AMENDED COMPLAINT
AND NOW COMES Plaintiff, Boscov's Department Store, Inc.,
by and through counsel, DeSantis, DeSantis & Essig, and for
its Amended Complaint against Defendant, Dorrel F. Rozman,
provides the following:
1. Plaintiff, Boscov's Department Store, Inc., is a
Pennsylvania Corporation with its principle office located at
4500 perkiomen Avenue, Reading, Berks County, Pennsylvania.
2. Defendant, Dorrel F. Rozman, is an adult individual
with an address of 1618 Chatham Road, Camp Hill, Cumberland
County, Pennsylvania.
3. On or about November 15, 1998, Defendant, Dorrel F,
Rozman, applied for and was subsequently issued a Boscov's
charge account (No. 100423502). Defendant's application for a
Boscov's charge account is attached hereto and incorporated
herein as Exhibit "A".
4. When applying for a Boscov's charge account,
Defendants agreed to and accepted the terms of the Boscov's
Retail Installment Credit Agreement, attached hereto and
incorporated herein as Exhibit "B".
5. Defendant made various purchases and payments from
time to time on her Boscov's charge account.
6. In connection with obtaining goods and services from
Plaintiff, Boscov's Department store, Inc., Defendant, Dorrel
F. Rozman, agreed and did promise to pay for same,
7, All credits, if any, to which Defendant, Dorrel F.
Rozman, is entitled, have been given to her and are reflected
on her account.
8. As of March 25, 1998, the outstanding balance of
Defendant, Dorrel F. Rozman's, charge account was One Thousand
Three Hundred Seventy-One Dollars and Seventeen Cents
($1,371.17). (Exhibit "C") , No payments on the account have
been made as of the date of filing this Amended complaint.
9. Plaintiff, Boscov's Department Store, Inc., has
demanded and continues to demand payment in the amount due
from Defendant on her Boscov's charge account, but Defendant,
Dorrel F. Rozman, has refused and continues to refuse to pay
said amount.
10. Pursuant to the Installment Credit Agreement,
Defendant is also obligated to pay interest on any outstanding
balance at a rate of 21%. (Exhibit "B").
11. Pursuant to the Boscov's Retail Installment Credit
Agreement, Defendant is obligated to pay reasonable attorney's
fees and court costs with the collection of past due payments.

WHEREFORE, Plaintiff, Boscov's Department store, Inc.,
respectfully requests that this Honorable Court enter a
judgment in its favor and against Defendant, Dorrel F. Rozman,
in the amount of One Thousand Three Hundred Seventy-One
Dollars and Seventeen Cents ($1,371.17), plus applicable
interest, costs and reasonable attorney fees.

AND NOW COMES Plaintiff, Boscov's Department store, Inc"
by and through counsel, Desantis, Desantis & Essig, and for
its Complaint against Defendant, Dorrel F. Rozman, provides
the following:
1. Plaintiff, Boscov's Department Store, Inc., is a
Pennsylvania Corporation with its principle office located at
4500 Perkiomen Avenue, Reading, Berks County, Pennsylvania.
2. Defendant, Dorrel F. Rozman, is an adult individual
with an address of 1618 Chatham Road, Camp Hill, Cumberland
County, Pennsylvania,
3. On or about November 15, 1998, Defendant, Dorrel F,
Rozman, applied for and was subsequently issued a Boscov's
charge account (No. 100423502). Defendant's application for a
Boscov's charge account is attached hereto and incorporated
herein as Exhibit "A".
4. Defendant made various purchases and payments from
time to time on her Boscov's charge account.
VERIFICATION
I, Stanley J. Burke, Esquire, depose and say that I am
the attorney for Plaintiff, Boscov's Department Store, Inc.,
and as such, am authorized to verify that said statements made
in the foregoing Complaint to the best of my knowledge and
understanding. I understand that false statements herein are

that all credits and debits arc accurately relleeted in the statement of account provided by

inception up through the prcsent time.
9. ADMITTED that Plaintiff~ its agents, servants and employees have made
harassing telephone calls to Defendant's residence and place of employment demanding
repayment. ADMITTED that Plaintiff, its agents, servants and employees have made these calls
despite requests to cease and desist. ADMITTED that Plaintiff, its agents, servants and
employees utilize an automated dialer which tics up the Defendant's telephone line by making
repeated telephone calls. ADMITTED that Defendant has refused to pay the sum of $1,317,17.
Defendant incorporates by reference her responses in ~7 and ~8 as though fully set forth.
10. ADMITTED that Exhibit "8" states the interest rate for all accounts is 21 %. It is
specifically DENIED that Exhibit "13" was the Installment Credit Agreement in effect since the
account was opened in November 1989. Defendant demands strict proof at trial that Exhibit "8"
was in effect since the account's inception in 1989.

4. DENIED AS STATIm. Delendant's New Maller sets forth illegal debt
collection practices by the Plaintilf which arc in violation of thc Unlilir Trade Practices and
Consumcr Protection Law (UTPCPL). 73 I'.S. *201-3.1, and thc Pennsylvania Bureau of
Consumer Protection's Debt Collection Trade Practices Regulations set forth in 37 Pa. Code.
*303.1. Defendant's New Matter states a claim for limiting Dclcndant's ability to use her
telephone when receiving repeated telephone calls from Boscov's automated computer dialer. It
is alleged that Boseov's automated computer dialer docs not cease making calls unless Defendant
either answers the telephone call or takes the phone off the hook. In either event. Plaintif'l's
conduct limits Defendant's use of public utility and is calculated to harass and annoy.
5. DENIED AS STATED. ~S of Plaintiff's Preliminary Objections to Defendant's
New Matter is a conclusion of law to which no response is requircd. If a response wcre required,

14. Plaintiff's automated computer dialer is designcd to harass. oppress. and annoy thc
Defendant and similarly situated individuals who arc the targct of the credit collection
department's efforts.
15. Plaintiff: its employees, agents and servants have made long distance telephone
calls to Defendant's place of employment.
16. Plaintiff, its employees, agents and servants have madc long distance telephone
calls to Defendant's residence on weekends and late in the evening.
17. Plaintiff, its employees, agents and servants have actual and constructive
knowledge that Defendant did not wish to be contacted by telephone at either her residence or
place of employment.
18. Plaintiff: its employees, agents and servants ignored said requests and continued
their harassing telephone calls.
19. Plaintiffs conduct is in violation of thc Pennsylvania Bureau of Consumer
Protection's Debt Collection Trade Practices Regulations set forth in 37 Pa. Code. *303.1.
20. Plaintiffs conduct is in violation of the Unfair Trade Practices and Consumer
Protection Law, 73 P.S. *201-3.1.
