we are serious about the collection of child support and that we're willing to put you in jail to make it clear to you. You were given many opportunities to do the right thing - i.e., pay your support - prior to being put you in jail. A review of this file clearly indicates to me that you have been in Court on numerous occasions for enforcement purposes. However, you still are not taking this matter seriously. You fathered this child and you are morally, financially and legally obligated to support him. The work release program, provided work is available to you, is a concept that we approve of because, as you say, it does get some support money for the child. It certainly won't make much ora dent in the $4,800+/- that you currently owe in arrears, but I feel certain that any funds received for your son's benefit will be welcomed by his mother. The issues you raised concerning terminating your parental rights and visitation are not within the purview of the Domestic Relations Section. You should consult with your attorney on those matters.
