A pretrial conference was held Monday, July 2,
2001, before the Honorable Edward E. Guido, Judge.
Present for
the Plaintiff was his son/ Hurd P. Anstadt, pursuant to
power-of-attorney, and present for the Defendant was Raymond A.
Swan, Esquire.
This is a property damage claim that is less
than $25,000.00, and, therefore, would require submission to
arbitration. However, insofar as this case has dragged on for
more than three years with procedural wrangling, we were
reluctant to send it to arbitration. The parties have agreed
that the matter should be sent to arbitration and that the
arbitration will be binding.
Therefore, by agreement of the parties, this
matter is submitted to binding arbitration. The Court
administrator is directed to request that a panel of arbitrators
be appointed forthwith.

Atehason and his wife, Mari Atchason, and the thcn owncrs, .lay and Ruby
Anstadt.
A written proposal was sent by Jerry Shaffer of Capital to Mr. Atchason
the following day. On April 28, 1997, Mr. Atehason phoned Capital and
rcqucsted that the tree removal be perlormcd. Capital removed the trccs that same
day and invoiced Mr. Atchason on May 8, 1997.
Allcr receiving no paymcnt, Capital contacted Mr. Atchason on June 15,
1997 and was told that the sale of the property had not yet been completed but
that everything would work out. A second invoice was sent on September 26,
1997. In the meantime, .lay Anstadt demanded payment from Mr. Atehason for
the removal of the trees by letter dated, September 12, 1997.
B. Procedural History
This matter was instituted by Plaintiff at the District Magistrate level
where an award was entered in favor of Plaintiff and subsequently appealed by
Defendant. After the filing of several Complaints and several set of Preliminary
Objections, Defendant, Capital, answercd Plaintiffs latest Amended Complaint on
June 8, 200 I. At that time, Defendant, Capital also joined as Additional
Defendants, .lack and Mari Atchason.
II. DAMAGES CLAIMED
Plaintiff has alleged total damages in the amount of $16,1 00.00 for the removal of
the three hemlock trees and damage to the lawn.
It should be noted that the Agreement of Sale between .lay and Ruby Anstadt and
the Atchasons dated March 27, 1997 was for a total amount of$225,000.00. The
property eventually was sold by .lay and Ruby Anstadt to Philip .I. Murren and Richard E.
Connell for $232,750.00 on December 4, 1997, despite the fact that the trees had been
removed,
To date, Plnintifl: Hurd Anstadt, has tililed to provide counsel for Defendant,
Capital, with a copy of this Power of Attorney despite sevcral rcquests for same. It is
Defendant's position, therefore, thai the issue of standing has not yet been settled.
Further, as the amount in controversy is less than $25,000,00, this matter should
be schedulcd for arbitration, not a bench trial.

Notice to Defend.
Pa. R.C.P. 1018.I(a) makes it mandatory that every complaint contain a notice to
defend in the foml prescribed by Rule 1018.I(b). What possible need the defendants
have for a notice to defend escapes us. Their attorney commenced this action by filing an
appeal from a district justice award in favor of plain tiff. He isslled a rule upon plaintiff to
file a complaint. To insist that the complaint be stricken for failure to attach a notice to
defend places a great deal of reliance on form to the detriment of substance. In any
event, the rules do require that a notice to defend be attached to the complaint.
Otherwise, no answer need be filed. (Pa. R.C.P. 1026(a)). Therefore, we suggest that
plaintiff comply with Rule 1018.1 by attaching a notice to defend to his next amended
complaint.
Specificity.
Plaintiff has made great strides in conforming his complaint to the dictates ofPa.
R.C.P. 1019. In fact, the current complaint comes very close to surviving the preliminary
objection based upon lack of specificity. Separate paragraphs selling forth the name of
the property owner, the existence of thc power of attorney and the approximate dates
upon which the alleged tree cutting took place will be sufficient to cure any remaining
objeetions.3
Verification.
Pa. R.C.P. 1024 requires that every llleading containing an averment of fact must
be verified. The complaint obviously contains averments of fact and is not verified. A

Thc Defcndants. Capital Trcc and Nursery. Inc. ,1I1d Jerry Shaeffcr, have filed Preliminary
Objections to Plaintiffs Complaint duc to thc Plaintitrs fililure to avcrallegations ofDefcndants'
negligence with the required specificity mandated by Pa. R.C.P. 1019(a). 42 Pa. C.S.A. In his
Complaint, the Plaintiff alleges Defendants' negligcnce eonsistcd. in part. of:
Defcndant(s) removed thrce (3) hemlock trccs...fi'om the property...
Defcndant(s) were not contracted by properly owner to remove thc
three (3) trecs.
Clearly, such vague and conclusory allegations arc not allowcd by Rule 10 19(a) and should bc
stricken from the Plaintiffs Complaint. When addressing similar allegations of negligence in
indicated:
Connor v Allel!henv General Hospital. SOl Pa. 306. 461 A,2d 600 (1983), the Supreme Court
"If the appellee did not know how it otherwise failed to use due care
and caution under the circumstances. it could have filed a Preliminary
Objection in the nature ofa request for a more spccific
pleading or could have moved to strike that portion of thc appellant's
Complaint."
Pennsylvania employs a "Fact Pleading Procedure" which requircs that every act or
performance esscntial in defining issues must be set forth with particularity in the Complaint.
Goodrich.Amram, 2.d I 019(a) (5). Accordingly, the Superior Court in Weiss v Eouibank. 313 Pa.
Super. 446, 460 A.2d 271 (1983) notcd:
Pcnnsylvania Rule of Civil Procedure 1019(a) provides that the
"material facts on which a cause of action..,..is based shall be stated in a
concise and summary form", This has been interpretedto mean that the
Complaint must apprise the defendant of the nature and extent of the
plaintiffs claim so that thc defcndant has notice of what thc plaintiff
intends to prove at trial and may prepare to meet such proof with his
own evidcnce,
As the court stressed, the purpose of Rule 10 19(a) and the "Fact Plcading Procedure" is to
ensure that thc Complaint is sufficiently clcar in order to enable the Defendants, Capital Tree and

BY THIS DOCUMENT. I AM FILING A CIVIL COMPLAINT AGAINST THE ABOVE NAMED DEFENDANT(S),
SPECIFICALLY AS FOLLOWS:
1. Defendant(s) was never called by property owner of 2303 Market Street, Camp Hill, PA 17011.
2. Defendant(s) cut down three (3) hemlock trees from property at 2303 Market St., camp Hill, PA 17011.
3. Defendant(s) removed the three(3) tree stumps of the three(3) hemlock trees.
4. Defendant(s) damaged the lawn during the removal of the three(3) trees and stumps,
5. The three(3) hemlock trees were each fifty(50) feet tall.
6, The three(3) hemlock trees were too large to replace.
7. The largest replacement hemlock trees available are nineteen (19) - twenty-four(24) feet maximum.
S, The cost of the largest replacement trees are $2500 each.
9. A 24' tall tree valued at $2500 averages out to $1 04/foot.
10. This makes the value of 50' tall trees at $5200 each.
11. The total damages for the three(3) hemlock trees cut down is $15.600.
12, The cost to repair the damaged lawn is $500,
13. Defendant(s) was not authorized by property owner to remove the three(3) hemlock trees,
14. This Civil Complaint is being filed to recoup the value of the three(3) hemlock trees and to repair
the damage to the lawn caused by the removal of the three(3) hemlock tree stumps,
15. The total damages are $16,100 and this amount of money paid to the plaintiff will settle the
Civil Complaint.
