WHEREAS. KOLLAS AND COSTOPOULOS. of 1104 Fernwood Avcnuc. Camp
Hill, Cumberland Comity, Pennsylvania, hereinafter referred to as Owner, is about to execute
contemporaneously herewith, a contract, with BRIM BUILDERS, INC., for the erection of a housc
ancillary to development in a complex known as Wertz Run Heights, Cumberland County,
Pennsylvania, construetion deseribed as follows:
ALL THOSE CERTAIN tracts or parcels of ground on Lot Nos. 88, 129, andl30 of
North Middleton Township, Cumberland COImty, Pennsylvania, more particularly bounded and
described as set forth in Exhibit "A" attached hereto and made a part hereof.
NOW, this 16th day of July, 1998, at the time of and immediately before the execution
of the principal contraet dated July 6, 1998, and before any authority has been given by the said
Owner, to the said Contraetor to commenee work on the said building, or purchase materials for the
same in consideration of the marking of the said contract with Owner, and the further consideration
of One Dollar and 00/100 ($1.00), to Contractor paid by Owner, it is agreed that no lien shall be filed
against the building by the contractor, or any sub-contraetor, nor by any of the material men or
workmen or any other person for any labor, or materials purchased, or extra labor or materials
purchased for the ereetioll of said building, the right to file sueh liens being eKpressly waived.

BEGINNING at a point, said point being on located the Western
right-of-way line of Longstreet Drive at the Common Front Proparty
Corner of l.ot 1129 and Lot 1130 of Wertz Run Heights, Phase 2;
Thence along Lot 1129 North 52 degrees 45 minutes 00 seconds West,
a distance of 150.00 feet to a point at other land now or late of
Kollas and Costopoulos, Wertz Run Heights, Phase 3; Thence along
other land now or late of Kollas and costopoulos, Wertz Run
Heights, Phase 3, North 37 degrees 15 minutes 00 seconds East, a
distance 120.00 feet to a point on the Southern right-of-way line
of Ridge Avenue; Thence along the southern right-of-way of Ridge
Avenue South 52 degrees 45 minutes 00 seconds East, a distance of
130.00 feet to a point at the start of a curve connecting the
Southern right-of-way line of Ridge Avenue with the Western right-
of-way line of Longstreet Drive; Thence along said curve in an
Easterly direction curving to right having a radius of 20.00 feet,
an arc length of 31.42 feet and a central angle of 90 degrees 00
minutes 00 seconds to a point on the Western right-of-way line of
Longstreet Drive; Thence along the Western right-of-way line of
