The parties are Ihc parcnts ofTylcr Michael Buchcnaucr, born February 2, 1996; the ehild
was born out ofwcdloek.

The parties were residing together Ihrough February 27, 1998, when the Petitioner moved
out of the home where the parties were residing with their minor child, and the Petitioner's minor
child from a previous relationship (Christopher Allan SeW; born June 13, 1986).

The Respondent filed a Petition for Custody, from whieh a Custody Conference was
scheduled for May 26, 1998. However, prior to the occurrence of the Custody Conference,
Respondent continually refused Petitioner from having regular access to the minor child.

On or about April 23, 1998, Petitioner filed a Petition for Special Relief as to the Custody
matters pending between the parties. On the same day, this Honorable Court issued an Order
compelling the parties to share custody of the minor child on a 50/50 basis until the occurrence
of the Custody Conference on May 26, 1998.

Upon attending the Custody Conference on May 26, 1998, the parties entered into an
agreement whereby custody of their minor child would be shared on a 50/50 basis between the
parties. This agreement was issued as a recommended order, and entered as a final Order by this
Honorable Court on June 8, 1998.

Sincc Fcbruary, 1998, the Respondent has allempted to cause and has intentionally,
knowingly, or recklessly placcd the Petitioner in reasonable Icar of imminent serious bodily
injury, and has knowingly engaged in a course of conduct and rcpeatedly committed acts toward
the Petitioner under circumstances which have placed the Petitioner in reasonable rear of serious
bodily injury. Such acts and conduct include, but arc not limited to, the following instances:
a. On or about July S'h, 1998, as the Petitioner was effectuating an exchange
of custody at the Respondent's residence pursuant to the current custody order,
Respondent began to question Petitioner regarding a potential reconciliation between the
parties. When the Petitioner expressed that she did not want to reconcile Respondent
became agitated and angry, arguing with the Petitioner. When the Petitioner continued to
assert that she did not wish to reconcile, Respondent grabbed the Petitioner by the throat
and pushed her into her vehicle, continuing to argue with her. Respondent again pushed
the Petitioner, causing her to fall backwards and land on the gravel driveway in a sitting
position, placing the Petitioner in fear of serious bodily injury to both herself and her
minor son.
b. On or about February 26, 1998, the parties were arguing, and the Respondent
grabbed the Petitioner's ann, hurting the Petitioner and placing her in fear of serious
bodily injury to both herself and her minor son.
c. Approximately three weeks prior to the incident described in sub-paragraph (b)
above, the parties were arguing in the driveway at their home while they were preparing
to leave the residence; the Respondent became so angry that he picked up the minor child
and carried him back into the home. When the Petitioner re-entered the home, the
Respondent pushed the Petitioner in a very threatening way; the minor child began to cry,
