Shover, who resides at 54A Garden Parkway in Carlisle, Cumberland County, Pennsylvania. 3. The Plaintiff, Stefannie S. Shover and the Defendant are the parents of three minor children, Amanda L, Shover, age 7, born 1 March 1991, Hailey A. Shover, age 7, born 1 March 1991, and Emily A. Shover, age 3, born 5 April 1995. 4. Plaintiff seeks custody of the three minor children, Amanda L. Shover, age 7, born 1 March 1991, Hailey A. Shover, age 7, born 1 March 1991, and Emily A. Shover, age 3, born 5 April 1995. 5. The children were not born out of wedlock and are presently in the custody of the Plaintiff. 6. During the past five years, the minor children have resided with the following persons at the following addresses: 1993. January of 1998 With both the Mother and Father Various Addresses In Carlisle (Except for one month in 1994 when the parents were separated and all three children resided with the Mother and the other two Plaintiffs in Mechanicsburg.) ~ January 1998 ' April 1998 Wilh the Father 8 Garden Parkway Carlisle, PA April 1998 . mid June 1998 Emily and Hailey have Resided with the Plaintiffs 25 Warwick Circle Mechanicsburg, PA 8 Garden Parkway Carlisle, PA Amanda has resided with The Defendant Mid June 1998 to present All three children resided With Plainli11 25 Warwick Circle Mechanicsburg, PA 7. Timothy Sperry and Joyce Sperry are the parents of the Plaintiff, Stefannie S, Shover and are the maternal grandparents of the subject children. 8. The Plaintiffs live at that address with the children Amanda, Hailey, and Emily. 9. The Defendant resides with his sister, Kelly Shover. 10, The Plaintiff has not participated as a party or in any other way in any litigation concerning the custody of the children in this or any other court. The Plaintiff has no information of a custody proceeding concerning the children pending in a court of this or any other jurisdiction. Plaintiff knows of no other person not a party to this action already who has physical custody of or claims to have custody or visitation rights with the said children. 11. The Plaintiffs believes that the best interests of the children will be served by awarding primary physical custody of all three of the children to Plaintiffs for the following reasons: A. The Defendant does not have adequate living quarters for the children; and B. Amanda has health problerm which are aggravated by the constant smoking of the Defendant; and C. The Defendant neglects the children by failing to treat their medical conditions. by failing to keep them clean and presentable for school, and by generally failing to provide adequately for their needs; and D. The Plaintiffs are providing a good and suitable home for the children and can provide a much better home for them than can the Defendant; and E. The Plaintiff, Stefannie S. Shover has been the primary care provider of the children for almost all of their lives. 12. Each parent whose parental rights to the children have not been terminated and the person who has physical custody of the children have been named as parties to this action. WHEREFORE. Stefannie S. Shover shall enjoy periods of temporary physical custody with the 3 minor children at such times and under such circumstances as agreed upon by the parties. 3, In the event the Father becomes dissatisfied with the temporary custody arrangement and desires a more specified schedule or otherwise wants to modify this Order, the Father may petition the court to have the case again scheduled with the Custody Conciliator for a Conference. It is noted that the Father was not in attendance at the Custody Conciliation Conference and, in the event of any future conference or Court hearing, the Father can at that time raise whatever issues he feels may be appropriate for consideration by the Court. The pertinent information pertaining to the children who are the subject of this litigation is as follows: Amanda 1. Shover, born March 1,1991; Hailey A. Shover, born March I, 1991; and Emily A. Shover, born April 5, 1995. 2, A Conciliation Conference was held on October 22, 1998, with the following individuals in attendance: The Mother Stefannie S. Shover and the maternal grandmother Joyce Sperry along with their counsel Samuel Andes, Esquire; the Father did not appear, Attorney Andes indicated that the Father was served with notice of the conference. Furthermore, the Mother indicated that she has had discussions with the Father and he acknowledged that he was aware of the date of the conference but that he was not planning to attend because of his work schedule. 3, The 3 minor children have been in the custody of the Mother and the maternal grandparents for the past 4-5 months. Father is seeing the children pursuant to an existing flexible arrangement between the Mother and Father.
