The Plaintiff is Citibank (South Dakota) N,A" a nationally charted banking institution with a place of business located at 7930 NW 110th Street, Kansas City, MO 64153, 2, The Defendant is ROBERT J SMITH, with a place of residence located at 39 OAK AVE, CAMP HILL, PA 17011-4238, 3. At the request of the Defendant, Plaintiff issued to Defendant a Citibank Mastercard credit card, account #5424180240508751; and at all times relevant hereto, Defendant was the holder of said card issued through the Plaintiff's credit facilities, A true and correct copy of Defendant's application is attached hereto, made a part hereof and marked Exhibit "A", 4, Defendant, upon acceptance and use of the Plaintiff's credit card, agreed to be bound by the terms and conditions of Plaintiff's revolving credit plan. A true and correct copy of said Agreement is attached hereto, made a part hereof and marked Exhibit "B", 5. In accordance with the terms of Exhibit "B", the Defendant agreed to pay the Plaintiff a finance/service charge on all sums due at an annual percentage rate 19,80% and the Plaintiff is entitled to additional finance/service charges from 06-13-98, 6, The Defendant subsequently used the said credit card, As of 06-13-98, the Defendant had incurred charges in the sum of $ $7,815.53, no part of which has been paid although duly demanded, 7, In accordance with the terms of Exhibit. "B", Defendant agreed to pay Plaintiff a reasonable attorney's fee if the account was referred to an attorney for collection and Plaintiff will incur an attorney's fee in the amount of $1,563,00, COUNT III 14. Plaintiff incorporates hereto paragraphs 1 through 13 of its Civil Action as if said paragraphs were set forth here at length, 15.
