COMPLAINT
1. The plaintiff, Wanda S. Gibbons, is an adult individual residing at 2500
Walnut Bottom Road, Carlisle, Cumberland County, Pennsylvania 17007.
2. The defendant, Eagle Punding Group, Inc., also known as Eagle
Funding Group SC, Inc., is a foreign business corporation with a principal
place of business at 1530 Main St., Newberry, South Carolina 29018, with a
registered service address in Pennsylvania of c/o CT Corp., 1635 Market St.,
Phila, Pa. 19103.
3. On or about August 20, 1997, Wanda Sue Gibbons was employed by
Eagle Funding Group SC, Inc., hereafter "Eagle Funding Group." As a term of
her employment, she was promised health insurance.
4. On or about August 20, 1997, Wanda Sue Gibbons was given a letter of
Termination/ separation of employment from Eagle Funding Group, Inc.,
effective August 31, 1997, for the reason that the company was downsizing. See
Exhibit A.
5. At the time of her separation from employment with Eagle Funding
Group, Inc., she was to continue to receive her health insurance benefits from
Great-West Life & Annuity, P.O. Box 1000, Horsham, PA 19044-1000 on a
Cobra Plan, for which Wanda Sue Gibbons paid the sum of $128.75 per month
to the defendant for a period of five months, beginning August 26, 1997.
Copies of those premium checks are attached hereto as Exhibit B. Premium
notices for October and November, 1997, from Eagle Funding Group to the
defendant are attached as Exhibit C.
6. During the period of her alleged coverage, Wanda Sue Gibbons incurred
the following medical expenses:
