being recorded in the Office of the Recorder of Deeds of Cumberland
County on September 29,1997 in Mortgage Book Volume 1407, Page 547.
A true and correct copy of said Mortgage containing a description
of the premises subject to said Mortgage is marked Exhibit "B",
attached hereto and made a part hereof.
5. Alternative assigned said Mortgage and Note to IMC
Mortgage Company Mortgage Inc. pursuant to the terms of a written
agreement.
7. Defendants are the record and real owners of the
aforesaid mortgaged premises.
8. Defendants are in default under the terms of the
aforesaid Mortgage and Note for, inter alia, failure to pay the
monthly installments of principal and interest on said Note when
due. Defendants are due for the October 18, 1997 payment.
9. On or about June 5, 1998, Defendants were mailed
Notices of Homeowner's Emergency Mortgage Assistance Act of 1983,
in compliance with the Homeowner's Emergency Mortgage Assistance
Act, Act 91 of 1983. True and correct copies of said Notices are
marked Exhibit "CD, attached hereto and made a part hereof.
10. On or about June 5, 1998, Defendants were mailed
Notices of Intention to Foreclose Mortgage in compliance with Act
6 of 1974, 41 P.S. ~101, et seq. True and correct copies of said
Notices are marked Exhibit "D", attached hereto and made a part
hereof.
