COMPLAINT IN REPLEVIN AND CONTRACT
AND NOW, comes the Plaintiff by and through its attorneys Apple and Apple,
P.C" and files this Complaint in Replevin and Contrad and avers the following in support
thereof:
1. The Plaintiff is a Corporation having its principal business at P. O. Box 22033,
Greensboro, NC 27420.
2. Defendants are individuals residing at Fargreen Road, Camp IIill, Cumberland
County, Pennsylvania 17011, and who are hereinafter referred to collectively as "Dcfc111lant."
COUNT ONE
REPLEVIN
3. On or about February 23, 1988, Defendant executed a Pennsylvania Consumer
Credit Inst,allment Note, which was also a Security Agreement, a true and corred copy of
said Contract is attached hereto, marked Exhibit "A" and made a part hereof.
4. By the terms of said Agreement the Defendant purchased a 1988 Bayline Boat
and a 1988 Trailer with a Serial Number of Boat 1052272, Trailer 1PHDC2U2J1000l46. The
Defendant took possession of said boat and trailer.
5. Defendant, pursuant to said Contrad, agreed to make a total of payments of
$146.00 per month, beginning on April 8, 1988.
6. The total amount to be paid to the Plaintiff pursuant to this Agreement was
to be $19,500.00.
7. Plaintiff, by reason of the terms of said Contract, holds a security interest in
the boat and trailer, and is entitled to the immediate possession of the said mobile home, all
appliances, furniture, equipment, and accessions attached to the mobile home at any time
later, and in any proceeds of the vehicle, including insurance proceeds.
8. Thc Plaintiff mcd a UCC statcmcnt form with thc Statc of Pcnnsylvania with
thc first licn in favor of the Plaintiff herein. A copy of said statcmcnt is attachcd hcrcto,
markcd Exhibit "B" and madc a part hcrcof.
9. Thc Dcfcndant is rcquircd to pay all costs of taking posscssion, rcpairing and
sloring thc vboat and trailcr, costs of suit, if thc Defcndant was in dcfault morc than fiftccn
(15) days whcn posscssion was takcn.
10. Thc Dcfcndant has bccn in default more than fiftccn (15) days whcn posscssion
was takcn.
11. Thc Dcfcndant is in default undcr the terms of said Contract, bccausc hc has
failed to make the rcquircd monthly payments.
12. The Dcfendant is in dcfault on said payments since Septmber 8,1997.
13. Monthly payments in arrear amount to $2,131.74 as of the date of this
Complaint.
14. Thc property has a value of $10,640.00.
15. Plaintiff avers that by reason of the Defendant's default on payment of said
rental paymcnts, thc right of possession of the said property is in the Plaintiff.
WHEREFORE, Plaintiff prays for Judgment against the Defendant in Count
One:
1. For recovery of possession of the personal property described abovc, or
for damages of $10,640.00, the value of said property, if Plaintiff can not
obtain recovery of same; and
2. for costs of this action; and
3. for such other and further relief as the court deems just and propcr.

COMPLAINT IN REPLEVIN AND CONTRACT
AND NOW, comes the Plaintiff by and through its attorneys Apple and Apple,
P.C., and files this Complaint in Replevin and Contract and avers the following in support
thereof:
1. The Plaintiff is a Corporation having its principal business at P.O. Box 22033,
Greensboro, NC 27420.
2. Defendants are individuals residing at Fargreen Road, Camp Hill, Cumberland
County, Pennsylvania 17011, and who are hereinafter referred to collectively as "Defendant."
COUNT ONE
REPLEVIN
3. On or about February 23, 1988, Defendant executed a Pennsylvania Consumer
Credit Installment Note, which was also a Security Agreement, a true and correct copy of
said Contract is attached hereto, marked Exhibit "An and made a part hereof.
4. By the terms of said Agreement the Defendant purchased a 1988 Bayline Boat
and a 1988 Trailer with a Serial Number of Boat 1052272, Trailer 1PHDC2U2J1000146. The
Defendant took possession of said boat and trailer.
5. Defendant, pursuant, to said Contract, agreed to make a total of payments of
$146.00 per month, beginning on April 8, 1988.
6. The total amount to be paid to the Plaintiff pursuant to this Agreement was
to be $19,500.00.
7. Plaintiff, by reason of the terms of said Contract, holds a security interest in
the boat and trailer, and is entitled to the immediate possession of the said mobile home, all
appliances, furniture, equipment, and accessions attached to the mobile home at any time
later, and in any proceeds of the vehicle, including insurance proceeds.

8. The Plaintiff filed a UCC statement form with the State of Pennsylvania with
the first lien in favor of the Plaintiff herein. ^ copy of said statement is attached hereto,
marked Exhibit "D" and made a part hereof.
9. The Defendant is required to pay all costs of taking possession, repairing and
storing the vboat and trailer, costs of suit, if the Defendant was in defaull more than fifteen
(15) days when possession was taken.
10. The Defendant has been in defaull more than fifteen (15) days when possession
was taken.
11. The Defendant is in default under the terms of said Contract, because he has
failed to make the required monthly payments.
12. The Defendant is in default on said payments since Septmber 8, 1997.
13. Monthly payments in arrear amount to $2,131.74 as of the date of this
Complaint.
14. The property has a value of $10,640.00.
15. Plaintiff avers that by reason of the Defendant's default on payment of said
rental payments, the right of possession of the said property is in the Plaintiff.
WHEREFORE, Plaintiff prays for Judgment against the Defendant in Count'
One:
1. For recovery of possession of the personal property described above, or
for damages of $10,640.00, the value of said property, if Plaintiff can not
obtain recovery of same; and
2. for costs of this action; and
3. for such other and further relief as the court deems just and proper.
